  1. Careless maneuvering by other drivers on the road: Four-wheeled vehicles tend to cause more motorcycle accidents than others. Most drivers are unable to detect motorcyclists or do not pay enough attention to them. They tend to make abrupt swerves that invariably results in a fall or collision. Motorcyclists are either forced off their bikes or make hard hitting physical contact resulting in severe injuries to the arm, neck and face areas.
  2. Loss of control of bike: Many motorcyclists have been victims of accidents because they were unable to control their motorcycles and took a skid or fall. In a motorcycle crash of this nature, the rider’s arms or legs often tend to get caught beneath his machine resulting in serious lacerations or even fractures. Control is defined as the ability to stop the bike at will in a safe manner.
  3. Sudden stops trigger accidents: Speeding was not a contributing factor for bike accidents. More clearly indicated was the occurrence of sudden stops as a cause for accidents. In fact, statistics indicated that as much as 70% of motorcycle accidents occurred when the motorcyclist was cruising at speeds less than 30 miles per hour. The solution is that motorcyclists are advised to slow down instead of clamping down the brake. The sudden switch in momentum makes the rider fly over the bike and sustain serious injuries.
  4. Age: The age factor has shown contradictory results in Europe and the US. In Europe, more young riders had had accidents while in the US, statistics favored middle-aged riders as more prone to accidents. But the DOT suggests that age perhaps is a redundant factor when it comes to accidents and the cause is more related to rashness while riding.
  5. Concealed objects: Another reason was cited as hidden objects that riders failed to detect until the last moment. Many times, the blinding glare of sunlight or low visibility during rains or snow can render solid objects nearly invisible until the rider was too close for comfort. Conversely, statistics indicated that motorcyclists who wore dark clothes were more likely to be missed than those who wore bright clothes.


The main issue that the study was able to highlight effectively was the importance of protective gear in preventing accidents. Since the study was based in Europe, helmets did not figure as a cause helmets are compulsory for motorcycle riding. The low results of motorcycle accidents were a clear proof of the fact that helmets made all the difference to bike riding. Perhaps it is time for the US to enforce all present regulations that require helmets to reduce the significance of catastrophic injuries sustained by motorcyclists in accidents of all types.

  • 32 states restrict the use of or have bans on cell phones for novice drivers. So this includes any under 18’s or learners.
  • 45 states as well as Washington D.C have restrictions on passengers for anyone in the intermediate stage. A majority of the states say that for the first 6 months to a year of driving you cannot have any passengers under the age of 21.
  • Night time driving is restricted in 48 states and Washington D.C for the intermediate stage and new drivers.


As more focus is put upon teenage drivers and possible distractions, and the new GDL laws that are being made there is hope that teen deaths while driving will be reduced. New drivers need time to become better drivers and help reduce the statistics of fatal auto accidents. Parents can help by encouraging their teens to not drive in groups and to become more focused on their driving.

Apparently, the presumably highly paid lobbyists for the construction industry slipped this law past the goalie (MA legislature) so to speak. The rational for this ill-advised and unfair law is “that the liability of engineers and contractors not be infinite in duration.” Milligan v. Tibbetts Engineering Corp., 391 Mass. 364, 368 (1984).

In Klein, Plaintiff’s Massachusetts Personal Injury Attorneys fought to upend this Statute of Repose. In klein, the victim was injured in a  construction accident 8 years after the statute of repose had expired. Id. They claimed that”….G. L. c. 260, Section 2B, violates the due process and equal protection guarantees of the United States and Massachusetts Constitutions and the right to a remedy by recourse to the laws guaranteed by the Massachusetts Constitution.” It certainly sounded like a nice well thought of argument by the MA Construction Accident Attorneys but it was blown up by the MA Supre Judicial Court. In Klein v. Catalano the Massachusetts Supreme judicial Court  succinctly declared: ,“Simply put, after six years, the statute completely eliminates a cause of action against certain persons in the construction industry.” Klein v. Catalano, 386 Mass. 701, 702-703 (1982). 


In other words if a building collapses and kills 5 people, more than 6 years after the building is open to the public, then the estates of the people killed in the fatal/ deadly accident have no recourse to obtain damages in a wrongful death cause of action in Mass. against the builders and engineers. OUTRAGEOUS


“Section 2B. Action of tort for damages arising out of any deficiency or neglect in the design, planning, construction or general administration of an improvement to real property, other than that of a public agency as defined in section thirty-nine A of chapter seven shall be commenced only within three years next after the cause of action accrues (STATUTE OF LIMITATIONS); provided, however, that in no event shall such actions be commenced more than six years after the earlier of the dates of: (1) the opening of the improvement to use; or (2) substantial completion of the improvement and the taking of possession for occupancy by the owner. The troubling 1974 Massachusetts workers compensation case “Mary E Canavan’s Case” is a classic example. This is a classic case of big government and Insurance denying defending and ducking responsibility in an health care employment injury cause of action.

Mary Canavan was a health care employee / nurse working as an employee for the city of Boston trying to make ends meet. Id. She was a nurse at the Long Island Hospital in Boston. Id. The City of Boston was a self-insured entity. Id. At the time of the injury Ms. Canavan was injured living on hospital grounds. Id.


The reason this case is troubling is that the City of Boston tried to deny a claim in which a nurse on hospital grounds was injured while trying to help in an emergency situation. She did everything she could to prevent others from being killed in a boat accident on hospital grounds. She risked her own health and welfare to save others which is her responsibility as a nurse. Despite this the City of Boston forced her to litigate and refused to do what is just and right by paying her workers compensation claim!
