As in most cases, you always have the option of seeking coverage for your loss through the at-fault driver’s auto insurance policy. However, far too often the at-fault driver either has no insurance or an insufficient amount to cover your loss. In any event, you should always attempt to seek coverage through the at-fault driver’s insurance policy.

 

If the at-fault driver’s insurance policy is insufficient, then you should turn to your own insurance policy to determine your options. Some drivers carry an uninsured motorist policy, which acts as more of a supplement to your auto insurance. In the event the at-fault driver’s policy is too low to cover your medical bills, your uninsured motorist policy, if you have one, will kick in to cover the deficiency. 

 

Injured pedestrians may also seek coverage through their own PIP policy. PIP, or Personal Injury Protection, is Florida’s no-fault law. Florida requires that every registered driver in the state must carry at least $10,000 in personal injury protection benefits. The beauty of PIP is that you may seek payment from your own PIP policy regardless of who is at fault. Furthermore, Florida’s PIP statute extends coverage to anyone listed on the policy and any relatives of the insured who live under the same household.

Once CDC study found that, in one year, more than 618,000 children ages 0-12 rode in vehicles without the use of a child safety seat or booster seat or a seat belt at least some of the time. Based on strong evidence of effectiveness, the Community Preventative Services Task Force recommends car seat laws and car seat distribution plus education programs to increase restraint use and decrease injuries and deaths to child passengers. These programs are encouraged to offset the 638 children ages 12 years and younger who died have died in a year as occupants in motor vehicle crashes and more than 127,250 who were injured due to 38% of them not being buckled up.

The Centers for Disease Control and Prevention provides that in 2013, 4,735 pedestrians were killed[1] in traffic crashes in the United States. This averages to one crash-related pedestrian death every 2 hours. Additionally, more than 150,000 pedestrians were treated in emergency departments for non-fatal crash-related injuries in 2013.  

 

Pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash and one in every five children under the age of 14 who were killed in traffic crashes were pedestrians.  Safekids.org provides that in 2012, approximately 19,183 child pedestrians were nonfatally injured in motor vehicle-related incidents.  Further, 78% of child pedestrian deaths occurred at non-intersection locations.

  • MYTH: You don’t need to pull over, exchange information or file a police report if you are involved in a minor accident.

The truth is that failing to pull over  or file a police report could actually get you into a considerable amount of legal trouble. Under Florida law, you are required to pull over your vehicle at the scene of an accident, even if the accident does not result in any injuries and even if the damage appears to be minimal. Failure to do so could result in misdemeanor charges.

The question of who is responsible for a sexual assault can be very difficult when the assault takes place on a commercial cruise line in international waters.   There are often many issues that could come into play like: what jurisdiction’s law has supremacy on the issue?;  Is the cruise line responsible?;  Is the individual who perpetrated the attacks entirely responsible leaving the cruise line free and clear?; What if one of the crew members of the ship was one of the attackers?  All of these questions make sexually assault liability cases on a cruise ship murky at best.  Luckily, we have a couple recent cases that will have to be our lighthouse on this issue.

Neglect at assisted living facilities can take many forms. Most assisted living facilities run into problems when they understaff or neglect the wellbeing of those they care for. Brookdale Assisted Living is a perfect example. Brookdale is a senior living facility which has numerous offices throughout the nation, 65 in Florida alone. What most do not know is that Brookdale has been the subject of numerous lawsuits due to the level of care they provide to patients. In 2013, Brookdale was sued for wrongful death and elder abusewhen one of their residents, Eleanor Buckingham, became ill, but was left unattended at a facility in California. Staff at the assisted living facility noticed an ulcer on Ms. Buckingham’s back, but failed to get medical attention until it was too late. Her condition was so neglected that the ulcer became infected and she eventually passed away as a result of her injuries. Brookdale accepting responsibility for the incident, and settled with Ms. Buckingham’s family for $1 Million.

According to the NINDS, symptoms of traumatic brain injury may include the following:

Mild traumatic brain injury
