FACT SHEET: Immigration Accountability Executive Action

The President’s Immigration Accountability Executive Actions will help secure the border, hold nearly 5 million undocumented immigrants accountable, and ensure that everyone plays by the same rules.  Acting within his legal authority, the President is taking an important step to fix our broken immigration system.

These executive actions crack down on illegal immigration at the border, prioritize deporting felons not families, and require certain undocumented immigrants to pass a criminal background check and pay their fair share of taxes as they register to temporarily stay in the U.S. without fear of deportation.

These are common sense steps, but only Congress can finish the job. As the President acts, he’ll continue to work with Congress on a comprehensive, bipartisan bill—like the one passed by the Senate more than a year ago—that can replace these actions and fix the whole system.

Three critical elements of the President’s executive actions are:

Cracking Down on Illegal Immigration at the Border:  The President’s actions increase the chances that anyone attempting to cross the border illegally will be caught and sent back.  Continuing the surge of resources that effectively reduced the number of unaccompanied children crossing the border illegally this summer, the President’s actions will also centralize border security command-and-control to continue to crack down on illegal immigration.
Deporting Felons, Not Families: The President’s actions focus on the deportation of people who threaten national security and public safety. He has directed immigration enforcement to place anyone suspected of terrorism, violent criminals, gang members, and recent border crossers at the top of the deportation priority list.
Accountability – Criminal Background Checks and Taxes:  ThePresident is also acting to hold accountable those undocumented immigrants who have lived in the US for more than five years and are parents of U.S. citizens or Lawful Permanent Residents.  By registering and passing criminal and national security background checks, millions of undocumented immigrants will start paying their fair share of taxes and temporarily stay in the U.S. without fear of deportation for three years at a time.
The President’s actions will also streamline legal immigration to boost our economy and will promote naturalization for those who qualify.

For more than a half century, every president—Democratic or Republican—has used his legal authority to act on immigration.  President Obama is now taking another commonsense step.  As the Administration implements these executive actions, Congress should finish the job by passing a bill like the bipartisan Senate bill that: continues to strengthen border security by adding 20,000 more Border Patrol agents; cracks down on companies who hire undocumented workers; creates an earned path to citizenship for undocumented immigrants who pay a fine and taxes, pass a background check, learn English and go to the back of the line; and boosts our economy and keeps families together by cutting red tape to simplify our legal immigration process.

CRACKING DOWN ON ILLEGAL IMMIGRATION AT THE BORDER

Under the Obama Administration, the resources that the Department of Homeland Security (DHS) dedicates to security at the Southwest border are at an all-time high.  Today, there are 3,000 additional Border Patrol agents along the Southwest Border and our border fencing, unmanned aircraft surveillance systems, and ground surveillance systems have more than doubled since 2008. Taken as a whole, the additional boots on the ground, technology, and resources provided in the last six years represent the most serious and sustained effort to secure our border in our Nation’s history, cutting illegal border crossings by more than half.

And this effort is producing results. From 1990 to 2007, the population of undocumented individuals in the United States grew from 3.5 million to 11 million people.  Since then, the size of the undocumented population has stopped growing for the first time in decades. Border apprehensions—a key indicator of border security— are at their lowest level since the 1970s.  This past summer, the President and the entire Administration responded to the influx of unaccompanied children with an aggressive, coordinated Federal response focused on heightened deterrence, enhanced enforcement, stronger foreign cooperation, and greater capacity for Federal agencies to ensure that our border remains secure.  As a result, the number of unaccompanied children attempting to cross the Southwest border has declined precipitously, and the Administration continues to focus its resources to prevent a similar situation from developing in the future.

To build on these efforts and to ensure that our limited enforcement resources are used effectively, the President has announced the following actions:

Shifting resources to the border and recent border crossers. Over the summer, DHS sent hundreds of Border Patrol agents and U.S. Immigration and Customs Enforcement (ICE) personnel to the Southwest border, and the Department of Justice (DOJ) reordered dockets in immigration courts to prioritize removal cases of recent border crossers.  This continued focus will help keep our borders safe and secure.  In addition, Secretary Johnson is announcing a new Southern Border and Approaches Campaign Plan which will strengthen the efforts of the agencies who work to keep our border secure.  And by establishing clearer priorities for interior enforcement, DHS is increasing the likelihood that people attempting to cross the border illegally will be apprehended and sent back.
Streamlining the immigration court process. DOJ is announcing a package of immigration court reforms that will address the backlog of pending cases by working with DHS to more quickly adjudicate cases of individuals who meet new DHS-wide enforcement priorities and close cases of individuals who are low priorities. DOJ will also pursue regulations that adopt best practices for court systems to use limited court hearing time as efficiently as possible.
Protecting victims of crime and human trafficking as well as workers.  The Department of Labor (DOL) is expanding and strengthening immigration options for victims of crimes (U visas) and trafficking (T visas) who cooperate in government investigations.  An interagency working group will also explore ways to ensure that workers can avail themselves of their labor and employment rights without fear of retaliation.


