When confronted with these types of questions, I like to first explain to clients that Florida law does indeed recognize that a tortfeasor (the person who caused you harm) can be held responsible for damages that are a result of a preexisting physical condition being aggravated by an injury, or an injury activating a latent condition. See C. F. Hamblen, Inc. v. Owens, 172 So. 694 (Fla. 1937).

When it comes to recovering for losses caused by someone else’s negligence, this question is often asked with little patience. Put quite bluntly, victims of negligence often times just want a straightforward answer; a ballpark estimate to what they could be looking to receive in terms of monetary compensation for their personal injuries caused by the alleged liable party. However, the point that many people fail to grasp is that every case is incomparably unique. The very first thing that should be solidified before an injured party goes around seeking a case estimate is whether there is a case at all. It’s a bad idea to assume you’ve got a case already and fall under the impression that you’re entitled to compensation and you’ll eventually receive it. Unfortunately, with the way tort law is structured, some cases stand no chance in a court of law. However, liable parties may be willing to avoid frivolous lawsuits through the means of a settlement agreement. Determining how much you could receive through a settlement is a nearly identical topic discussed separately.

So how does an accident victim who has suffered a “mild” brain injury due to negligence exhibited by a third party recover for the damage?
Matthew A. Dolman's insight:

TBI’s do not always manifest in obvious ways. Sometimes a person who receives a blow to the head can be diagnosed with a “mild” or “minor” brain injury. It’s common for this type of damage to not be visible on MRIs or CT scans, and symptomatology becomes more difficult to illustrate. These injuries may differ than those caused by severe head trauma, but can be debilitating all the same.


So how does an accident victim who has suffered a “mild” brain injury due to negligence exhibited by a third party recover for the damage? Reasonably, this type of TBI is significantly harder to prove to a jury of six strangers. If no diagnostic imagining proves the damage, a victim’s attorney must demonstrate the symptoms and changes to the victim and attribute such damage to the brain. This can be very difficult to sell to jurors, especially if the impact that caused the TBI appears minor (i.e. an everyday moderate to minimal impact auto accident or a seemingly minor bump to the head from a fall).

 The ruling has now solidified that, at least in the state of the Florida, in order to prosecute anyone for a hit-and-run, you’ll need reasonable proof to show that the alleged criminal had “actual knowledge” of their involvement in an accident. In other words, if it’s not easily determinable that the hitter-and-runner knew (or should have known) that they hit-and-ran, the case is unlikely to proceed.


The controversy behind this new ruling is the mere fact that it sounds relatively unfair. When it’s put plainly, it sounds as if it would be nearly impossible to provide such proof, as no one is ever prepared for an accident, and even less prepared for a hit-and-run accident

Traumatic brain injuries are a very common result of motorcycle accidents. In Florida, riders are not required to wear a helmet, meaning that a higher percentage of accidents result in head trauma in Florida than in helmet-required jurisdictions. It’s common knowledge that safe riding means putting a lid on, but helmets can only protect your brain to a certain extent.  Many riders, including Ruben Aizmendi, die from head injuries sustained while wearing a helmet because the crash is so severe that the helmet was not enough; many others sustain massive head trauma because their equipment is faulty or not up to appropriate specifications.

Traveling across the country the conditions are becoming worse. Desolate, dark roads, no threat of law enforcement and minimal access to hospitals are a large issue. So what has been done to mitigate these concerns? Not much. Some states, have implemented laws where truck drivers must stay in one highway lane and are not permitted to go above a certain speed. However, some states, such as Illinois, have increased speeds for all, including tractor-trailers, allowing an increased threat for other drivers.

When I first discovered this app, I was amazed with how useful it sounded. This app allows people to plan their driving routes ahead of time to avoid any delays or road hazards. Thus, in theory, the potential of more people driving safer routes could reduce the average amount of car accidents that occur. However, the use of this app may lead to unintended consequences. Specifically, this app has the potential to distract drivers from focusing their attention on the road. There is a very good chance that someone who spots an accident will quickly take their eyes off the road order to post their observations on Waze.


Phone applications draw attention away from the road

Distracted driving is becoming one of the deadliest causes of car accidents. According to a United States Government website for Distracted Driving (Seewww.distraction.gov), at any given moment during daylight hours, over 600,000 vehicles are being driven by someone using a hand-held device.

Traumatic brain injuries can significantly affect a person’s ability to communicate

Communication through speech is one of the most important aspects of our lives as human beings. Most of us take the ability to verbally express our thoughts for granted, using that ability every time we go to the store or pick up the phone. Additionally, the ability to communicate via speech is essential to our livelihood and an integral part of our chosen profession.


A traumatic brain injury has the potential to significantly affect victims’ ability to communicate, both in terms of their ability to use language and their speech itself. For example, the speech of a person who has sustained a TBI may become slurred, due to a condition known as dysarthria. This condition occurs due to weakness in the muscles used to produce speech. Sometimes, TBI victims may also develop aphasia, or problems understanding or producing speech correctly. In addition, a person with TBI may also have issues the part of the brain responsible for language, resulting in a situation in which the individual has difficulty finding words or using correct sentence structure. Finally, TBI victims may also develop dysphagia, a condition in which a person has difficulty swallowing, which can also affect a person’s ability to speak. With any of these conditions, a person’s ability to communicate effectively with others may be significantly impaired, resulting in challenges that did not exist before the injury.

Needless to say, such burn victims are unable to work or attend school during this recovery period, so they often lose out on substantial amounts of income or fall behind in their education. Additionally, the recovery process for many burn injuries can be extremely painful and may include multiple surgical procedures, skin grafts, and more. The risk of infection with burn injuries is also high, so these wounds can often lead to additional illnesses and even death.

One very important type of regulations are referred to as “hours of service” regulations.


Truck drivers often transport goods across many states or even across the entire country. Spending long hours on monotonous highways can easily become exhausting and fatigue is common after particularly long trips. However, many truck drivers may be tempted to keep driving despite fatigue in order to make more deliveries in a certain period of time to earn more money.
