Playtech’s impressive first-half financial results released today were marred only by the continued poor performance of its poker platform, iPoker. The group is looking toward both new licensees and a real-money mobile platform to boost its ailing network.

 

Poker understandably received slim attention in an otherwise glowing half-annual report:

The international poker market remained challenging for the first six months of the year, causing poker revenue to fall by 9% to €9.7 million. The iPoker network maintained its position as the leading independent poker network in the dotcom market place, and we are currently in discussions with a number of significant new licensees who wish to join the network.

 

Revealed on pokerfuse last week, one major new licensee in talks with Playtech is is Everest Poker, which plans to shut its independent poker room and join the network. Although considered a micro-network, it would bring a possible 20% boost to player numbers on iPoker. It operates a larger French network, which would completely reinvigorate Playtech’s presence in France. Rumored to be in talks with joining the network is Betfair, which currently operates on the Ongame network but is reportedly looking for a new home.

The Betting (Amendment) Bill, which the Irish government hopes will help bridge a huge €50m-plus shortfall in funding for the country’s racing industry, will require all Irish-licensed bookmakers taking more than €200,000 or 10% of bets remotely and non Irish-licensed bookmakers taking online bets in Ireland to apply for a “remote bookmaker’s licence”.

 

Betting exchanges such as Betfair will be required to obtain a “remote betting intermediary ‘s licence”.

 

Passage of the Bill when Ireland’s parliament returns after its summer recess will activate the changes to taxation of remote betting contained within Ireland’s 2011 Finance Act. This will compel all bookmakers taking bets from Ireland to pay 1% betting duty on those bets as all betting shops currently do in Ireland.

 

Betting exchanges will, “in view of the different model adopted by betting exchanges” according to the Finance Act, pay a betting in intermediary duty “of 15% on the commission they charge/receive from persons in the State.”

Cyprus bans online casino games and poker while simultaneously legalising most sports betting. The most popular online sports betting which takes place on exchanges is banned.

 

The law provides for a 10% tax on net sports book revenues and a 3% tax on gross revenues. 1% of the gross revenue tax will go to charities working on gambling addiction.

 

Betfair will be hit hard by the law as it generates some £9m or 4% of its global revenues from the island. Betfair shares fell 4.5% on news of the new law. 

 

Greek company OPAP which offers online lottery and keno games will continue to be allowed to operate under an exemption reflecting a bilateral agreement between Greece and Cyprus.

The other 15 German Lander, including Bayer Leverkusen’s home state of North-Rhine Westphalia, last week ratified a new Interstate Gambling Treaty to take effect from 1 July under which 20 licences will be offered to private operators, based on an unworkable 5% turnover tax. In contrast to Schleswig-Holstein, the offer of online poker and casino by private operators will remain prohibited.

Betfair profit rising on mobile and betting, David Altaner at GamblingCompliance

Betfair full-year earnings before interest, tax, depreciation and amortisation rose 12 percent, led by betting on mobile phones. Full-year EBITDA, excluding one-time items, rose to £89.6m in the year ended April 30, from a year-ago £79.7m. Earnings per share gained 46 percent to 33.1 pence during the year.

 

Mobile revenue nearly doubled, to £22.7m, and the number of bets on mobile phoned more than doubled to 44m, the company said.

 

Exchange betting gained 11 percent in the period to £250.1m, while betting at fixed odds dropped 12 percent to £18.1m, ahead of the lauch of a new fixed odds sportsbook now underway.

Online betting exchange Betfair came out worst with an estimated 48 percent dent to earnings per share (EPS) in 2015 thanks to its heavy reliance on the UK, according to the Jefferies report.

 

Bricks-and-mortar bookmakers are likely to fare much better, the analysts said. Paddy Power, William Hill and Ladbrokes can expect a 19 percent, 13 percent and 12 percent hit to EPS respectively.

Germany is set to enact a new Interstate Treaty on Gambling that would reconfirm the prohibition of online gambling in all German states except one – Schleswig-Holstein. As the EU Commission reviews the treaty, research body MECN indicates online gaming in Germany will grow to €1.7bn by 2015, driven by poker and lotteries.

 

Before the new treaty comes into effect, lawmakers must determine whether online licensees in Schleswig-Holstein will be able to operate throughout the country. The German region passed its own gaming law in Sep 2011 that permits online poker and casino games. Three licenses have since been issued to Betfair, JAXX and state-owned Oddset.

