In these cases, many departments employ a legal professional (usually an officer in the command staff) who is trained as an attorney, mediator, or abitrator. This officer responds to the scene and mediates a resolution. I have personally witnessed this type of case be mediated to an apology and compensation for losses. The officers involved learn something about how this affects innocent "suspects"; and the citizens feel better about a department that will fix its own mistakes.

No Right to Strike: Calvin Coolidge and the Boston Police Strike of 1919

Here's a little of our own history juxtaposed against the current Bolivian situation. I'd have to agree with Coolidge: The Police have no right to strike. But see my earlier comments about the dependency this places the police on the current political status quo. Is it fair to attack police for "profiling" when those in power want to place the emphasis on "crime control" and "keeping the public peace" even though the people may not support these policies?

Police need to be autonomous from the political bodies that provide funding and write the laws that the police enforce. Without autonomy, the police become the "brown shirts" for unethical regimes. Yet, we need police oversight. If the community is the customer and oversight, we may end up with too much local mores and favoritism for the "locals sons" vs. outsiders. Citizen oversight boards and professional ombudsmen are both often accused of going "native" becoming rubber stamps for whatever the cops want. Perhaps Inspector General positions made up of retired judges would be an appropriate remedy?

What's the rule with criminal defendents? The article implies that the general public can't see the evidence before an interview. While technically correct, a citizen CAN refuse to be interviewed persuant to Miranda v. Arizona and then "sees" the evidence through discovery before trial. Police officers in California cannot refuse to be interviewed (although any coerced testimony cannot be used in a subsequent criminal trial).
The best policy is to tell the whole truth when interviewed, but all sides need to take this testimony with the knowledge that different players have different perspectives and will perceive things differently. These are not lies and shouldn't be treated as such.

How does one deal with a police mutiny? Do officers have a right to strike? Most would say that they do not have a right to strike, but this puts officers in a position of having to follow "lawful orders" on the one hand (along with protecting the Constitution), but having no real means of protesting conditions that violate these values (or which violate a fair wage or working conditions). How can the New Public Administration work in these situations? How can officers truly stand up for equality? Isn't this precluded by the limits placed on officers?