DEPORTING FELONS, NOT FAMILIES

By setting priorities and focusing its enforcement resources, the Obama Administration has already increased the removal of criminals by more than 80%.  These actions build on that strong record by:

Focusing on the removal of national security, border security, and public safety threats.  To better focus on the priorities that matter, Secretary Johnson is issuing a new DHS-wide memorandum that makes clear that the government’s enforcement activity should be focused on national security threats, serious criminals, and recent border crossers.  DHS will direct all of its enforcement resources at pursuing these highest priorities for removal.
Implementing a new Priority Enforcement Program. Effectively identifying and removing criminals in state and local jails is a critical goal but it must be done in a way that sustains the community’s trust.  To address concerns from Governors, Mayors, law enforcement and community leaders which have undermined cooperation with DHS, Secretary Johnson is replacing the existing Secure Communities program with a new Priority Enforcement Program (PEP) to remove those convicted of criminal offenses.  DHS will continue to rely on biometric data to verify individuals who are enforcement priorities, and they will also work with DOJ’s Bureau of Prisons to identify and remove federal criminals serving time as soon as possible.
ACCOUNTABILITY – CRIMINAL BACKGROUND CHECKS AND TAXES

Every Democratic and Republican president since Dwight Eisenhower has taken executive action on immigration.  Consistent with this long history, DHS will expand the existing Deferred Action for Childhood Arrivals (DACA) program to include more immigrants who came to the U.S. as children.  DHS will also create a new deferred action program for people who are parents of U.S. Citizens or Lawful Permanent Residents (LPRs) and have lived in the United States for five years or longer if they register, pass a background check and pay taxes.

The President is taking the following actions to hold accountable certain undocumented immigrants:

Creating a mechanism that requires certain undocumented immigrants to pass a background check to make sure that they start paying their fair share in taxes. In order to promote public safety, DHS is establishing a new deferred action program for parents of U.S. Citizens or LPRs who are not enforcement priorities and have been in the country for more than 5 years.  Individuals will have the opportunity to request temporary relief from deportation and work authorization for three years at a time if they come forward and register, submit biometric data, pass background checks, pay fees, and show that their child was born before the date of this announcement.  By providing individuals with an opportunity to come out of the shadows and work legally, we will also help crack down on companies who hired undocumented workers, which undermines the wages of all workers, and ensure that individuals are playing by the rules and paying their fair share of taxes.
Expanding DACA to cover additional DREAMers. Under the initial DACA program, young people who had been in the U.S. for at least five years, came as children, and met specific education and public safety criteria were eligible for temporary relief from deportation so long as they were born after 1981 and entered the country before June 15, 2007.  DHS is expanding DACA so that individuals who were brought to this country as children can apply if they entered before January 1, 2010, regardless of how old they are today.  Going forward, DACA relief will also be granted for three years.
The President’s actions will also streamline legal immigration to boost our economy and promote naturalization by:

Providing portable work authorization for high-skilled workers awaiting LPR status and their spouses.  Under the current system, employees with approved LPR applications often wait many years for their visa to become available.  DHS will make regulatory changes to allow these workers to move or change jobs more easily.  DHS is finalizing new rules to give certain H-1B spouses employment authorization as long as the H-1B spouse has an approved LPR application.
Enhancing options for foreign entrepreneurs.  DHS will expand immigration options for foreign entrepreneurs who meet certain criteria for creating jobs, attracting investment, and generating revenue in the U.S., to ensure that our system encourages them to grow our economy.  The criteria will include income thresholds so that these individuals are not eligible for certain public benefits like welfare or tax credits under the Affordable Care Act.
Strengthening and extending on-the-job training for STEM graduates of U.S universities. In order to strengthen educational experiences of foreign students studying science, technology, engineering, and mathematics (STEM) at U.S. universities, DHS will propose changes to expand and extend the use of the existing Optional Practical Training (OPT) program and require stronger ties between OPT students and their colleges and universities following graduation.
Streamlining the process for foreign workers and their employers, while protecting American workers. DHS will clarify its guidance on temporary L-1 visas for foreign workers who transfer from a company’s foreign office to its U.S. office. DOL will take regulatory action to modernize the labor market test that is required of employers that sponsor foreign workers for immigrant visas while ensuring that American workers are protected.
Reducing family separation for those waiting to obtain LPR status.Due to barriers in our system, U.S. citizens and LPRs are often separated for years from their immediate relatives, while they wait to obtain their LPR status. To reduce the time these individuals are separated, DHS will expand an existing program that allows certain individuals to apply for a provisional waiver for certain violations before departing the United States to attend visa interviews.
Ensuring that individuals with lawful status can travel to their countries of origin. DHS will clarify its guidance to provide greater assurance to individuals with a pending LPR application or certain temporary status permission to travel abroad with advance permission (“parole”).
Issuing a Presidential Memorandum on visa modernization. There are many ways in which our legal immigration system can be modernized to reduce government costs, eliminate redundant systems, reduce burdens on employers and families, and eliminate fraud. The President is issuing a Memorandum directing an interagency group to recommend areas for improvement.
Creating a White House Task Force on New Americans. The President is creating a White House Task Force on New Americans to create a federal strategy on immigrant integration.
Promoting Citizenship Public Awareness: DHS will launch a comprehensive citizenship awareness media campaign in the 10 states that are home to 75 percent of the overall LPR population. USCIS will also expand options for paying naturalization fees and explore additional measures to expand accessibility, including studying potential partial fee waiver for qualified individuals.
Ensuring U.S. Citizens Can Serve: To further our military’s needs and support recruitment efforts, DHS will expand an existing policy to provide relief to spouses and children of U.S. citizens seeking to enlist in the military, consistent with a request made by the Department of Defense.

