Five more licenses to operate online sports betting in the German state of Schleswig-Holstein were issued on Tuesday, with recipients Ladbrokes and 888 among the new additions.

The Home Office will continue processing applications, with now over 40 operators under consideration, including 22 for “online casino games” including poker, according to yesterday’s statement.

 

However, the latest batch were all sports-betting licenses, bringing the total number of licenses issued to date to 12. Along with 888 and Ladbrokes, Cashpoint Malta Ltd and Admiral Sportwetten (recipient of two licenses) join the likes of Betfair, JAXX, Bet365 and bwin.party. All licenses are good for six years.

The sponsorship is announced on the back of Betfair receiving an online sports betting licence in the northernmost Land of Schleswig-Holstein last month, where Betfair will pay 20% on gross profit. The other 15 German Lander, including Bayer Leverkusen’s home state of North-Rhine Westphalia, last week ratified a new Interstate Gambling Treaty to take effect from 1 July under which 20 licences will be offered to private operators, based on an unworkable 5% turnover tax. In contrast to Schleswig-Holstein, the offer of online poker and casino by private operators will remain prohibited.

Fifteen of the German Federal State parliaments intend during the next two weeks to ratify a new Interstate Gambling Treaty proposing the issue of no more than 20 licences for private sports betting operators based on an unworkable 5% turnover tax, ahead of this coming into force across all 15 Lander on 1 July.

 

Schleswig-Holstein (SH), that refused to back the new Interstate Treaty and instead passed its own Gambling Law providing for the issue of unlimited licences for all products based on a 20% gross profit tax. Since the licensing process began on 3 May, seven operators, including Betfair, bet365 and bwin, have received sports betting licences, with at least further 24 applications for sports and 17 for casino games (including poker) in the licensing pipeline.

Schleswig-Holstein’s new government wants to roll-back regulation, Gambling Compliance

Following state elections in Schleswig Holstein, on Sunday June 3, 2012, the former opposition of the SPD, the Greens and the SSW, came to an agreement:

 

"The aim of the state government is to achieve a federal regulation of gambling and for Schleswig-Holstein to join the Interstate Treaty. The state government will examine how lifting Schleswig-Holstein’s Gambling Act is possible without having to pay compensation and how it is possible to stop the licensing process through a law amendment in line with the competition law."

 

“We will aim to sell our casinos. During the privatisation it will be taken into consideration that there will be no opening towards the online market [for online casino games], that the rights of the employees are respected and that the planned loss in taxes is critically examined.”

 

What it means in practice is unknown. No compensation and compliance with competition laws are to big hurdels that will be hard to avoid.

Recently, the German state of Schleswig-Holstein has liberalized its regulations.

 

The remaining 15 German states signed a deal under which the gambling regulations will be more restrictive. This not only led to criticism in the gaming industry, but also the European Union is investigating whether the restrictions comply with free market rules by favoring state monopolies.

 

The gaming companies which will operate in Schleswig-Holstein will be subject to 20% tax on gross profits. Betfair alone is expecting to pay around $5 million dollars annually to the German state. Allowing online sports betting in Germany is expected to eat into illegal betting market, which is estimated to be around $6-7 billion dollars.

The three licences were issued to Betfair, Jaxx, and Oddest for sports betting by the previous coalition government. This coalition was made up of the Christian Democrats and the Liberal Democrats. The opposition party, the Social Democrats (SPD), has been strongly opposed to online gambling regulation and indicated in the run up to the election that it would repeal Schleswig-Holstein’s regional gambling act which was passed in October 2011.

Betfair secures German online licence, Gerrit Wiesmann

Betfair of the UK and Jaxx, its German rival, are the first commercial betting companies to be awarded licences for web-based sports bets in Germany in addition to the state owned operator Oddset. The license only apply in the state of Schleswig-Holstein and covers sports betting. Licenses for poker and other casino-style games will come during the coming weeks to some of the 37 applicants.

 

Betfair has led the charge against the gambling monopolies of Germany’s 16 regions, a regime which was declared in breach of European laws guaranteeing companies freedom to do business across the region.

 

Schleswig-Holstein plans to tax online betting companies’ gross profits at 20 per cent, shunning a more weighty tax on customer bets, which the other states are aiming for – and providers say would be unworkable.

The breakaway German federal state of Schleswig-Holstein is to abolish its own gambling law and join the new Interstate Gambling Treaty recently ratified by the other 15 Länder, it confirmed Tuesday.

