“No matter what side you’re on, it’s a broken system,” said restaurateur Kevin Boehm, partner in Boka Restaurant Group, a multiconcept operation based in Chicago. His comment opened an industry panel on tipping presented on Sunday in Chicago by Union Square Hospitality Group, Danny Meyer’s restaurant company and a pioneer in exploring alternatives to compensating servers through tips. USHG introduced its “hospitality included” no-tipping policy last fall. Since then, the model has been a hot topic of discussion in the industry, with most restaurateurs taking a wait-and-see approach as they learn from the leaders. Five of those leaders’ top learnings, hits and misses were revealed during the panel.

Last year TechCrunch estimated the takeout and delivery market overall is about $70 billion, with close to 13 percent of that coming from digital sales, though the trend was still in very early stages. Data management provider 1010data, meanwhile, recently estimated the food delivery market grew about 40 percent in 2015 compared with the prior year in both total number of orders and dollars spent.

In 2008 the US economy crashed. People were freaking out… especially brick and mortar business owners. As sales dipped, local merchants flirted with the most dangerous marketing device ever created: the daily deal. The daily deal, while innocuous on the surface, was probably the most detrimental action any business owner could have taken. Think about the math behind it: a third party sells your product, which normally costs $100, for $50. THEN, the third party takes half of that ($25). The business owner earns $25 for a $100 worth of product. Keep in mind the average business owner ekes a 5% margin on average. In order to reach breakeven on the marketing, the customer who bought that $50 daily deal would need to return – at full price- a staggering 14 times! You start to think about how many times the average person eats out per month, the kinds of customers who are interested in 50% off, and these metrics look ever worse for business owners.

If you sell pizza and are the owner of a pizza business, a nutritionist of a school, the head chef of a restaurant, the person in charge of the operations of a large pizza chain, convenience store or grocery store, or a foodservice consultant, don’t overlook the importance of the portioning process. Especially how your whole pizza is portioned for each customer. Keep in mind no longer will the consumer just open a pizza box and grab a slice of pizza. The growing trend with portioning and calorie transparency will mean before the consumer bites into a slice of pizza, they will see the size of the slices of pizza, compare the slices to what is advertised on the menu, then eat. If the slices don’t match the calories or the appropriate size of the pizza and slices as advertised on the menu, you might be the next subject on Jeff Rossen’s investigative report.

Class-action lawsuits over “side work” by restaurant employees who get tip-credit pay show signs of increasing, one industry legal expert says. This week, a server at a Ruby Tuesday restaurant in Hixson, Tenn., filed a class-action lawsuit in U.S. District Court in Chattanooga, claiming that the chain underpaid its servers and bartenders for "side work" such as cutting lemons, filling ice bins and rolling silverware.

In a case with possible implications for any restaurant serving iced drinks, a woman has sued Starbucks for delivering fewer ounces of chilled beverages than it promises. The plaintiff wants $5 million in compensation for customers who were shortchanged on the iced drinks they bought at the coffee chain during the last 10 years. She argues that they were promised a certain volume of whatever chilled drink they’d purchased—24 ounces, in the case of a venti-sized order. In fact, alleges Stacey Pincus, the liquid ounces fell far below that promised amount because much of the cup was filled with ice. The chain is actually promising a certain size of cup, not a set volume of beverage, according to Pincus.

ATLANTA & PRINCETON, N.J.--(BUSINESS WIRE)--Global Payments Inc. (NYSE: GPN), a leading worldwide provider of payment technology services, and Heartland Payment Systems, Inc. (NYSE: HPY), one of the nation’s largest payment companies, announced today that Heartland stockholders voted to approve the proposal relating to Heartland’s merger with Global Payments. Approximately 29.7 million shares were voted in favor of the merger proposal. The favorable vote represents approximately 99% of the total Heartland shares which voted on the merger proposal and 80% of the total outstanding Heartland share count.

Chef Robert Irvine has spent the past five years attempting to save 140 failing restaurants across America for the Food Network show "Restaurant: Impossible". Of the 137 restaurants aired, 82, or 60%, have closed since their makeovers, according to the blog Food Network Gossip. That's actually not bad, since these restaurants were so poorly managed that Irvine and his team only took the job if there was essentially a 100% chance of imminent failure. In fact, according to a frequently cited study by Ohio State University on failed restaurants, 60% do not make it past the first year, and 80% go under in five years.

In the last several months, insect protein has made major inroads with investors and consumers. Earlier this month, following a $1.6 million seed round in the fall of 2014, Exo raised $4 million in Series A financing. And while Exo doesn’t release sales figures, another cricket-protein startup, Chapul, more than quadrupled its annual revenue from 2014 to 2015, from about $70,000 to just over $300,000, and is on track to bring in more than $1 million this year.
