Who is Davontae Sanford? He is Detroit's Forgotten Child. Innocence raped in the grips of overzealous cops and a prosecutor who doesn't give a damn about justice or innocence. She wants Detroit to forget Davontae!! To ignore her great evil misdeeds and sweep the case under the carpet. And your silence has made it all possible Detroit. BUT she suffered a MAJOR defeat at the Michigan Court of Appeals when that court granted Davontae relief on every issue he raised but one; namely whether Private Investigator Linda Boris can testify as to the details of the murders that Vincent Smothers confided in her --as he has to CNN; the Associated Press; his attorney and last but not least to Detroit Homicide investigators. Davontae cross-appealed that issue at the Supreme court. Smothers wants to confess on the record to clear Davontae for the four murders he did not commit. What does Smothers have to gain by confessing to a crime that he knows will get him a mandatory life sentence? Nothing! But Kym Worthy has a lot to lose if he does. Millions of dollars in civil liability and her integrity (which isn't much) for WRONGFULLY convicting that young boy! And Detroit? You are okay with this? Well we can't wait for sleepers to wake up from a dream. Fortunately one appeals court made up of all conservative judges by the way ruled in Davontaes favor. The prosecutor appealed that decision to the Michigan Supreme Court where we are now in a,wait and see hold for the high court. I am cautiously optimistic however that given the fact the three judge panel who ruled in Davontaes favor were all conservatives the state high court which is majority conservative will deny Worthy's appeal. And then the ugly court battle will begin. She will NOT be able to stop Smothers from confessing on the record and convince the trial judge to sustain Davontaes convictions. It's hardly surprising in a regime designed to brutalise and punish the poor, although, of course, the DWP has come out with its usual fatuous denial saying, "Mental health problems are complex, and to try to link them to one thing - such as welfare reform - is misleading and irresponsible." A department that thinks the poor can be incentivised by depriving them of the means of survival is, I am sure, convinced that those forced to impose such sanctions have a cushy number. Since the crash the rich have more than doubled their wealth ably assisted by your government, the notion of the trickle down effect, that the poor will get to enjoy some crumbs falling from the tables of the rich, is revealed for all its sick, arrogant, nonsense. Steven Castanedo was still a teenager when he was arrested for murder in the second degree. He got caught up in a flawed justice system, was not provided with proper defense counsel and became a victim of Florida's Mandatory Minimum Sentencing Law. He's serving a 35 YEAR PRISON SENTENCE, with a 25 year mandatory. Steven never got a chance for due process with a trial. He basically took the lesser of two evils. His choices were to go to trial the following Monday with an attorney who had not even interviewed one witness or reviewed the case and risk getting LIFE WITHOUT PAROLE (that’s right, prison until he dies), or take a plea and settle for a minimum mandatory sentence of 25 years and a maximum of 35 years. Which sounds better to you? As a seventeen year old with no one to advise him other than a disinterested attorney, do you think Steven was scared? Detectives went to Steven’s house and collected his clothes and shoes to send to forensics to check for blood, gun residue, or any DNA that could place him at the crime. They also tested his hands for gun residue to see if he fired a weapon. All tests came back NEGATIVE. Defense attorney Shirley turned to Steven Castanedo and said “I think it is in your best interest to take the plea”. Shirley stated on record that he “wanted the defendant to understand the severity of the offense”, and that he “was looking at life in prison and never get(ing) [sic] out”. Steven’s attorney coerced him into accepting the plea or alternatively go to trial with an unprepared attorney that knew nothing about the case and risk a LIFE sentence. He was young, terrified, and did not know what to do, so he took his attorney’s advice and pled guilty. In my opinion on CAPITAL CRIMES i believe prosecutors should prove beyond a reasonable doubt that a person actually committed the crime DO NOT go off of HEARSAY. I can say anybody did this or that and they are getting life. That is not JUSTICE! We have now retained an excellent attorney that specializes in appeals/juveniles he goes by the name of Michael Ufferman from Tallahassee Florida, we pray he will get Steven the justice he so well deserves.
Paul Gatling tries to hold back tears as he is exonerated, Monday, May 2, 2016, in New York City. Gatling, now 81, was 29 when he was wrongfully convicted of the murder of Lawrence Rothbort in his Brooklyn home in 1963. The decorated Korean War vet was grilled by detectives until he confessed to avoid the electric chair. However, there was always something strange about the case, such as Rothbort's wife could not immediately pick him out of a police line-up. Gatling stated, "I was a young black man. With the white, pregnant wife in front of an all-white jury pointing me out, it was over." Gatling said that "Most of all, I want to vote before I die". Today I remember the beautiful Mitrice Richardson on what would have been her 31st birthday. I reflect on all of the lost hope, the lost dreams, and the lack of compassion the LA Sheriff's Dept had for her & her family. It's been almost 7-years since Mitrice Richardson was released from the Malibu/ Lost Hills Sheriffs Department in Agoura Hills, CA. in the dark hours of the early morning with no car, no phone, and no money. Tragically, her naked skeletal remains were found in a remote canyon very close to the sheriff's station 11 months later. The Los Angeles Sheriff's Dept. has consistently mishandled the investigation of her murder (including removing her remains from the "crime scene" without the coroners permission). Though I never had the privilege of personally meeting Mitrice...Her life has helped me find my purpose. It is now a life committed to Advocacy & Support to the families of missing persons. The way people suffering mental illness & their interaction with law enforcement MUST be changed. This could happen to any of our children. Please google and read her complete story.