All sounds very charitable but we are over $17T in debt and can't afford to take in the worlds population of poor, etc. We have to take care of our own...with over 48K on food stamps, unemployment and underemployment over 17% for some age groups. We must stop this abuse of power and defend our Constitution and US sovereignty before we are no longer a nation of laws and no longer a country!! Support LEGAL immigration and enforce the current laws while securing our borders now!!

Dear Democrat:

 

From time to time, I have actually met a Democrat. Judging from many election results, you would think I would run into them everywhere. It’s like they come out of nowhere when it’s time to vote.

I have to admit I am having a real hard time understanding how you think much of the time. Some of you have not only voted once for Obama; you did it twice. Now I can understand the first time, but I certainly cannot understand why anyone would have voted for him the second time. I keep expecting to hear any day now that he is resigning from office, admitting he doesn’t really know what he is doing. Then, I think, what if he does know? And I get really scared.

Take this budget/debt crisis we have now.

We are already 17 trillion dollars in debt. Does anybody see a problem here? Do you really want to keep borrowing and printing money forever? Is there some dollar amount when you will say “That is enough. We really need to stop borrowing any more money”? 20 trillion? 30 trillion?

And I’m thinking, what are they thinking?

 

Is it because they can? I keep wishing that someday, I will make enough money that I don’t have to scrimp and save to make my property tax payments, or I can just write a check when the time comes without blinking an eye. I think that happened a few times.

I am guessing that when they got to Washington or Springfield, they were told that being a Congressman or a Senator is almost like being a little king or queen. People are going to be coming to them bringing gifts seeking their favor. They will have the power to grant wishes; and while they won’t be able to keep all the money they control, they will be able to spend it like there is no tomorrow. And they will be able to make a lot of money much easier than out in the real world.

I admit that can be a real heady experience.

Democrats pride themselves on being compassionate and diverse. And Republicans are criticized by them as focused on just one demographic group, which is true; but it’s just not the one the Democrats think it is.

The Republicans have tried to see our nation as one people, not different people competing for the same small shares of the pie, but an ever-expanding pie as individuals are free to pursue their dreams. They try to see us all as Americans, not Hispanics, blacks, Muslims, gays, or women.

Republicans are well aware that millions of people have come to our country to start a new life, and the way they did it was by becoming Americans. Furthermore, the way for them to succeed was to assimilate into the American identity. It was very easy for these new immigrants to start their own businesses and to work their way up to a middle class or better existence.

Our country achieved a level of productivity, wealth, education, and success unparalleled anywhere else in the world. And they did it without a massive government trying to solve every problem. In fact, it is this same massive government that makes it so hard for people to start their own businesses, which is the biggest impediment to a booming economy.

The Bill of Rights that laid the ground rules for our country laid out in principle the main things that we were free to do and everything that the government could not do to us.

The Democrats changed the idea of a right into something that people are owed, something that the government has to do for them, which essentially involves taking money from somebody else to give to those who now have a right to something for some reason.

It does make you wonder since all the signs and barricades were up the next day or same day....this is likely what the DEMs and Obama wants in order to bring down our economy once and for all....this video says the NYT is accusing GOP of planning the shut down in advance.....but I think it was the DEMs since they are the ones who control 2/3rds of the Federal Govt and the Obama admin is the one picking and choosing what to shut down. The narrator concludes the plan was organized and funded by DEM sources long before and that the GOP doesn't have the ability to organize the shut down, despite the media blaming the Koch brothers, but Obama controls the executive branch and has the ability to choose what gets shut down!.

Patty Konietzky thought the small purple lesion on her husband's ankle was a spider bite. But when the lesion quickly spread across his body like a constellation, she knew something wasn't right.

After a trip to the hospital and a day and a half later, Konietzky's 59-year-old husband was dead.

