Many ads and many people will always say, "Don't plead guitly". The person who is accused will then look at an offer of a "low term" or the legal minimum jail time, that is offered and the threat of the "high term" if they don't accept the plea. Many times this will mean the difference between going to county jail or state prison, or going in for one year compared to serving four. The accused will then plead guilty for no other reason then the possiblity of four years over thier head.


The disparity between low and high terms almost always make the person charged look long and hard at the minimum offer. Many times, even if the person is innocent, the evidence, both direct and circumstantial may look difficult to overcome. The problem then arrises, that even if the person is innocent, the threat of a high term hanging over their head will cause the accused to just take the best of what is offered. Sometimes the person will feel that the low term is the best of equally bad alternatives.

As in many courthouses throughout the state, budget cuts, budget shortfalls and lack of state money has put a gridlock on justice. In many southern California courts, civil cases can take up to 3 years from the time of filing the complaint until the time of trial. In the criminal courts, because many courthouses have consolitaded, or closed, criminal trials are set to very strict time guidelines and any continuances are frowned upon, if not outright denied. In many situations this is not a problem, but if the criminal case is complex, or there is evidence that needs to be either produced or found, the lack of time can be devastating to the accused.

An interesting story. From the article it would appear that the officer is guilty. But, the jury did not find him so! In our judicial system we rely heavily upon the fellow members of our society to hear all the evidence and to make a determination upon that evidence. According to CALCRIM No. 219, reasonable doubt is, "proof that leaves you with an abiding conviction that the allegations of the petition are true. The evidence need not eliminate all possible doubt..." Here a jury heard the evidence and found that the officer was not guilty.

 

Sexual allegations are a dangerous and in many instance a life altering accusation. Though many allegations are justified, many are not. Because of the stigma attached to a sexual allegation and the belief in our society that many allegations are automatically true, a person charged needs to be prepared to prove his innocence, through investigation and interviews to determine the truth. Though this is not how system are is set up. With these horrendous allegations it is unfortunately what has to be done.

 

The issues with sexual allegations in my opinion only, is that because of the harm to society that sexual harassment and sexual battery does to the victim, that society needs to punish those guilty, and punish them severely. Unfortunately though, because society views those guilty so harshly, that harsh judgment is then passed to those accused, and accused only.

 

For a person with a vendetta, a simple accusation can set in motion the machinery to destroy an innocent person. Here a person was doing his job, and woman who was a prostitute and car thief made an accusation. Now the officer is out of a job, faces the potential of losing his pension and many other stigmas. Though it is unknown what actually happened, or which story is ultimately true. Based on the jury verdict this man was not guilty and his life is ruined.

Unfortunately as has been said here before, DUI's happen to everyone. For every drink a person takes it can take upwards of an hour for that drink to be processed in your system. Mixed drinks are worse. There is no way to know what the bartender poured, was it a heavy pour or light, and many drinks mix two or three different alcohols. This doesn't even take into account the possession charge. Mr. Smith needs to have a good DUI and Drug possession attorney. The taking of a human life is the most atrocious thing that another human being can do. The one constant in all society is that the taking of a human life is wrong. So how can we justify taking the life by our government?


There are many reasons to consider the death penalty outdated. Included are my top three:  1) its more expensive to run a death row block than a general population block 2) With automatic appeals, and the appellate process actually proceeding through the penalty (the execution) can take many years, as the article noted, California's last execution was in 2006. 3) Finally, its a mercy. What is more of a punishment for a deranged killer? Sitting in a small box for the next 20, 30, 70 years, or being executed in the next few years?

As with any DUI there are many factors to consider before anyone can pronounce judgment. Ultimately what needs to be determined is if he was .08  at the time he was driving. No more and no less. If he was .07, he was not drunk driving. If he was .08 or higher he was.

There is a strong argument in major metro areas that the stadiums have priced out the regular fan. Yet, these stadiums are also the quietest and have the least amount of violence from the fans. What is the correct balance? Regular fans bring the noise and energy, and unfortunately, a small percentage also bring rage and violence. In the major metros, the cost is so high to go to the game that tickets are bought by corporate sponsers and handed out to bigwigs. Because of that people in these major metros are on their best behaviour because the boss IS looking. In the older stadiums and the lower cost venues everybody can go. The flip side is that because everyone goes behaviours go out the window. Can undercover police officers curb this?

