This Scoop.it webpage analyzes the event of Rete 4, third channel of Silvio Berlusconi's Mediaset, in a media ethical perspective. I report the main media debate and production around this issue, to point out the anomalies of the Italian media system. Rete 4's history highlights important media ethical issues such as abuse of power, conflict of interests, lack of pluralism, and ambivalences of the media free market. These features are outcome of the concetration of media and political power in the hands of Berlusconi: a dangerous aspect which further thickens the link between these two deeply woven fields.

Vittorio Feltri, in 2008 director of "Libero", one of the newspapers closest to Berlusconi, was asked what his newspaper reported about the sentence of European Union in favor of Europa 7. This could be an oppurtunity to discover, and then report on this page, how right-wing media covered the issue. However Feltri affirms to not even know what the interviewer is talking about.

 

I cannot report on this page much of right-wing media's coverage of  Rete 4, not because politically I am politically biased, but  because there is not an actual coverage.

The conflict of interests not only involves media and politics, also football seems to be subjected to a dirty mechanism. In 2011 Italian "Lega Calcio" wanted to offer the rights to broadcast matches of Italian championships to Mediaset, rather than sell them to Europa 7, which offered more than 5 million euros. Up to you any consideration.

Antonio di Pietro, magistrate of the famous inquiry "mani pulite" (1992) which discovered the mechanism of bribes between private companies and political parties, posts a reflection on the situation.

He argues that a missed support by the leftwing Partito Democratico to the law against Rete 4 in compliance with the European normative of 2008 "stinks". Di Pietro alludes to a system of economic and political favors, compromises, which unites all the parties, despite their fictious political diversity. Di Pietro enemies of "tangentopoli" seems not be so faraway.

The interview to Mediaset's President, Fedele Confaloniere highlights a clash of perspective. Confalonieri states how in a liberal perspective "what is not explicitly banned, is permitted". He refers to the wild occupation of the ether by the private players as an achievement of the freedom of expression and of liberal entrepreneurship. Nevetheless Confalonieri seems not to consider how that "freedom" has later deprived him of his freedom and right to broadcast.

 

When a wild deregulated free media market loses its being free and becomes tool of the strongest power.

Gasparri's Law is not in compliance with the European normative. The government continues to delay the issue. It gives to Europa 7 a frequency from RAI, but it is not enough to broadcast on national level. In anycase, Rete 4 is not touched. Thus Italy exceeds the ultimatum established by the European Court of Justice and has to pay an ingent fine for not having respect Di Stefano's rights. Therefore, not only Di Stefano, but also Italian citizens have to pay the price of Rete 4's abuse. However, as showed in the confrontation with other European countries, Italian citizens has always paid for a lacking of pluralism in the media sector. The most ingent costs of Berlusconi's monopoly are not nearly pecuniary.

In 1999, the public race for the concession of the TV frequencies is lost by Rete 4. Instead, Francesco Di Stefano won the concession for his Europa 7. Nevertheless, despite the concession, the frequencies are occupied by Rete 4. The price of the "original sin" becomes evident, and Di Stefano is forced to undertake a long Odissey through complaints, plea and trials . The challenge is very hard against a power affected by a strong conflict of interests.

 

Gasparri's Law in 2003 serves to overturn once again the Constitutional Court verdict. The advent of digital TV is used as a pretext to spread the antitrust limit on both analog and digital. Nevertheless, in Italy, the digital TV had not come yet. The changes of the media ecosystem are freezed to maintain the old powers.

In 1994, the Constitutional Court considers unconstitutional Mammì's Law. The same private player cannot own three channels on the analog. In two years Rete 4 has to free "its" frequencies. However, Berlusconi's party succeeds in extend the ultimatum through a compromise with the left wing governemnt.

 

The debate on the media become highly politicized. It points out strong conflict of interests, and the suspect of bribes to political parties by the main media companies. Compromises and exchanges of favors seems to be the guidelines of a dangerous political/media path.

"The Original Sin": in 1974, Italian Constitutional Court establishes the liberalization of the frequencies market, but without providing a new plan for the concession of the TV frequencies. Thus, it starts a struggle for the abusive occupation of the frequencies by the private players. The "Far West of the ether" is won by Silvio Berlusconi. From that moment, Berlusconi's monopoly can prosper thanks to the endorsement of the governments and a series of manifactured judiciary cavils, at the expense of the other players and of fair competition. The main victim of this story is Francesco Di Stefano, winner in 1999 of concession for his channel Europa 7, but unable to broadcast because his frequencies are abusively occupied by Berlusconi's Rete 4.

Emilio Fede, who thanks is highly debated news TG4 has become the symbol of Rete 4, got angry with part of his news editorial staff because they had not thanked Berlusconi's government for the approval of Gasparri's Law in Parliament. The pressure of the director in the name of freedom, actually turns to be a forcing and a limit to his staff - a limit to the freedom of information and to diversity in the editorial environment.

The profits of Rete 4, the empty pockets of the citizens. The conclusion by Alessandra Mussolini, senator of Berlusconi's party Forza Italia, underlines how the debate on Rete 4/Europa 7's issue cannot be a priority in the political agenda, when there are many Neapolitan families without a television.

 

I just wonder whether Mussolini will tell those Neapolitan people they have to pay a fine for the abuse of a network they can not even watch.

"The reasonable development". In 1997, Maccanico's Law establishes that Rete 4 must move to the satellite because in excess. However, the law states that the move of the channel from the analog will happen when the technology of the satellite will have reached a "reasonable development", without precising what does it mean. Another manifactured judiciary cavils upon which Berlusconi can hang on.

The ideal of pluralism of information, fostered by Berlusconi himself to obtain the liberalization of the market, is then sacrificed once Mediaset obtained its monopoly of the private TV. The following antitrust laws, requested by Constitutional Court to ripristin the pluralism in Italian TV system, turn to be manifactured procedures to defend Berlusconi's interests. First step: Mammì's Law (1990). The law establishes the maximum limit of 25% for each player. However it considers 12 national channels in the ether, when actually the channels were only 11. Berlusconi's channel were 3. To you the solution of the problem.