The diagnosis: vibrio vulnificus, an infection caused by a bacteria found in warm salt water. It's in the same family of bacterium that causes cholera. So far this year, 31 people across Florida have been infected by the severe strain of vibrio, and 10 have died.

"I thought the doctors would treat him with antibiotics and we'd go home," said Konietzky, who lives in Palm Coast, Fla. "Never in a million years it crossed my mind that this is where I'd be today."

State health officials say there are two ways to contract the disease: by eating raw, tainted shellfish -- usually oysters -- or when an open wound comes in contact with bacteria in warm seawater.

While this could potentially concern officials in a state with hundreds of miles of coastline and an economy dependent on tourism, experts say it's nothing that most people should worry about. Vibrio bacteria exist normally in salt water and generally only affect people with compromised immune systems, they say. Symptoms include vomiting, diarrhea and abdominal pain. If the bacteria get into the bloodstream, they provoke symptoms including fever and chills, decreased blood pressure and blistering skin wounds.

I've heard reports of this before and haven't confirmed it to be true yet but I wouldn't doubt it. Obamacare is about power and control of our health and economy, not reducing costs or providing quality care.

This article which I rescooped  talk  about how Obamacare is not as affordable to how it was portrayed to be. I believe this an interesting point of view of this problem because this is part of the reason our government is a mess right now. Hopefully Obamacare is as affordable as it was said to be because our economy is already bad as it is.

UPDATE: According to the FBI, Alexis did not use an AR-15 semi-automatic rifle but instead used a shotgun and two handguns. The shotgun was purchased legally in Virginia and then brought illegally into Washington D.C. It is still believed Alexis stole the handguns off of police officers at the scene. 

According to NBC Washington, Aaron Alexis, the man who carried out a deadly rampage at Washington D.C.'s Navy Yard yesterday, purchased a shotgun legally and passed a background check through the FBI NICS system. The other firearms Alexis used in the shooting a semi-automatic rifle and a were two 9mm semi-automatic handguns and were stolen after he made it onto the base. 

Surveillance video shows the gunman entered the NAVSEA building, at 1336 Isaac Hull Ave., with a shotgun, law enforcement officials told News4's Jackie Bensen.

He shot a security officer in the head, killing him, and took his 9 mm pistol and a magazine of ammunition. The shooter then continued through the building and seemed to target his victims, who were mostly on the third and fourth floors, Bensen reported.

D.C.’s Metropolitan Police Department and several other law enforcement agencies responded with active shooter teams.

During that response, a MPD officer was shot in the leg. The gunman was then shot by a FBI hostage response team, law enforcement sources told Bensen.

According to what witnesses are telling investigators, by the time the shootings ended, the gunman was seen with a semiautomatic 9 mm pistol and an AR-15 assault rifle. Authorities are investigating whether the gunman took the D.C. police officers’ rifle.
NBC national reported a similar story, but notes authorities say Alexis may have taken the guns from an on base safe. If true, someone left that safe open. 

The officials also said Alexis obtained the assault rifle used in the shooting from a gun safe on the naval base. There’s where he may have also obtained a handgun, according to authorities.

Conclusion more laws won't stop a crazed killer, that's why they break laws. Murder is against the law but people still do it...

The Chinese government has revealed for the first time that it has nuclear submarines capable of attacking cities throughout the United States.

Last week, state-run Chinese news agencies – such as China Central TV, the People’s Daily, the Global Times, the PLA Daily, the China Youth Daily and the Guangmin Daily – ran identical reports about the ‘awesomeness’ of the People’s Liberation Army’s submarine force.

‘This is the first time in 42 years since the establishment of our navy’s strategic submarine force that we reveal on such a large scale the secrets of our first-generation underwater nuclear force,’ the Global Times said in a lengthy article titled ‘China for the First Time Possesses Effective Underwater Nuclear Deterrence against the United States.’

Chinese news agencies also reported on the Army’s lethal intentions should it ever use the nuclear weapons the submarines are capable of launching.

‘Because the Midwest states of the U.S. are sparsely populated, in order to increase the lethality, [our] nuclear attacks should mainly target the key cities on the West Coast of the United States, such as Seattle, Los Angeles, San Francisco and San Diego,’ the Global Times said. ‘The 12 JL-2 nuclear warheads carried by one single Type 094 SSBN can kill and wound 5 million to 12 million Americans.

But West Coast cities aren’t the only metropolitan areas in the U.S. that face the threat of a nuclear attack from the Chinese, according to the country’s state-run media.

The western half of the United States particularly western cities of Seattle, Los Angeles, San Francisco and San Diego are at greatest risk should the Chinese military choose to strike nuclear underwater warfare.  The Chinese government has developed nuclear submarines that are capable of attacking the United States particularly the west coast but not limited to just the west coast metropolitan cities.  Denver, Colorado is in the west and could also be a target in my opinion.   These nuclear warheads can kill and wound 5-12 million Americans should they be launched.  This is incredibly alarming and disturbing to me.  According to the Chinese media, this is the first time China has possessed "effective underwater nucler detterrence against the United States".  The Chinese government in my opinion seem to have it out for our country and cannot be trusted.