 

Germany’s northernmost state recently issued seven online sports betting licences to companies including bet365, Betfair and bwin under the Gambling Act passed by the previous government. However, the new SPD-led Cabinet announced in Kiel this week that Schleswig-Holstein (SH) would join the restrictive new common gambling treaty that came into force on 1 July, confirming the intent first outlined in its manifesto shortly after coming to power.

 

Germany’s new Interstate Treaty replaces the state monopoly on online sports betting with the issue of up to 20 licences to private operators, came into force on 1 July, alongside a prohibitive 5% turnover tax on sports bets and a continued ban on online poker and casino.

The Bremen State Court (Landgericht Bremen) confirmed that:

- The Interstate Treaty expired at the end of 2011, and has not been prolonged in a valid legal fashion. The original time frame for the application of the law has expireced and a new one is not in place.

- The internet gambling ban in the Interstate Treaty cannot be applied and thus Lotto24 did not breach the provision of the law when offering gambling in Bremen.

 

According to the plaintiff – the state lottery of Bremen - Lotto24 breached competition law when it started offering its products in Bremen in breach of the internet gambling ban. On March 19, 2012 the Bremen State Court issued an order requesting Lotto24 to stop collecting players from Bremen. Lotto24 appealed. This order had been lifted by the May 10, 2012 appeal ruling.

Hope for an open regulated gaming market in the north German state of Schleswig-Holstein turned to despair this weekend after the state’s new coalition government agreed in principle to revert to the State Treaty on Gaming and to cancel online gaming licences issued by the previous government.

 

The coalition agreement states that “it is the goal of this government for Schleswig-Holstein to join in national gaming regulations”.

Schleswig-Holstein online gambling licences, Germany’s first, dodge the question of whether they are able to be used in the other 15 German states.

 

Jaxx will use that ambiguity to start using its new licence as soon as possible. UK-listed Betfair is proceeding more cautiously, saying it has not yet determined its next move.

 

Jaxx, which is changing its name to mybet Holdings, will generate more than €1m in tax for Schleswig-Holstein in 2012 alone. Tax in the northernmost German state is 20 percent of gross gaming revenue.

 

Jaxx, based in Schleswig-Holstein, wants to debut its dot.de website in time for the June 8 opening of the Euro 2012 football tournament.

German operator JAXX SE has completed the sale of its lottery business to a group of private investors for €12.5m. JAXX’s  is comprised of its JAXX GmbH (Hamburg), JAXX GmbH (Lustenau), Vendo Spielsysteme GmbH, flux.com Telewette GmbH and JAXX UK Ltd subsidiaries, JAXX domains, brand names and naming rights are also included and, as a result, JAXX SE will change its name to mybet Holding SE.

 

The decision to sell the lottery business was taken in order to allow it to focus on sports betting, casino and poker products. JAXX had become one of the first three operators to be awarded a licence to offer online sports betting in the northern Land of Schleswig-Holstein, alongside Betfair and Die NordwestLotto Schleswig-Holstein, with casino and poker approval expected to be handed out in the coming weeks.

Election Countdown Pressure For Schleswig-Holstein Licences, Daniel Macadam

Schleswig-Holstein’s incumbent government has survived another attempt to destroy its nascent gambling regime, but now has only four working days left to issue licences before elections in Germany’s northernmost region.

 

That victory leaves ministers free to issue gambling licences to the 30-plus operators which have already applied, in what would be one of their last acts of government.

 

The people of Schleswig-Holstein go to the polls on Sunday May 6 with the Christian Democrats, currently in coalition with the libertarian Free Democratic Party (FDP), neck-and-neck with their main opponents, the Social Democrats.

 

Still, German legal experts are unconvinced they will go through with that immediately.

“It certainly becomes less probable if licences are issued next week,” said Frieder Backu, gaming and tax lawyer at SSW Schneider Schiffer Weihermueller. “Moreover the abolition of the law would still need some time. A new coalition has to be negotiated first.”

 

Joerg Hofmann, partner at Melchers law firm, agreed: “Once operators are online, the train has left the station.” “Even if politicians would again think about trying to revoke the new law, they would need two hearings in the parliament to pass a new Act. Due to the summer break this won’t happen prior to September or even later.”

 

With the Greens now the region’s third largest party in the polls, Heinold also ramped up the election rhetoric, stating: “One of the only winners is the gambling industry, which will receive a licence to print money,” she added.
