Motorcyclists across the United States are well aware of the laws against lane splitting and know that it is prohibited in every state, except California, which is also ranked among the worst states in the context of traffic and incidents on the roadway. For those who are not familiar with the term, lane splitting refers to a two-wheeled vehicle moving between roadway lanes of vehicles that are proceeding in the same direction. It is no question that lane splitting is dangerous and is one of the easiest ways for accidents to occur, but for motorcyclists it is a method to travel at a greater rate of speed and avoid being stuck in traffic.

Two recent Florida Appellate Court opinions may have a chilling effect on the ability of physicians who treat automobile accident victims to avoid unduly burdensome and harassing discovery requests. In Katzman v Rediron Fabrication, Inc., Case No. 4D11-1290 (FL Dist. 4 Ct. App., Aug. 10, 2011) and Melissa Crable v. State Farm Mutual Automobile Insurance Company, 5:2010cv00402, the insurance industry received two very favorable decisions that allows for a much broader scope of discovery that defense attorneys may now propound upon physicians who rendered medical treatment on an automobile accident victim as a result of a letter of protection.

The Florida Bar is considering a change to its rules of Professional Conduct, which could prohibit Florida Attorneys from accepting referrals from a referral service if the client is referred to another entity. There have been ongoing discussions regarding the proposed amendments which are designed to prevent collusion. Some experts feel that proper regulation exists to prevent such nefarious acts and others are clamoring for greater oversight into the business relationships of all interested parties.


Generally, for profit Florida Medical and Legal Referral Services are wholly designed to link consumers who are actively searching for a physician or attorney. Companies such as 1-800-ASK-GARY and 411-Pain have a different business model. Many consumers are unaware of the relationship between the advertisers, the physician provider and the attorney. Let’s examine the main lawyer referral services in Florida individually and focus on what they fail to tell the consumer.

Certain traumatic brain injuries are easy to identify. For instance, a fractured skull, a brain bleed, or if an individual is in a coma due to an impact to the head, we can be certain they have suffered a traumatic brain injury or trauma to the brain. However, oftentimes an individual will suffer what is termed a “mild” or “moderate” brain injury (as if trauma to the brain could be considered “mild”) as a result of an automobile or motorcycle accident. The term “mild brain injury” often leads to misconceptions that the symptoms are not serious or that the injury is only temporary. This is a very dangerous error as brain injury symptoms can often increase or intensify as time goes on. Such injuries are often more difficult to identify as they involve subtle problems with emotions, memory, thinking, and concentration among others. In fact the Center for Disease Control identifies a myriad of factors and issues that are often associated with a traumatic brain injury.

Thousands of former professional football players have claimed they incurred severe brain trauma from injuries on the field. Since these claims and the lawsuits that followed, several medical professionals have seized the chance to develop assessments for brain damage. Many experts say the validity regarding such claims of accurate brain damage assessment techniques are premature and as such, unfounded.


Previously, it was widely believed that chronic traumatic encephalopathy, or C.T.E. for short, could only be diagnosed posthumously from analyzing brain tissue. Most researchers still believe this to be true.

Every day we see school buses stopping to pick up children at bus stops and drop them off on campuses. Oftentimes parents can be seen waiting at bus stops with their children, eager to ensure their kids make it safely onto the bus and on their way to school. When parents place their kids on the bus or drop them off at school, they expect that the school's administrators and teachers are stepping into their shoes as protectors and supervisors of their children and will ensure their safety.


In fact, under Florida law, teachers and school administrators have a legal duty to use reasonable care in supervising students on school grounds. Not only does the school have the responsibility to watch over students, but elementary, middle and high schools also have an obligation to control the behavior of other students and to protect the students in their care from being injured at school and from being injured by other students. see Collins v. School Bd. Of Broward County, 471 So. 2d 502 (Fla. 2d DCA 1978). This means that Florida law will not allow a school’s administrators to turn a blind eye towards physical bullying by students. When children enter school grounds, teachers become responsible for supervising student activities.