Thanks to implementation of Obamacare , a rise in single parent families and less quality education more and more graduates do not have the skills to hold a full time job and many jobs available are only part-time. 

In addition, 15% between 16-24 have no job and don't go to school....those who are in school do less because they have less. The American Dream is becoming more and more difficult to obtain...in the meantime the Obama admin wants to implement immigration reform and add more unemploye and under skilled workers to the system.

Students aren't learning what they need to find good jobs and the rise in single parent families is leading to increased poverty.

 

The report concludes that the best way to stop this decline is to improve the economy and create more jobs but Obamacare is leading to more uncertainty and more companies are hiring less people or shifting them to part-time jobs.

BERLIN, Sept 18 (Reuters) - Germany exported 111 tonnes of chemicals to Syria between 2002 and 2006 that could be used in the production of sarin gas, according to a government document published on Wednesday.


But the government rejected a suggestion from an opposition lawmaker that Germany might thereby have inadvertently contributed to the Aug. 21 sarin attack in Syria, which the West blames on President Bashar al-Assad.

The chemicals - sodium fluoride, hydrofluoric acid and ammonium hydrogen fluoride - are classified as "dual use" under European Union law, meaning they can be used for either civil or military purposes. They require special export permits.

In a written response to a parliamentary question from Germany's Left Party, the economy ministry said the chemicals sold between 2002 and 2003, in 2005 and 2006 had a total value of 174,000 euros ($232,300) and were sold for civilian use.

"Permits were granted after careful consideration of all possible risks, including of the goods' misuse or transfer into chemical weapons use. In all cases their planned civil use was considered to be plausible," the ministry stated.

"The German government has no information to suggest that the delivered goods were later used for purposes other than the originally declared civilian purpose," it added.

Chancellor Angela Merkel told ARD television: "We are of course looking into all allegations on this but from what we can see so far the export licence was for civil use."

In addition to the UK, it looks like Germany sent dual use chemicals to Syria that could have been used in making chemical weapons. The UN report released on Monday continues to offer little concrete evidence that proves Assad used the chemical weapons against it's own people. Russia is planning to present evidence the rebels were behind the attacks.

Damascus and key ally Moscow joined forces on Wednesday in a bid to thwart plans for a Western-backed UN resolution on Syria's chemical weapons that allows the use of force.

The United States, meanwhile, said it will maintain the threat of force in case Syria's regime fails to abide by an agreement to relinquish control of its chemical weapons.

Russia came out swinging, saying Damascus had handed over new evidence implicating the rebels in an August 21 sarin gas attack near the capital that killed hundreds, while slamming a UN report into the incident as "biased."

Syrian President Bashar al-Assad, boosted by a visit to Damascus by Russian Deputy Foreign Minister Sergei Ryabkov, thanked Moscow for its support throughout his regime's 30-month-old conflict with armed rebels.

"President Assad expressed... his gratitude to Russia for its position of helping Syria face down the savage attack... and the Western, regional and Arab-backed terrorism," state television quoted him as saying after meeting Ryabkov.

"Russia's positions on the Syrian crisis create hope of a new global balance," Assad added.

His comments came as UN chemical weapons inspectors confirmed they would be returning to Syria for additional investigations into the use of the deadly weapons in the conflict.

Russia and the United States continued to trade accusations about who was to blame for the sarin attack that the chemical weapons inspectors confirmed in a report this week.

Despite having jointly agreed a deal under which Syria will turn over its chemical weapons stock, the two nations remain at loggerheads over who launched the attack.

The US military will maintain the threat of force against Syria, US Defence Secretary Chuck Hagel said Wednesday.

"We should keep that military option exactly where it is. We have assured the president that our assets and force posture remain the same," he told a news conference.

Russia said the Syrian regime had handed over new evidence implicating the rebels in the deadly incident and that this would be handed over to the United Nations.

Moscow will review the new materials and "of course, present them in the UN Security Council," Russian news agencies quoted Foreign Minister Sergei Lavrov as saying.

But US President Barack Obama has said it was "inconceivable" that anyone other than the Syrian regime could have carried out the attack.

The international community is also divided over the wording of a UN Security Council resolution on the US-Russia deal, with Moscow strongly opposing a Chapter VII resolution.

Syria's deputy foreign minister, Faisal Muqdad, told AFP on Wednesday that Damascus was confident the UN would not adopt a Chapter VII resolution.

"I think this is a big lie used by the Western powers; we believe it will never be used," he said in Damascus.

 

 

France and Britain are reportedly preparing a draft resolution including a demand for action under Chapter VII -- which allows the use of force and tough sanctions -- if Syria fails to uphold the deal on its chemical weapons.

