Many of the local roads surrounding the various cities and towns in Northern California are very similar to the Lakeville Highway. Inevitably these small and windy roads have people who are driving too fast for the conditions and either drift into the oncoming traffic, or will run into traffic that is stopped on a blind turn. Vehicle Code Section 21460 (a) states: "If double parallel solid yellow lines are in place, a person driving a vehicle shall not drive to the left of the lines" and Vehicle Code Section 22350 states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”As this accident indicates the driver was going over 50 miles per hour and drifted over. As we drive these roads think about how many times we will cut the lines on a turn to go faster. This is an unfortunate accident that thankfully did not cost anyone their life. LAKE COUNTY -- There's something in the water and it's responsible for taking the life of Ryland Joseph.

Tragic and horrifying. As a parent of two beautiful boys, I am always afraid of what is out there, and what they face. My youngest son spent three months in the NICU after being born extremely premature. When you hear stories such as this your heart breaks.

 

Right now the current Medical Malpractice laws in California are extremely outdated. Currently California has caps on what a family that has lost a child due to the negligence of a hospital to limits that were set when Jerry Brown was originally in office.

 

Legislation is currently in Sacramento to change that. In the coming weeks there will be many advertisements and talking heads discussing MICRA (Medical Injury Compensation Reform Act of 1975) and the raising of the limits of what hospitals and medical practitioners would pay when they are liable for damages caused by their negligence. (For example, having plumbing with legionnaire’s disease in it).

 

Do not let the scare tactic ads from the medical malpractice insurance carriers scare you. I urge you to actually read about the act itself before you act.

CHP takes action to fight collisions caused by speed and aggressive driving

This is great news! Many auto accidents are caused by one of two things, either the person is driving too fast, or following someone too closely.


California Vehicle Codes §22350, and §21703, state inter alia:

 

            “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” VC §22350.

 

            “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” VC §21703.


When drivers are in violation of one or both of these statutes it typically leads to a rear end accident.  The fact that the CHP is now taking an effort to limit these factors means that many more people will not have to go through the pain and misery of an auto accident.

KELSEYVILLE -- Agencies are conducting a joint investigation into the officer-involved car crash which resulted in the death of one woman on Oct.

As horrendous and tragic as this event is, there are many issues that arise from accidents involving a public entity, like the Lake County Sheriff Department and a private citizen. Questions such as, why was Officer Lewis driving in an emergency protocol? Where on Highway 29  were they? Was Officer Lewis following proper procedure, and was he driving in a reasonable manner considering that he was under emergency protocol?


For Ms. Garcia there are questions of why she did not pull over to the side. That area of Highway 29 is narrow; was Ms. Garcia able to see the emergency lights? Did Officer Lewis also have his sirens on also?


All of these questions will have to be answered to determine who was at fault for the accident.


When a person does file a claim against a public entity there is a very short statute of limitations. Meaning, that Ms. Garcia's family only has six months from the time of the accident to file a claim against the county, and then from the time the county responds, six more months  to file suit.

One of the worst things imaginable is being in an auto accident while your children are in the car with you. In California, if you are in an auto accident, no matter how minor, if you have a child using a booster seat, car seat, or full child car seating system, by law, the Insurance provider for the third party responsible for the accident must replace the child seating system.

DID YOU KNOW?  That every policy of insurance issued in the State of California is required to cover the replacement costs of all child safety restraints and seats after an accident.  It is good policy to ALWAYS replace these seats in the event of a motor vehicle collision as even fairly minor impact crashes can safety issues with these seats.

Though the picture would suggest otherwise, this is not "breaking bad". The cultivation and sale of marijuana in California is a very murky and grey area of the law right now. According to the article there were 37 mature plants with seven people cultivating and growing, or "owning" them. Each district and county has their own guidelines about what is and what is not a legal amount. From the article these seven individuals need to hire a lawyer well versed in Marijuana laws in California and should defend this case fully.

KELSEYVILLE -- Two children and two adults made it out of an American Type A school bus crash with minor injuries on Highway 29 near Smith Ranch Road Tuesday afternoon.

The safety of our children is always in the back of a parents mind. This is especially true when we entrust our children to a school teacher, a babysitter, coach or put them onto a bus. Fortunately no one was seriously hurt in this accident.

 

"California requires three-point seat belts on (1) school buses manufactured on and after July 1, 2005 that carry more than 16 passengers, and (2) all other school buses manufactured on and after July 1, 2004. It asks school transportation providers to first allocate seat-belt equipped school buses for elementary school students whenever possible. The state cannot charge any person, school district, or organization with violating this law if a passenger either does not fasten his or her seat belt, or does so improperly (Cal. Veh. Code § 27316)."

It is not very often that an accident of that severity allows all passengers to walk away with only minor injuries. The driver and his passengers were very lucky.

Growing up in Lake County, and seeing the damage that meth can do I am glad of the amounts of meth siezed. That being said, there are always two sides to the story. Hopefully this person will be able to have representation by a good attorney who can make sure that the punishment fits the crime. Too often people who make the news are way overpunished and to that end spend more time in prison that warranted.

Pedestrians have the right of way, period. Pedestrian accidents are almost always catstrophic, and almost always the motor vehicle drivers fault.

In small towns though the fault of the pedestrian jaywalking and not paying attention also arrises. Small towns have narrower streets, sidewalks that are close to the moving vehicles, or at times no areas for pedestrians at all. It is at these times that DRIVERS need to be more aware of their surroundings.

In many small towns the business center is small and conjested. You will have tight street parking with cars jammed against the sidewalk, and pedestrians darting across the streets and back. The Driver going through these short conjested areas need to be vigilent. Though a jaywalking pedestrian can sometimes be found at fault, the injuries that a motor vehicle causes to a pedestrian will haunt a driver for life, and even a small percentage of liability will still be many thousands of dollars.