Though the picture would suggest otherwise, this is not "breaking bad". The cultivation and sale of marijuana in California is a very murky and grey area of the law right now. According to the article there were 37 mature plants with seven people cultivating and growing, or "owning" them. Each district and county has their own guidelines about what is and what is not a legal amount. From the article these seven individuals need to hire a lawyer well versed in Marijuana laws in California and should defend this case fully.

Transporting drugs is a very serious crime that can have not only local jail, but state prison, or federal prison terms. The fact that the accused sells marijuana is of itself not the real problem for this man. Marijuana can carry a serious jail sentence, but that, coupled with the meth, and evasion, and his admissions mean that this person will be facing a serious prison term. In this situation this person will need an experienced and resourceful attorney.

Bestiality, and conspiracy and disseminating obscene materials? Though what the couple were doing with their dog both sicken me and unfortunately, makes me laugh uncontrollably, I am still concerned that calling this dissemination of obscene material. According to Calcrim Jury instruction 1142, "material, when considered as a whole is obscene if: 1. it shows or describes sexual conduct in a obviously offensive way; 2. a reasonable person would conclude that it lacks serious literary, artistic, political, or scientific value; AND 3. an average adult person applying contemporary statewide standards would conclude that it appeals to a prurient interest. (Further defined as a shameful or morbid interest in nudity, sex, or excretion.)" 

 

On the face this would seem to fit the bill. But, that is in my opinion alone. The issue with obscenity is the same as it was in the 70's, specifically, "what is obscene". Just because I do not like the subject matter, does not necessarily make the obscene. I also do not like Spongebob Squarepants and do not allow my children to watch the program. To me, that show is also obscene, but, I loved Breaking Bad, which others have found obscene.

 

Ultimately my opinion is just that. MY OPINION alone. But, I also could be missing the point on obscenity in general. Some things just might be too sick to defend. As gross as this case appears though, I feel that a defense could be very well made.

The biggest issue with drunk driving parents is not the underlying driving under the influence charge, which by itself is a serious misdemeanor that will follow the convicted driver for ten years, but the more serious and lasting charge of child endangerment. In California if a parent is driving under the influence and has children in the car at the time, that parent can and will lose their custodial rights to the children. The state will take them.

This is an amazing step forward in a number of issues that face the California Criminal Justice system. First, children who make horrendous decisions are just that. Children who have made horrendous decisions. Punishing a child well until adulthood is counter productive and counter intuitive. Though punishing a horrendous crime with a very strict and severe punishment "feels" like the right thing to do. Ultimately, in many instances it is not. There are many instances of youths who when given a second chance turned their lives around. One reason that has been given for a youth's turnaround is simple maturity. The stupid and dumb decisions that a youth makes would not have been made in an adult. Young men do not mentally develop until their early to mid twenties. When a youth is put into the system that development would then necessarily be stunted and would never grow. By allowing a youth to be able to earn parole would help them to both mature while incarcerated (by giving them hope of release) and would allow them the incentive to reach for maturity.

From the nature of the article it appears that the suspect/parolee is a homeless person. Unfortunately when looking at minor crimes, such as petty theft, etc. it inevitably appears that the alleged person is homeless or has an organic brain disorder, or both. Again, unfortunately, these people have become part of the criminal justice system and instead of finding the help needed, in the form of shelters, rehabilitation, or mental health institutions, they are sent from county jail to the streets, only to commit another dumb petty theft and be sent back to county jail again. DUI's affect everyone. The fact that more women are arrested for DUI's really boils down to there are more women drivers on the road. It really is as simple as that. Unfortunately, everyone, male and female, feel that a drink or two before going home from work, or from a social event will not affect them, that they are "alright" and can make it home. The blood alcohol levels are set at a point that is so low that a person will normally not feel the effects of what they drank. For women, who are smaller on average than men, a single drink can put them over the legal limit. More, when a person drinks a mixed drink, the amount of alcohol can double or triple, dependent on the bartender "pouring heavy" or a drink that will mix multiple alcohols.

Investigators said they arrested Milton Hodges after a crime spree in Osceola County on Wednesday. Deputies said Hodges first tried to rob a Lowes store on Pleasant Hill Road.

This incident reinforces the notion that most of the criminals in our society are criminals because of either an organic brain dysfunction, or is drug related. Unfortunately this person will go to prison for a number of years and his underlying problems will not be addressed.This is the type of person that would most be benefited and thus would benefit society by getting either a treatment program or mental health program.

 

Hiring a good criminal defense attorney well versed in the conditions that lead most people to commit crimes such as these will help a person get the treatment and help he needs so that in the future he will not be a menace to society, but a working productive member.