But Russia has said there was "no basis" for a UN resolution to invoke Chapter VII.

Nick Brown, editor of the specialised IHS Jane's Defence Equipment and Technology Centre, said the UN report did not conclusively point any finger of blame.

"I have not personally seen any compelling data that proves beyond doubt who the weapons were used by," he said in an analysis to clients.

"The exact forensic detail of who prepared and then triggered the weapons remains unclear...

"The extremely fluid nature of the conflict in Syria makes it extraordinarily difficult to comment on the origin of weapons use in absolute terms," Brown wrote.

Ryabkov said on Tuesday that Syria had handed over new evidence showing opposition forces were behind the sarin attack.

He also said Russia was disappointed with the UN inspectors' report on the attack, describing it as selective for having ignored other alleged attacks.

"Without a full picture... we cannot describe the character of the conclusions as anything other than politicised, biased and one-sided," Russian news agency RIA Novosti quoted him as saying.

France rejected the claims of bias, saying "nobody can question of the objectivity of the people appointed by the UN."

UN chief inspector Ake Sellstrom, meanwhile, told AFP that his team would return to Syria to investigate additional alleged attacks.

Suspect In Navy Yard Attack Previously Arrested In Seattle For “Anger-Fueled” Shooting

Aaron Alexis, the man identified by Washington D.C. police as a suspect in this morning’s tragic attack on a US Navy Yard, was previously arrested by Seattle police in 2004 for shooting out the tires of another man’s vehicle in what Alexis later described to detectives as an anger-fueled “blackout.”

Because Seattle police have received numerous inquiries about the incident, we are posting the details, detective logs, and the original report for the May 6, 2004 case.

At about 8 am that morning, two construction workers had parked their 1986 Honda Accord in the driveway of their worksite, next to a home where Alexis was staying in the Beacon Hill neighborhood.

The victims reported seeing a man, later identified by police as Alexis, walk out of the home next to their worksite, pull a gun from his waistband and fire three shots into the two rear tires of their Honda before he walked slowly back to his home north of the construction site.

Officers responded to the scene but were unable to locate Alexis, and no one answered the door at his home.

When detectives interviewed workers and a manager at the construction site, they told police Alexis had “stared” at construction workers at the job site every day over the last month prior to the shooting. The owner of the construction business told police he believed Alexis was angry over the parking situation around the work site.

Detective notes from the incident indicate they made several attempts to contact Alexis by phone and at his work, but eventually found and arrested him outside of his home on June 3rd.

Police then obtained permission to search the home, found a gun and ammunition in Alexis’ room, and booked him into the King County Jail for malicious mischief.

Following his arrest, Alexis told detectives he perceived he had been “mocked” by construction workers the morning of the incident and said they had “disrespected him.” Alexis also claimed he had an anger-fueled “blackout,” and could not remember firing his gun at the victims’ vehicle until an hour after the incident.

Alexis also told police he was present during “the tragic events of September 11, 2001″ and described “how those events had disturbed him.”

Detectives later spoke with Alexis’ father, who lived in New York at the time, who told police Alexis had anger management problems associated with PTSD, and that Alexis had been an active participant in rescue attempts on September 11th, 2001.

http://RevolutionNews.US ~ Homeland InSecurity Secretary Janet Napolitano said Friday that the Obama administration will push for immigration reform by giving the estimated 14 million people who are in the United States illegally fair pathway to earned legal status.

A tough and fair pathway to earned legal status will mandate that illegal immigrants meet a number of requirements—including registering, paying a fine, passing a criminal background check, fully paying all taxes and learning English, Napolitano said Friday at a panel discussion at the liberal Center for American Progress in Washington, D.C.

These are substantial requirements that will make sure this population gets right with the law, Napolitano said. It will help fix our broken system.

Napolitano said the Obama administration is working to end the recession and put Americans back to work but said giving legal status to illegal aliens will strengthen our economy.

Requiring illegal immigrants to register to earn legal status, as I discussed earlier, will strengthen our economy as these immigrants become full-paying taxpayers, Napolitano said. As labor leaders have made clear to me, immigration reform will be a boon to American workers.

Think about it: unions will never achieve the best terms for workers when a large part of the workforce is illegal and operates in a shadow economy, Napolitano said. By contrast, the status quo not only hurts American workers, it also stifles potential opportunities to grow our economy.

Napolitano said that she has seen a major shift in the immigration landscape, which the Obama administration hopes will make it easier for Congress to pass new immigration laws.

Included in that shift, Napolitano said, is a more secure border between the United States and Mexico, tougher law enforcement that has resulted in more arrests of criminal illegal immigrants and confiscation of contraband, and fewer people coming into the country illegally because of current economic conditions.

For starters, the security of the Southwest border has been transformed from where it was in 2007, Napolitano said. The federal government has dedicated unprecedented resources to the Mexican border in terms of manpower, technology and infrastructure—and its made a real difference.

