Exploring the legal issues around open data and open hardware - opensource.com | Peer2Politics | Scoop.it

Drafting and using open licenses for data and hardware presents both familiar old challenges (like license proliferation) and new challenges (like less developed legal frameworks and different production models). About thirty people working in these areas recently gathered (under the umbrella of the FSF-E's "European Legal Network") to discuss the latest work in these areas under the Chatham House Rules. This article will summarize what the group learned, and, I hope, stimulate discussion to improve the state of licensing in those areas.

One of the benefits of open source software is that it tends to reduce the lock in that customers face – when multiple options exist for customers’ technology needs, there is more choice and hence less chances for a vendor to lock customers in. Of course the flip side of that is that for open source software vendors, it is hard to ensure the continuity of their revenue streams. In an idea world all vendors would keep customers because of their awesome service, their great support and their breadth of options, but alas we don’t live in a perfect world.

Several people and organizations have recently called for a “New Deal for Europe”: the German Trade Union Confederation DGB with its “Marshall Plan for Europe”; the European Trade Union Confederation (ETUC) with its “New Path for Europe”; many a contributor to the book Shaping a Different Europe, and others. Underlying all such proposals is the realization that the austerity measures that have been imposed all over the EU (not only on its periphery and not only on the Eurozone) are obviously detrimental to the economy and to the people, yet individual countries cannot on their own take those step to boost investments, stimulate employment and revive the economy, like the Keynes-inspired ones which brought the USA through the Great Depression and presided over the post-war economic expansion.

It’s jaw-dropping to realize what a house of cards the imperium has become, how tenuous the base for social control is in America today, how unsound are its moorings, how precariously it rests on a gamble that the audience-nation won’t change its mind. Well, maybe we won’t. But the possibility is there, on a scale that should terrify the dominators, and exactly what they can do about it is far from obvious.”

Earlier this week, a mixed crowd of entrepreneurs, investors, start ups, nonprofits, social activists, and others came together for the inaugural conference on Catalyzing the Sharing Economy defined as the use of networked, mobile, information technology to share goods and services.    Think AirBNB and Uber, but it is much more than that.   It is a movement driven by social change values — less consumption, less waste, and sustainability.   But also, in an era of being connected online – it is a human driven desire to connect with others, as one speaker said, “The antidote to loneliness.”

I have spent many hours ruminating about what exactly it would take for us, humanity, to move all our businesses to sustainable enterprises. I personally think that it will take a lot more than one business doing this or saying that, or one person standing in the crowd exhaustively telling others of the perils of our current lives. It will take the effort of many positive deviants, in many fields cooperating and collaborating with each other. Anyone and everyone needs to be a positive deviant in the field they are passionate about.

In a new Pew Research Center report, nearly 1,600 technology experts give their thoughts about how the “Internet of Things” — wearable computers, processor-embedded products and other digital advances — will alter society over the next decade. Many (though not all) of the experts foresee, in the words of the report, “a global, immersive, ambient networked computing environment” that will change the way we do everything from stocking our fridges to finding our soulmates.
