Trampoline Accidents Cause Costly Hospital Visits

Trampoline Accidents Cause Costly Hospital Visits | Accidents, Recalls and Awareness | Scoop.it
Trampoline accidents cost over $400 million in emergency room visits. Doctors are hoping to ban recreational trampoline use due to safety issues.
Kane & Silverman P.C.'s insight:

The numbers are staggering...especially considering that out in west Pennsylvania they have a lot of land and open spaces. That's perfect for trampolines. But is it worth it to put your child's life or safety at risk?
This opens a great argument for the doctors who are hoping to ban the sale of trampolines, effectively reducing trampoline accidents that cause bruises, broken bones, and brain injury.

Tragic Bus Crash Kills 1, Critically Injures 45

Tragic Bus Crash Kills 1, Critically Injures 45 | Accidents, Recalls and Awareness | Scoop.it

A bus slammed into the back of a tractor-trailer on Interstate 80. Sadly 1 died and many injured. This tragedy is still under investigation...

Kane & Silverman P.C.'s insight:

I'm curious as I look at this photo (video capture)...if the tractor trailer driver said he was traveling at a normal speed (by his account) - the damage to the bus seems substantial and the truck bed lodged inside the bus. Did the driver back up into that position after the collision? Or is it more likely the truck driver did indeed slow down first?

Think Your Delivery Drivers are Covered? Think Again!

Think Your Delivery Drivers are Covered? Think Again! | Accidents, Recalls and Awareness | Scoop.it

If you provide delivery to your customers, you need delivery drivers. But do your drivers have enough insurance coverage to protect your business in case of an accident?

Your employees’ personal vehicle insurance does not cover any accidents that occur while the car owner is “on the job.” It doesn’t cover injury to clients or coworkers, nor does it cover damage to goods, property, or other vehicles that is incurred in an accident.

In the case of an vehicle accident involving your delivery driver, your business can be held accountable for damages. To prevent accidents from causing your business undue financial hardship, consider how you can better protect your business with commercial vehicle insurance, personal insurance, and strategic precautions.

Robbins & Associates's curator insight, July 10, 2013 7:28 AM

Workers who use a company vehicle need to be aware of coverage. If an at fault driver has little or no coverage the only protection for the company employee is Uninsured/Underinsured coverage, UM. Check your home coverage for UM, and that will protect you while in another vehicle.

Woman Dies While Texting, Driving, and Posting To Facebook

Woman Dies While Texting, Driving, and Posting To Facebook | Accidents, Recalls and Awareness | Scoop.it

A young woman was texting while driving and posting selfies seconds before she was in a fatal car accident, colliding with a truck.

Kane & Silverman P.C.'s insight:

Everywhere you look, people warn about the dangers of "texting and driving". Yet thousands and thousands of people a day get in their cars and are brave enough to keep an eye on the road...and their phones.

There are alternatives to taking both hands off the wheel when driving, such as Bluetooth and speakerphone. But even those you need to look at your phone to locate the 'end' button.

What happened to this young lady, who's life was cut short, is an unfortunate reality in this century. History will only repeat itself if we don't raise awareness, raise our voices, and make more responsible decisions. We can start with: Don't text and drive.

an article by RI Car Accident lawyer David Slepkow 401-437-1100
excerpt:

Are the caps in Liability applicable in the event that a government worker accidentally kills a civilian in accident in Mass.?

Continued from Part 1 of 3

The Liability caps do not apply in wrongful death lawsuits and fatal car accidents in Massachusetts. Conners v. Northeast Hospital Corp. 439 Mass. at 470 (2003).

Thankfully, the MA Supreme Judicial Court refused to allow governmental immunity for fatal crashes and accidents. Therefore, if a government employee is involved in a fatal motorcycle, Semi Truck bicycle, car accident, pedestrian or premises liability accident the government cannot run from liability.

In Kromhout v Commonwealth the Massachusetts Supreme Judicial Court resolved the following issue: “This case presents an issue, specifically reserved in Patrazza v. Commonwealth, ante 464, 466 & n. 1 (1986), involving the Commonwealth’s liability in a wrongful death action arising from a defect in a State highway.”

an article by RI Car Accident lawyer David Slepkow 401-437-1100
excerpt:

The most common types of automobile accidents that occur on the roads, streets and highways of Rhode Island and Providence Plantations are known as a “rear-enders”.

Nationally, according to the National Highway Transportation Safety Administration, “approximately 29.7% of all crashes in the year 2000 were rear-end crashes. These crashes were responsible for 30% of all injuries and 29.7% of the property damage.” http://www-nrd.nhtsa.dot.gov/Pubs/809-540.PDF

A large majority of auto wrecks in the Ocean State constitute what is commonly known as “rear enders”. Rear- end accidents in Rhode Island are easier to settle with Insurance Liability Adjusters than other types of vehicular collisions.

Pursuant to RI Injury law, the liability of the motorist who caused the rear end car crash is assumed. In other words, the motorist who strikes another vehicle is usually negligent and at fault for the wreck.

Unconsciounable! Any case against this negligent driver should include punitive damages. Zayas-Rodriguez, the negligent driver,  had marijuana, clonazepam - an anti-anxiety medication - and a third drug in his system.Police said on Sept. 11 Zayas-Rodriguez got into an argument and sped off in his black Lexus on North Fifth Street where he ran a red light at the Tilghman Street intersection and was hit by a Chevy Tahoe. The SUV rolled onto its side and hit three pedestrians. Joseph Watson, who was driving the Tahoe, and Tammy Trapp, Zayas-Rodriguez’s girlfriend who was a passenger in his car, were also injured. #AllentownInjuryAttorney
