When Perception Trumps Science: A Consideration of Flawed Forensics Used to Convict Diane Downs

11/14/2013 - The "Crimes of the Century" panel will look at the high profile murder case against Oregon mother Diane Downs. Multiple accounts of what happened in May 1983 suggest an ironclad case was made against Diane when she was convicted in 1984 of killing her youngest daughter and attempted murder of her two other children. However, Diane and her family insist that the accounts are at best theories reinforced in part by false evidence as well as Diane's calm demeanor and seeming lack of grief due to mental and emotional disorders.

Crimes of the Century panelist Dr. Andrew D. Jackson will track us through the questionable forensics in Diane's case, aided by Diane's brother, Mr. James Frederickson. Tune live at 8PM Eastern to Crimes of the Century Radio on the Black Talk Radio Network. Tune In: http://blacktalkradionetwork.com/page...

Illinois Judge Orders DNA Testing in Murder Case

Illinois Judge Orders DNA Testing in Murder Case | socialaction2014 | Scoop.it

Nearly four decades after an Illinois man was initially convicted of the murders of a brother and sister in their home, a judge ruled that several pieces of evidence could undergo DNA testing, reported the Journal Star.

Johnnie Lee Savory spent 30 years behind bars before being released in 2006. Five years later, Illinois Gov. Pat Quinn commuted his sentence and ended his parole.

In Tuesday’s ruling, Peoria County Circuit Judge Steve Kouri said that the order doesn’t allow for a new trial and that DNA testing could be conducted at Savory’s own expense.

“This means hope for Johnnie,” said Joshua Tepfer, an attorney with the Northwestern University’s Center on Wrongful Convictions. “He has wanted this and fought for this and a team of advocates and friends have fought for this for more than 20 years, or since this technology became available.”

Savory, who has maintained his innocence, was tried twice. He was found guilty in the stabbing deaths of Connie Cooper, 19, and her brother, James Robinson, 14, in June 1977. His first conviction was overturned when the Third District Illinois Appellate Court ruled Savory’s alleged confession involuntary. He was retried in 1981 and found guilty again. Two years later, two of the witnesses recanted their testimony.

Among the pieces of evidence being tested are items the investigators deemed relevant to the case back in 1977. They include the purported murder weapon, a knife taken from Savory’s pants, the pants Savory was wearing, fingernail clippings from Copper and Robinson as well as a bloody light switch plate.

Kouri noted in his order that the blood evidence used against Savory was only able to identify the group type, which is far less probative than DNA.

“Type O blood type is found in approximately one in two people and Type A is in approximately one in three people,” Kouri wrote. “Can it be imagined that such rudimentary ‘scientific’ evidence would be presented and argued to a jury in a courtroom today, particularly in a double-homicide trial?”

The Center on Wrongful Convictions already has a Texas-based DNA testing firm lined up, and Tepfer is optimistic about the results.

CPU & NYPD "FACE OFF" - YouTube

Copwatch Patrol Unit (CPU) while patrolling the 25th Precinct and the PSA5 housing precinct we witness a young Black male being taking in handcuff to a patrol car. While the young Black male pass by our cameras he said that he was assaulted by police in the 9th floor. Then in the same video you will hear a plain clothes police officer also confront us and says, "go record the girlfriend who was just assaulted by him".

After police left the scene, CPU hung around for another 30 minutes to see if we see the young lady that was assaulted, but no ambulance came or the young lady who police said was assaulted surface.

We did get the opportunity to speak to 3 people 1 being the member of the girlfriend family. CPU was told that they was arguing, but no one hit anyone. There was a call to 911, but it was made according to the witnesses by a neighbor. When 2 police officers arrived at the scene they got into an argument with the young Black Male and then the called into the 911 dispatch that officers needed assistance (10-13) and an army of militarize police officers showed up.

CPU Presence there is to empower the community into taking action when they see police and civilian encounters. CPU is not there to judge, but to document and share with the world. Police have always been aggressive with civilians and many times civilians end up hurt or Kill. CPU wants the NYPD and Police around the world to know that there is a group of Freedom Fighters that is willing to stand up against any injustice and CPU is not afraid to put their body on the line to send this message to all those police that thinks they could come into our communities and bully our brothers and sisters. Enough is Enough.

Police also need to understand that they are not the judge, jury and executioner. Their job in this unjust system is to lock up those that they so-called deem criminals.

You the audience use your own understanding on how to decipher what you see in our videos. Use you experience and knowledge of what you have live and witness thru your days in this planet and you will see the truth manifest itself.

If you see something, pulled out your phone and document it. Video does not lie!

Silence Is Consent!!!
