“Happy Birthday” is public domain, former owner Warner/Chapell to pay $14M

“Happy Birthday” is public domain, former owner Warner/Chapell to pay $14M | Musica, Copyright & Tecnologia | Scoop.it
Music publisher Warner/Chappell will no longer be allowed to collect licensing royalties on those who sing "Happy Birthday" in public and will pay back $14 million to those who have paid for licensing in the past, according to court settlement papers filed late Monday night.

The settlement is a result of a lawsuit originally filed in 2013 by filmmaker Jennifer Nelson, who challenged the "Happy Birthday" copyright. "Happy Birthday" has the same melody as "Good Morning to You," a children's song dating to the 19th Century. But despite the song's murky early history, music publisher Warner/Chappell has stuck to its story that the song was copyrighted in 1935, and a royalty had to be paid for any public use of it—until now.

Pandora's CEO Explains Why 'Free' Music Is Worth So Much: Op-Ed

Pandora's CEO Explains Why 'Free' Music Is Worth So Much: Op-Ed | Musica, Copyright & Tecnologia | Scoop.it
It is a transformative period for the music industry. Unlike any other time in history, new technologies have enabled nearly limitless connections between listeners and the music they love. We know this is so because at Pandora, making those connections is our business and our passion. By making licensed music effortlessly accessible to the masses, services like ours foster discovery and excitement between artists and fans, creating a virtuous cycle of new revenue and opportunity.

Joshua Smith's curator insight, November 4, 2015 1:19 PM

To argue that Free to listener sites are bad seems ridiculous to me. Sites like Pandora use advertisements to pay for royalties and site maintenance in order to offer music steaming free to listeners. I personally do not use any sites like this, as I prefer to pay the subscription fee to have access over what I listen to rather than a random playlist curated on my tastes. For the average listen Pandora provides a great, and free, service that introduces them to new music and new artists in turn driving sales of merchandise and music for them. This seems no different to me than having a big box retailer reselling your albums to the consumer.

SoundCloud CEO Alexander Ljung on Making 'Freemium' Work and Negotiating With the Majors

SoundCloud CEO Alexander Ljung on Making 'Freemium' Work and Negotiating With the Majors | Musica, Copyright & Tecnologia | Scoop.it
Six months from now, the online audio platform SoundCloud could be competing with Spotify and Apple in the music-streaming business. On the other hand, it also could be the next target of the major labels’ legal wrath, like the recently shuttered Grooveshark. The answer to that billion-dollar question (based on reports of the company’s valuation) depends on Alexander Ljung, SoundCloud’s co-founder and CEO.

I'm just not really looking forward to paying a subscription to use SoundCloud. A big part of their has a free account at the moment and I doubt they'll continue to use SoundCloud to find new music. As a music producer, I'm going to have to open myself to new methods of finding and posting music after this just because half or more of my audience will not be able to hear my music on SoundCloud.

This article explains that Apple realizes the amount of tasks they have ahead of them to improve their streaming service. It also goes over the fact that they can only improve these things with time and experience that comes from talking to major record labels as well as independent artists, both of which they greatly appreciate as much as the other.

Sajada Artis's curator insight, September 13, 2015 5:38 PM

Apple attempts to to create a new music streaming service to apple products. Apple Music will also launch for Android devices in the fall of 2015. In August 2015 Apple has signed up 11 million people for Apple Music’s three month free trial which started on June 30, 2015. At the end of September services will be $9.99 a month for service.

I believe this is a pretty cool feature, however would people really pay $9.99a month for music when there is plenty of other streaming services out there for free? I do believe this is a great idea to jumpstart the Music Industry however I believe not many people will may for something that they can get for free somewhere else.

This news article reveals a very valuable information about free music streaming including different websites and apps, just like youtube, souncloud and others. Pandora (internet radio) is determine to prove that free listening does create value for the music industry, revealing that 10 years after launching the company has now paid out USD1.5bn in royalties.  It mentions that the services emphasises that music streaming services are still only beginning to touch on the real potential in advertising supported models. The Recording Industry Association of America (RIAA) puts the total US market for music subscription services at USD800m in 2014, but USD 40bn for radio and digital ads. All of this business need to benefit  all spaces how ever free services claim that the real challenge is in convincing the consumers not to pirate music.

This articles explain the hurt on music sales on online stores like iTunes, Amazon, and others. Streaming music is ultimately hurting the general sales of any record labels or music distribution formats.

Alex Capps's curator insight, November 9, 2014 8:41 PM

In this article it is stated that the sales of online downloads dropped 6.5%  between 2012 and 2013 while online streaming sales climbed 32%. It is believed that streaming will become the most sufficient way for music collecting. The article also shows a breakdown of overall music sales.

JD Gorecki's curator insight, May 15, 2015 5:53 PM

This article is an overall summary of music streaming and the justified impact it is making on the world within the last few years. It clearly examples from "Billboard" and "Nielsen Entertainment" with facts and quotes such as "streaming was up 32 percent over the previous year, to 118.1 billion track streams." The reader will find many other statistics throughout the article making it a much more realistic idea of the latest music streaming. I believe that this is a reliable source and overview to undermine what is really being covered because of the facts presented from important people and companies playing a major role in the industry.

And yet they keep thinking free music based on the outdated broadcaster to audience scheme

EungKyun Kim's curator insight, April 14, 2014 3:35 AM

I love this idea that people can personalize their track list. By listening to the regular radio station, I can have chance to listen to new music that I did not know. However, sometimes, they play some songs that I do not want to listen and they do not play what I want to listen. By personalizing my own track list, I can listen the song that I want all the time. I think this is really good idea to provide personalized radio station to the public.
