(Court of Appeal, Thorpe, Black LJJ, Sir David Keene, 22 June 2012)

 

The Turkish mother applied for leave to remove the child and move to Turkey when the relationship with the English father ended. Permission was refused and the mother was prevented from taking the child to Turkey on holiday for a year. When the application was renewed it was once again refused. The mother appealed.

 

In dismissing the appeal the court held that it was for the judge to see and hear the witness evidence and there was no doubt that the maternal grandfather's evidence had caused the judge alarm. It was not for the Court of Appeal to minimise that consideration. The judge actively encouraged the mother to reapply for permission to take the child to Turkey on holiday when he was older.

The biological father of Gammy, a baby boy with Down syndrome born to a surrogate mother in Thailand, has been convicted of 22 child sex crimes, including one against a girl who was just 7 years old, the Daily Mail reports. Previously, the Sydney Morning Herald reported David John Farnell, now 56, had been sentenced for molesting two girls under the age of 13 when he was age 25 and age 26, but the story changed when the Mail discovered additional court documents revealing a total of 22 convictions for sexual offences.David Farnell, the biological father of baby Gammy, has been convicted of 22 child sex crimes.
Ngozi Odochi (Godwell) Nwokocha's insight:

Farnell was first tried in an Australian court at age 39 and after being found guilty for the assault charges, he was jailed for a total of four years and six months, the Herald said, additional time in jail added as additional charges were brought against him. Among his crimes were three cconvictionsfor procuring a girl under the age of 13. Court documents discovered by the Mail describe Farnell’s “secretive meetings” with girls in a garden shed or at home, where it is said he touched them inappropriately and forced them to carry out sexual acts.


Chanbua told Daily Mail Australia she was "a little worried" about Farnell's criminal history. “I am a little bit worried but not a lot because they are father and daughter,” she said through an interpreter, adding, “I don't think that he will do anything bad to his own daughter.” Chanbua is taking care of baby Gammy in the absence of his parents.

SYDNEY—An Australian couple denied they had abandoned their son with his Thai surrogate after learning he had Down syndrome, saying in an interview broadcast on Sunday that the woman demanded she be allowed to keep the boy.

 

“We did not abandon our son,” an emotional David Farnell said in an interview with Australia’s 60 Minutes.

 

“(Pattaramon) said that if we tried to take our little boy, she’s going to get the police and she’s going to try and take our little girl and she’s going to keep both of the babies,” he said.

 

Pattaramon denied that she’d ever threatened to keep both children, but agreed that she hadn’t wanted the Farnells to take Gammy home.

Dear Mrs Macaulay,

 

My partner has just separated from his wife. They have three kids who bear his last name. However, he recently found out that the youngest one isn't his. His name is on the birth certificate. What can he do? Can he get her charged or fined?

 

Before I deal with the contents of your letter, I must clarify one point. You have described the just separated married man as 'my partner'. Well, he cannot be nor is he yet in any way 'your partner'. He is a married man and so he cannot be anyone's 'partner' until he becomes an unmarried man, in other words 'single'. You may have been his paramour if you and he had your relationship before he separated from his wife, and now you are his lover or companion or friend.

 

I have dealt with this so that you understand that despite the length of time you and he remain in your relationship, which you choose to describe as a partnership, you cannot and will not qualify as a 'spouse' in a common-law relationship, which, I am sure you know, is recognised in law. A relationship as a common-law spouse would entitle you to the rights of one, but as long as he remains a married man, though separated, you have no rights as a spouse.

 

You have not said how he found out the child wasn't his. Was it by rumour, in that someone told him so? Was it as a result of a DNA test? Was it a legally ordered test? Was it a test done with the agreement of his wife? Did his wife say so in the midst of a quarrel? Is it really a fact?

A man “frittered away” £95,000 of his elderly mother’s cash on holidays and a honeymoon, after he was made power of attorney over her financial affairs.

 

Engineer Michael Edward Palframan, from Connah's Quay, used the cash to fund a lavish lifestyle, bought jewellery and even used it to pay for his honeymoon – a sunshine Caribbean cruise.

 

Palframan, 53, of St David’s Court, was jailed for two years and eight months at MoldCrown Court today after he admitted two charges of dishonestly abusing his position as power of attorney over the affairs of Louise Palframan, 84, by applying her funds for his own purposes.

 

Mrs Palframan's home was sold in order to fund her care in a residential home – but after the defendant  spent the proceeds from that sale,  he started dipping into her pension.

The actress and her fiancé Brad Pitt have previously said they didn't want their brood - Maddox, 13, Pax, 10, Zahara, nine, Shiloh, eight, and five-year-old twins Vivienne and Knox - to follow them into acting, but it appears they may have changed their mind after they all appeared on set together ready to film.

THOUSANDS of vulnerable Scots could be thrown in to legal limbo after a court questioned the validity of documents that allow loved ones to make decisions on their behalf.

Lawyers have warned as many as half of all continuing Powers of Attorney (PoA), papers drawn up by solicitors to let friends or family manage the financial and property affairs of those incapable of doing so themselves, could be invalid.


Their concerns were sparked when Sheriff John A Baird, ­writing in a formal judgment, argued that a single continuing PoA, drawn up in a standard style, was illegal.

 

His view would see thousands of families and institutions forced to redraft PoAs.

 

However, some documents now in doubt may have been signed by people who were of sound mind when they did so, but who are no longer capable of making such a decision.

Each company involved must make sure that its employees are under no pressure to look at emails or any work-related material on their smartphones or computers after 6 pm. The agreement has garnered immense distaste from around the world. they think it is too lazy.

This article talked about the creation of a new French law that requires employees to turn off their smart phones in full 18:00. Every company should ensure that their employees participate in the absence of pressure to see email after 6pm. Therefore, workload of people has reduced.