Compared to last year, seizures in all categories—drugs, smuggled cash, and illegal weapons—are up dramatically. For example, just looking at bulk cash, Customs and Border Protection has seized at the border more than $34 million in cash being smuggled southbound so far this year—more than four times as much as at this time last year.

Moreover, the immigration debate in 2007 happened during a period of historically high levels of illegal entry into the United States. Two years later, because of better enforcement and the current economic circumstances, those numbers have fallen sharply. The flow has reduced significantly by more than half from the busiest years, proving we are in a much different environment than we were before.

These are major differences that should change the immigration conversation, Napolitano said.

The secretary said the Obama administration is committed to this issue.

When Congress is ready to act, we will be ready to support them, Napolitano said.

Feds Buy Up Hotel Rooms for Influx of Illegal Immigrants (Video)
Your tax dollars at work…
Federal agencies are renting hotel rooms for the undocumented families. Other families are being released across the US.
The Obama Administration has been housing illegal immigrants in hotels for years.

Great....is this the direction Eric Holder is going with releasing "non-violent" drug dealers/offenders from prison next?? How is this going to keep America safe?? Why should the US be paying to give illegal immigrants hotel rooms when they should be deported!!??

This video talks about mandatory minimum sentencing laws and three strikes laws too and talks about how it has lead to an increase in overcroweded prisons, but if we release these people, they will eventually recommit the crime and will eventually become a bigger criminal/drugpin. 

Street drug dealers start out small and eventually work their way up to becoming drug kingpings. Why should we release these criminals onto our streets when they are bound to endanger others and eventually committ bigger crimes??  All they are doing is enocouraging more illegal behavior. Not enforcing our border laws has led to a rise in illegal immigrants. Therefore releasing prisoners for "non-violent" drug offenses is going to lead to a rise in more drug offenders who will eventually become bigger criminals. Just like the legalization of abortion led to more abortions and they are still unsafe! 

 

If we are to be a civil and moral society it is time to enforce our laws and live up to the standards of a moral society. One that values life and liberty without endangering the lives of others!

As the so-called “war on drugs” enters its fifth decade, we need to ask whether it, and the approaches that comprise it, have been truly effective – and build on the Administration’s efforts, led by the Office of National Drug Control Policy, to usher in a new approach.  And with an outsized, unnecessarily large prison population, we need to ensure that incarceration is used to punish, deter, and rehabilitate – not merely to warehouse and forget.

Today, a vicious cycle of poverty, criminality, and incarceration traps too many Americans and weakens too many communities.  And many aspects of our criminal justice system may actually exacerbate these problems, rather than alleviate them.

It’s clear – as we come together today – that too many Americans go to too many prisons for far too long, and for no truly good law enforcement reason.  It’s clear, at a basic level, that 20th-century criminal justice solutions are not adequate to overcome our 21st-century challenges.  And it is well past time to implement common sense changes that will foster safer communities from coast to coast.

These are issues the President and I have been talking about for as long as I’ve known him – issues he’s felt strongly about ever since his days as a community organizer on the South Side of Chicago.  He’s worked hard over the years to protect our communities, to keep violent criminals off our streets, and to make sure those who break the law are held accountable.  And he’s also made it part of his mission to reduce the disparities in our criminal justice system.  In Illinois, he passed legislation that addressed racial profiling and trained police departments on how they could avoid racial bias.  And in 2010, this Administration successfully advocated for the reduction of the unjust 100-to-1 sentencing disparity between crack and powder cocaine.

That’s the balance the President and I have tried to strike – because it’s important to safeguard our communities and stay true to our values.  And we’ve made progress.  But as you heard the President say a few weeks ago when he spoke about theTrayvon Martin case, he also believes – as I do – that our work is far from finished.

And, through the Department’s Civil Rights Division and other components, we’ll continue to work with allies – like the Department of Education and others throughout the federal government and beyond – to confront the “school-to-prison pipeline” and those zero-tolerance school discipline policies that do not promote safety, and that transform too many educational institutions from doorways of opportunity into gateways to the criminal justice system.  A minor school disciplinary offense should put a student in the principal’s office and not a police precinct.

More broadly, through the Department’s Access to Justice Initiative, the Civil Rights Division, and a range of grant programs, this Administration is bringing stakeholders together – and providing direct support – to address the inequalities that unfold every day in America’s courtrooms, and to fulfill the Supreme Court’s historic decision in Gideon v. Wainwright.  Fifty years ago last March, this landmark ruling affirmed that every defendant charged with a serious crime has the right to an attorney, even if he or she cannot afford one.  Yet America’s indigent defense systems continue to exist in a state of crisis, and the promise of Gideon is not being met. To address this crisis, Congress must not only end the forced budget cuts that have decimated public defenders nationwide – they must expand existing indigent defense programs, provide access to counsel for more juvenile defendants, and increase funding for federal public defender offices.  And every legal professional, every member of this audience, must answer the ABA’s call to contribute to this cause through pro bono service – and help realize the promise of equal justice for all.

