Currently, the USFDA has not approved Kratom as food supplement or medicine.  The Kratom leaves and alkaloids are not however included in the Controlled Substances Act schedule.  This means that it is safe to have them in possession.  As far as side effect is concerned, it is advised that users of Kratom should not drive or operate machinery as it can make people sleepy and even doze off.  The issue in the U.S. is that some states have passed bills to restrict the use of Kratom.  Some of them have included the alkaloids of Kratom in their controlled substances list.
