The article cites approximately 15 juvenile sex offenders are being held indefinitely in New Jersey's Adult Diagnostic and Treatment Facility (ADTC) under the state's civil commitment laws.  In the past week, the United States Supreme Court ruled in Montgomery v. Louisiana that lifetime incarceration for juveniles is a violation of the Eighth Amendment, which provides protection against cruel and unusual punishment.  It stands to reason that this federal case will provide the grounds to challenge lifetime civil commitment for juvenile sex offenders.

This week a Cumberland County man pleaded guilty to distribution of child pornography (Endangering the Welfare of a Child), specifically storing files depicting child abuse on a file-sharing program on his computer, which was accessible to other users.

Canada does not have a sex offender registration and notification law similar to Megan's Law.  If convicted of his sex crimes in the US, this Canadian may be placed on Megan's Law and parole supervision, which could prohibit him from returning to his native country.

The Asbury Press Park reports that an Ocean County sex offender was charged with failure to register.  In New Jersey, there are two kinds of Megan's Law violations: 1) Failure to Register, and 2) Failure to Verify.  Both are third degree crimes, punishable by up to 5 years is state prison and up to a $15,000 fine.

A sex offender registrant is exposed to a far greater sentence for a federal Failure to Register charge, than if he were charged at the state level.  For instance, the New Haven man is facing up to 10 years in federal prison for Failure to Register under SORNA.  If he were charged with Failure to Register in New Jersey, his maximum sentence would be 5 years.

A 66-year-old South Toms River man admitted in an Ocean County courtroom on Wednesday that he sexually assaulted two young girls.

The Ocean County man plead guilty to two counts of first-degree aggravated sexual assault.  It is reported that the prosecutor is seeking a sentence of 13-years imprisonment.  If the court finds that the defendant's actions can be characterized as "repetitive and compulsive," he may be serving his sentence at the Adult Diagnostic and Treatment Center (ADTC), also known as Avenel.

NJ legislatures and politicians are regularly encouraging parents to utilize the Megan's Law internet registry. It has just been reported yesterday that an Ocean County freeholder advised parents to review the sex offender registry.  Other efforts include Senate Bill No. 1762, which would require school districts and child care centers to distribute information on Megan's Law and instructions on how to access the registry website.