Netherlands moves towards Danish regulatory model, Gaming Intelligence

Plans to introduce a licensing regime for online gaming operators in the Netherlands are slowly taking shape, with the Danish system appearing the more likely model to follow after the Justice Ministry concedes that the Belgian model could prove vulnerable under EU law.

 

In September 2011, Boston Consulting Group issued a report at the request of Teeven, outlining two possible scenarios for a regulated market. The first follows the Belgian model of issuing a limited number of licenses to land-based gaming operators who would also offer games online, while the second follows the more open model employed in Denmark and the German state of Schleswig-Holstein.

 

“In the first place, a restriction on the number of operators is unnecessary from the point of view of consumer protection and prevention of gambling addiction,” states Teeven. “By imposing strict requirements, at least the same level of protection can be attained. The location of servers in our country is also not necessary in order to facilitate strict monitoring.”

 

Operators no longer offering their sites in Dutch include bwin.party, Betfair, Bet365 and Ladbrokes, while many more continue to offer gaming in Dutch.

Recently, the German state of Schleswig-Holstein has liberalized its regulations.

 

The remaining 15 German states signed a deal under which the gambling regulations will be more restrictive. This not only led to criticism in the gaming industry, but also the European Union is investigating whether the restrictions comply with free market rules by favoring state monopolies.

 

The gaming companies which will operate in Schleswig-Holstein will be subject to 20% tax on gross profits. Betfair alone is expecting to pay around $5 million dollars annually to the German state. Allowing online sports betting in Germany is expected to eat into illegal betting market, which is estimated to be around $6-7 billion dollars.

Betfair secures German online licence, Gerrit Wiesmann

Betfair of the UK and Jaxx, its German rival, are the first commercial betting companies to be awarded licences for web-based sports bets in Germany in addition to the state owned operator Oddset. The license only apply in the state of Schleswig-Holstein and covers sports betting. Licenses for poker and other casino-style games will come during the coming weeks to some of the 37 applicants.

 

Betfair has led the charge against the gambling monopolies of Germany’s 16 regions, a regime which was declared in breach of European laws guaranteeing companies freedom to do business across the region.

 

Schleswig-Holstein plans to tax online betting companies’ gross profits at 20 per cent, shunning a more weighty tax on customer bets, which the other states are aiming for – and providers say would be unworkable.

Five more licenses to operate online sports betting in the German state of Schleswig-Holstein were issued on Tuesday, with recipients Ladbrokes and 888 among the new additions.

The Home Office will continue processing applications, with now over 40 operators under consideration, including 22 for “online casino games” including poker, according to yesterday’s statement.

 

However, the latest batch were all sports-betting licenses, bringing the total number of licenses issued to date to 12. Along with 888 and Ladbrokes, Cashpoint Malta Ltd and Admiral Sportwetten (recipient of two licenses) join the likes of Betfair, JAXX, Bet365 and bwin.party. All licenses are good for six years.

The breakaway German federal state of Schleswig-Holstein is to abolish its own gambling law and join the new Interstate Gambling Treaty recently ratified by the other 15 Länder, it confirmed Tuesday.

 

Germany’s northernmost state recently issued seven online sports betting licences to companies including bet365, Betfair and bwin under the Gambling Act passed by the previous government. However, the new SPD-led Cabinet announced in Kiel this week that Schleswig-Holstein (SH) would join the restrictive new common gambling treaty that came into force on 1 July, confirming the intent first outlined in its manifesto shortly after coming to power.

 

Germany’s new Interstate Treaty replaces the state monopoly on online sports betting with the issue of up to 20 licences to private operators, came into force on 1 July, alongside a prohibitive 5% turnover tax on sports bets and a continued ban on online poker and casino.

The UK government can expect to generate up to £242m in revenues from the introduction of its planned point of consumption (POC) tax, according to the results of a new report from GamblingData.


In detailing the UK online gambling market to be worth £1.71bn in net gaming revenue (NGR), GamblingData suggests that between 5.25-7.25 percent of the market would end up avoiding the tax at the proposed 15 percent rate.

Poker revenue was up two percent to £22.9 million at Betfair in the year to the end of April 2012 from £21.9 million. This compares to a fall of 15 percent in financial year 2011. Poker actives fell by 9 percent to 147,000 from 161,000 in the same period while revenue per user rose to £152 from £136.

