A Muslim hospital consultant was told yesterday that he must pay his ex-wife maintenance even though under Islamic rules he believes he owes her nothing.

A judge told Dr Zaid Al-Saffar that he must follow ‘the rule in this country’ and share his money.

The Appeal Court decision means Dr Al-Saffar must pay £60,000 to his former wife, academic Hanan Al-Saffar.

The ruling sounded a warning to Muslim couples who believe their marriages are ordered according to sharia law and agree to be bound by Islamic courts.

Lord Justice Ward told Dr Al-Saffar: ‘The rule in this country is that you share and the starting point is equal division.
‘You came out of the marriage without having made your wife any substantial capital payment.’

He added: ‘Life is sometimes hard; do not be consumed with bitterness.’

But Dr Al-Saffar said after the case: ‘By playing the system and pretending to be a victim she got everything, which I think is totally unfair.

‘Family law in this country is biased against Muslim people.’

The consultant rheumatologist at Scarborough Hospital in North Yorkshire, who is also the head of the Islamic Society in the resort town, was married for eight years, and the couple had two children.

The marriage was formalised following the Islamic tradition of Mahr, under which the groom pays a gift to his bride.
Because of this, his wife had signed away her share of the couple’s home in Belvedere Road, in Scarborough.

May 17, 2012 (KHARTOUM) – A court in the Sudanese capital Khartoum has sentenced an unidentified woman to be executed by stoning for committing the “crime of fornication” under Islamic Shariah laws, local newspapers reported on Wednesday.

 

The sentence was handed down on 14 May by Judge Sami Ibrahim Shabo who presides over the general criminal court in Um Bada area, in the suburbs of Khartoum’s twin-city of Omdurman.

According to the privately-owned daily newspaper Al-Ahram al-Yawm, the court issued the sentence after the defendant refused to “retract her earlier confessions” that the child she gave birth to is from a man other than her husband.

The man she said she had a sexual relationship with has denied the charge and was therefore acquitted by the judge.

The predominantly Muslim Sudan is supposedly governed by Shariah laws under the rule of the Islamist National Congress Party (NCP).

However, there are no recorded cases of courts applying the extreme punishments of stoning to death for adultery or the amputation of hands for theft.

Newspapers said that the sentence has been referred to the Supreme Court for final approval.

I have read reports from different sources that at least 14 young people were stoned to death in Baghdad in the last month.

 

This is being reported as a deliberate campaign by Shi'ite militants against kids who are dressed in 'emo' style. This subculture is widely perceived in Iraq as both gay and an expression of Satanism, say the reports.

According to Reuters, militants in Shi'ite neighbourhoods where these kids were attacked, had circulated pamphlets on Saturday morning naming at least 24 more youths who will be targeted for death if they do not change the way they dress.

"We strongly warn you, to all the obscene males and females, if you will not leave this filthy work within four days the punishment of God will descend upon you at the hand of the Mujahideen," this pamphlet reads.

Different reports are coming out about these attacks.

The majority of the youths who have been attacked have died from severe skull fractures after being beaten with rocks and bricks, although I have also read they are using concrete blocks.

Others, including two girls, were wounded in assaults, these were warnings…

There are others being targeted and this is a part of a larger trend in the area, where as many as 58 Iraqis believed to be gay have been bludgeoned to death with rocks in the past six weeks.

There were previous attacks in 2009 on those believed to be or known to be gay in Iraq.

Egyptian Women Appeal Sex-After-Death, Teen Marriage Laws.

Egyptian women have urged the country’s Islamist-dominated parliament not to pass two controversial laws on age at marriage and sex after death.

The two laws include provisions that would void the rights of women to obtaining education and employment due to religious standards.

 

One of the laws would drop the minimum permissible age of marriage to age 14. The other would permit a husband to carry out conjugal relations with his wife within six hours following her death.

 

The latter issue was originally raised by Moroccan Islamic cleric Zamzami Abdul Bari in May 2011, according to the Al Arabiya pan-Arab news network. Bari was quoted as saying that marriage remains valid even after death – and that a woman could also claim the same right as a man in such a matter.

 

The news of the controversial legislation under consideration was reported last week by Egyptian columnist Amro Abdul Samea in the Egyptian Al Ahram newspaper. According to Samea, Dr. Mervat al-Talawi, head of Egypt’s National Council for Women sent an appeal on the matter to Dr. Sa’ad al-Katatni, Speaker of the Egyptian People’s Assembly.

 

A second journalist, TV anchor Jaber al-Qarmouty, commented on the “’Farewell Intercourse’ draft law” after Samea’s article was published, saying, “This is unbelievable. It is a catastrophe to give the husband such a right! Has the Islamic trend reached that far? Is there really a draft law in this regard? Are there people thinking in this manner?”

 

Since Islamists have taken over the Egyptian parliament in the past year, more moderate forces in the country have grown increasingly concerned over the future of women’s rights in Egypt. At present, Egyptian women retain the right to end unhappy or abusive marriages without interference from a husband, through the Khula – the Islamic right to divorce law, which grants men the right to terminate a marriage as well. Islamists in the Egyptian parliament also wish to cancel the law empowering women to use the Khula to end a bad marriage.
