Howard Lederer Asks Judge to Consider Impact of Dicristina "Game of Skill" Ruling | Pokerfuse | Hit by the deck | Scoop.it

Howard Lederer’s lawyers have been quick off the mark and written to the Federal Court asking for a conference to discuss the impact of the recent ruling by US District Court Judge Weinstein on the Lederer’s outstanding civil charges.

In US v Dicristina, Eastern District of New York Judge Jack Weinstein ruled that poker is a game of skill and therefore the Illegal Gambling Business Act (IGBA) does not apply. Lederer now wants a “status conference” with Judge Leonard Sand and the prosecution in the Southern District of New York.

The legalese and deferential tone of the letter do not detract from the intended message: If poker does not constitute illegal gambling, then why are the charges not dropped, or at least put on hold until you hear whether the ruling is sustained on appeal?

Shock News: Jason Mercier Hits A Downswing | OnlinePoker.net | Hit by the deck | Scoop.it

The game of poker contains a great deal of variance and nowhere is this more true than in tournament poker where pros can go months without cashing, thus skewing a players perception of reality and affecting their play.
However, Jason Mercier is one pro who seems to have remained relatively free from the sickly influence of high-variance in tournaments giving rise to the expression “running like Jason Mercier.” Since cashing in at his first tournament in 2008, Mercier has been on an incredible hot streak and notched up $7,852,900 in winnings, recording seven figure scores each and every year along the way. Nevertheless, the 25 year old now appears to have encountered his first real downswing and so far in 2012 has earned just $265,529 from tournaments.

GOP Convention Passes Platform That Includes Anti-Online Poker Stance | PokerNewsDaily | Hit by the deck | Scoop.it
With slightly more than two months left until the 2012 Presidential Elections, both the Republican (GOP) and Democratic parties are going through the process of naming their nominees. While it was long ago concluded that former Massachusetts Governor Mitt Romney would be the GOP selection and incumbent President Barack Obama the Democratic choice, it is a piece of the platform passed by the GOP that has raised the ire of poker players in the United States.

The GOP platform – the statement of positions that the party will advocate for arguing for its election to office – was passed on Tuesday during their convention in Tampa, FL, and the question of online gaming and poker was a plank of said platform. Although it was buried deep within their 62-page position (on Page 32, to be exact), it still has drawn considerable fire for the position that the Republicans plan to take should they earn election in November.

What version of the Absolute Poker story will be portrayed to the public ? | Pokerfuse | Hit by the deck | Scoop.it
While browsing through poker media sites as I am prone to doing, I came across a video clip that was making its way through some of the media outlets. It was an interview on CNBC’s “Squawk Box” with popular author Ben Mezrich, famous for such books as Bringing Down the House which popularized the MIT Blackjack card counting syndicate and The Accidental Billionaires which depicted the rise of Facebook.

In the interview, Mezrich talked about his new book that would be released next summer. He claims it’s about “a bunch of college kids that launched the online poker world” from a dorm room at the University of Montana. He claimed these unfortunate kids were “being persecuted” for doing what Mezrich believes to be something that was after all, “very American.” The online poker site he is referring to is Absolute Poker.

WSOP success for Somerville 2.0 | ESPN Poker

The difference in skill level of the top poker players in the world is measured by percentile to the far right of the decimal point. Where in sports we see distinct and measurable advantages in speed, strength, coordination and build, the causes of poker success are far subtler. When a player's chosen instrument of battle (the brain) suffers the cerebral equivalent of chronic knee pain, the signs aren't quite so obvious. This is why life balance is so often cited as crucial to poker.

Jason Somerville has never lacked results. The 25-year-old professional scored a pair of final table appearances at the 2009 World Series of Poker and hasn't looked back since. Over the course of the past three years, he's put together eight six-figure cashes, one bracelet win and winnings exceeding $2.4 million in live tournament play despite the burden of a massive secret he'd carried for longer than even he had realized. That burden has now been lifted, which should be a scary thing for those who face him across the table. The version of Somerville they see now -- which you'll see on Tuesday's ESPN broadcast of the WSOP main event -- is really only experiencing life balance and peace of mind for the first time.

NY judge: Poker's not gambling under federal law | Wall Street Journal

NY judge: Poker's not gambling under federal law | Wall Street Journal | Hit by the deck | Scoop.it
NEW YORK — A federal judge in New York has handed a victory to poker advocates, ruling that the card game is not gambling under federal law because it is primarily a game of skill, not chance.