 

The company, which moved to the Ongame network in 2010, said, “Q1 was the final quarter to be affected by year-on-year comparisons to the pre-migration period before the move to the Ongame network which caused an initial decline in revenue.

 

“Poker revenue has now seen six quarters of stability since the migration. Excluding Italy, revenues in the final nine months of the year increased by 14%.

 

“In Poker, an emphasis on recreational players and improving network ecology has seen like-for-like revenue increase 6% year-on- year, excluding Italian revenues.”

Germany’s parliament is poised to pass a draft online sports betting bill today or tomorrow that would tax turnover and which could cost Bwin.Party Digital Entertainment €50m (£40m). The proposed bill, cleared by the Bundestag’s Finance Committee yesterday, would set a country-wide tax rate of 5 percent on sports bets and a limit of 20 licences.

 

The tax, which would take effect on July 1, would have a “material impact" on both Bwin.Party and the UK’s Betfair. UK bookmaker William Hill could lose less than 1.5 percent of earnings, and the bill would have a negligible effect on rivals Paddy Power and Ladbrokes.

Two Way TV and Samsung partner to offer sports betting, GamingIntelligence

The betting application will be made available on Samsung’s internet enabled TVs, smartphones, tablets, Blu-ray players, home theatre systems and other consumer products. It allows viewers of broadcasted sports events to place bets via their TV remote control or other compatible device.

 

The deal follows the signing of a similar agreement in January of this year between Two Way TV and LG Electronics Australia.

 

The company currently has agreements in place to develop TV betting with two of the leading betting operators in Australia, Betfair and Sportingbet.

Since December, we have seen various operators bowing out (notably Bodog, Unibet and other Microgaming skins). A last minute surprise—a demand from the Spanish tax man to pay four year’s of back-taxes—has raised questions as to which poker rooms will be getting licenses in a few days’ time.

 

Still no official list has been published, but given recent statements from various operators we have a good idea of who has their fingers crossed for a license.

Bwin.party, Bet365, Betclic Everest subsidiary bet-at-home and Malta-licensed operator Tipico have become the latest companies to receive a Schleswig-Holstein licence, allowing them to offer sports betting in the jurisdiction with immediate effect, with licences for poker and casino expected to be awarded “in due course.”

 

Less than a week before the CDU’s election failure, Betfair, mybet and Die NordwestLotto were announced as the first three operators to be granted a license in Schleswig-Holstein, and following today’s news another 24 operators are still awaiting news on their own sportsbook appilcations, with a further 17 having applied solely for poker and casino approval.

Madrid-listed Codere intends to make betting the “cornerstone” of its Spanish strategy this year as it expands into online gambling in its home market, according to its chairman and chief executive.

 

The Madrid-based company has more than tripled the number of betting points in Spain to 708 over the last two years, albeit from a relatively small base, according to first-quarter results published on Friday.

 

The bingo, casino and betting company has filed around a dozen injunctions against the largest Spanish-facing online gambling operators with mixed success.

London-listed Sportingbet was forced to shutter its market-leading “miapuesta” sites in March, but attempts to do the same to PokerStars, Bwin and Betfair have so far failed.

 

Group revenues jumped 32 percent to €403.3m in the first quarter to help earnings before interest, tax, depreciation and amortisation (EBITDA) rise 17 percent to €78.9m. Codere has become increasingly reliant on its Latin American businesses, which accounted for 74 percent of revenues, and a whopping 86 percent of EBITDA, in the first quarter of 2012.

German operator JAXX SE has completed the sale of its lottery business to a group of private investors for €12.5m. JAXX’s  is comprised of its JAXX GmbH (Hamburg), JAXX GmbH (Lustenau), Vendo Spielsysteme GmbH, flux.com Telewette GmbH and JAXX UK Ltd subsidiaries, JAXX domains, brand names and naming rights are also included and, as a result, JAXX SE will change its name to mybet Holding SE.

 

The decision to sell the lottery business was taken in order to allow it to focus on sports betting, casino and poker products. JAXX had become one of the first three operators to be awarded a licence to offer online sports betting in the northern Land of Schleswig-Holstein, alongside Betfair and Die NordwestLotto Schleswig-Holstein, with casino and poker approval expected to be handed out in the coming weeks.