The decision Tuesday by Judge Jack Weinstein in Brooklyn is likely to be embraced by advocates of card games who are pushing to legalize Internet poker in the United States.

The ruling resulted in the dismissal of a federal criminal indictment against a man convicted last month of conspiring to operate an illegal underground poker club. The judge relied in his decision largely on findings by a defense expert who analyzed Internet poker games. Weinstein noted that the federal statute was created to combat organized crime

Lawyers did not immediately respond to phone messages for comment.

Why is the DOJ Appointing a Third Party to Repay Full Tilt US Balances? | Pokerfuse | Hit by the deck | Scoop.it
Why is the DOJ not using PokerStars to handle repayments to US players? The deal between the DOJ and PokerStars will result in the DOJ appointing a claims processor to refund US players balances while players in the rest of the world will have their balances managed by PokerStars.

PokerStars has already made full repayment to all its own former US players following the Black Friday shut down. It did so completely within the law and under the oversight of the DOJ. The announcement that the DOJ is seeking to appoint a third party claims processor to handle repayments seems hard to understand from a practical point of view.

Inside Warren Buffett's Private Poker Game | Forbes | Hit by the deck | Scoop.it

Warren Buffett is a famously world-class bridge player, putting in 12 hours a week at the table, often with Bill Gates, and sponsoring the Buffett Cup, which mimics golf’s Ryder Cup, except with cards. “Every hand fascinates me,” he recently told me, in explaining this obsession. But relatively quietly, over the past seven years he’s emerged as the host of one of the planet’s most exclusive poker games.

While the World Series of Poker Main Event remains the most famous and prestigious tournament, a ten-day-long bacchanal that satisfies ESPN’s late-night programming needs for months, it’s also open to anyone with $10,000 and a dream. The NetJets Poker Invitational, run by Berkshire Hathaway‘s private-jet subsidiary, has a much steeper hurdle: Players must be a NetJets fractional owner (minimum cost: $200,000), with a select few heavy Marquis Jet Card owners sprinkled in.

Internet poker: Federal standards would benefit Nevada | Las Vegas Review Journal | Hit by the deck | Scoop.it
Michael Gaughan's South Point Poker made history last week, becoming the first U.S. casino to be licensed to operate an in-state, real-money poker website. Lawrence Vaughan, chief operating officer, predicted an October launch.

It's great news for Nevada. But a checkerboard of up to 50 intrastate poker networks, each with its own regulations, is hardly ideal. The best outcome for Nevada operators - more licensees are on the way - would be federal legislation enabling Internet gaming nationwide. With its long and successful regulatory history, Nevada would be best-positioned to lead that industry.

World Poker Tour: Josh Hale Wins Legends of Poker Main Event | BLUFF Poker | Hit by the deck | Scoop.it
We have a winner at the World Poker Tour Legends of Poker Main Event at the Bicycle Casino in Los Angeles, and his name is Josh Hale. He topped a field of 622 runners to win the top prize of $500,000 and his first major tournament title, but even though he entered the final table as the chip leader, his win was an exciting one thanks to multiple twists, turns, and lead changes on the final night of the tournament.

Not only did Hale have to go through three big names in Jeff Madsen, Greg Mueller, and Ali Eslami, he also faced a big chip disadvantage going into the heads-up final against Max Steinberg. In the end, it was the satellite seat winner Hale who was the last man standing, and as you can see from his winner photo, he was one of the more excited champions in the recent memory on the WPT...

We're told most people are playing it cool and leaving Phelps alone. The poker enthusiast plays regularly at the hotel and has participated in tournaments there.

The swimming star was still on Borgata grounds Tuesday afternoon.

Phelps will be back in A.C. on Sept. 22 as he hosts a party at The Pool After Dark at Harrah's.

When Michael Phelps won his record-breaking 19th career medal at the 2012 Olympics in London, he became the most decorated Olympian of all time. By the end of his time in the pool, he had earned 22 medals, 18 of them gold. To put those numbers into perspective, only four others have won at least nine gold medals — Larisa Latynina, Carl Lewis, Paavo Nurmi and Mark Spitz. Each finished his or her career with a total of nine gold medals, putting Phelps' accomplishment at double. Latynina earned 18 total medals during her career, but Phelps moved past that number this summer. The question now is: What's next up for Phelps in his post-swimming career?