As we come together this morning, this same promise must lead us all to acknowledge that – although incarceration has a significant role to play in our justice system – widespread incarceration at the federal, state, and local levels is both ineffective and unsustainable.  It imposes a significant economic burden – totaling $80 billion in 2010 alone – and it comes with human and moral costs that are impossible to calculate.

As a nation, we are coldly efficient in our incarceration efforts.  While the entire U.S. population has increased by about a third since 1980, the federal prison population has grown at an astonishing rate – by almost 800 percent.  It’s still growing – despite the fact that federal prisons are operating at nearly 40 percent above capacity.  Even though this country comprises just 5 percent of the world’s population, we incarcerate almost a quarter of the world’s prisoners.  More than 219,000 federal inmates are currently behind bars.  Almost half of them are serving time for drug-related crimes, and many have substance use disorders.  Nine to 10 million more people cycle through America’s local jails each year.  And roughly 40 percent of former federal prisoners – and more than 60 percent of former state prisoners – are rearrested or have their supervision revoked within three years after their release, at great cost to American taxpayers and often for technical or minor violations of the terms of their release.

As a society, we pay much too high a price whenever our system fails to deliver outcomes that deter and punish crime, keep us safe, and ensure that those who have paid their debts have the chance to become productive citizens.  Right now, unwarranted disparities are far too common.  As President Obama said last month, it’s time to ask tough questions about how we can strengthen our communities, support young people, and address the fact that young black and Latino men are disproportionately likely to become involved in our criminal justice system – as victims as well as perpetrators.

We also must confront the reality that – once they’re in that system – people of color often face harsher punishments than their peers.  One deeply troubling report, released in February, indicates that – in recent years – black male offenders have received sentences nearly 20 percent longer than those imposed on white males convicted of similar crimes.  This isn’t just unacceptable – it is shameful.  It’s unworthy of our great country, and our great legal tradition.  And in response, I have today directed a group of U.S. Attorneys to examine sentencing disparities, and to develop recommendations on how we can address them.

 

 

We will start by fundamentally rethinking the notion of mandatory minimum sentences for drug-related crimes.  Some statutes that mandate inflexible sentences – regardless of the individual conduct at issue in a particular case – reduce the discretion available to prosecutors, judges, and juries.  Because they oftentimes generate unfairly long sentences, they breed disrespect for the system.  When applied indiscriminately, they do not serve public safety.  They – and some of the enforcement priorities we have set – have had a destabilizing effect on particular communities, largely poor and of color.  And, applied inappropriately, they are ultimately counterproductive.

This is why I have today mandated a modification of the Justice Department’s charging policies so that certain low-level, nonviolent drug offenders who have no ties to large-scale organizations, gangs, or cartels will no longer be charged with offenses that impose draconian mandatory minimum sentences.  They now will be charged with offenses for which the accompanying sentences are better suited to their individual conduct, rather than excessive prison terms more appropriate for violent criminals or drug kingpins.  By reserving the most severe penalties for serious, high-level, or violent drug traffickers, we can better promote public safety, deterrence, and rehabilitation – while making our expenditures smarter and more productive.  We’ve seen that this approach has bipartisan support in Congress – where a number of leaders, including Senators Dick Durbin, Patrick Leahy, Mike Lee, and Rand Paulhave introduced what I think is promising legislation aimed at giving federal judges more discretion in applying mandatory minimums to certain drug offenders.  Such legislation will ultimately save our country billions of dollars while keeping us safe.  And the President and I look forward to working with members of both parties to refine and advance these proposals.

Secondly, the Department has now updated its framework for considering compassionate release for inmates facing extraordinary or compelling circumstances – and who pose no threat to the public.  In late April, the Bureau of Prisons expanded the criteria which will be considered for inmates seeking compassionate release for medical reasons.  Today, I can announce additional expansions to our policy – including revised criteria for elderly inmates who did not commit violent crimes and who have served significant portions of their sentences.  Of course, as our primary responsibility, we must ensure that the American public is protected from anyone who may pose a danger to the community.  But considering the applications of nonviolent offenders – through a careful review process that ultimately allows judges to consider whether release is warranted – is the fair thing to do.  And it is the smart thing to do as well, because it will enable us to use our limited resources to house those who pose the greatest threat.

Finally, my colleagues and I are taking steps to identify and share best practices for enhancing the use of diversion programs – such as drug treatment and community service initiatives – that can serve as effective alternatives to incarceration.

95% of all prosecutions are done at state and local level, not requiring the Federal govts oversight according to state prosecutors; Holder is claiming that there are mandatory sentences being enforced too often against non-violent criminals and that their are disparities against those of minority races. However, it is not reflected in state and local courts the way that Holder claims. Holder's saying to ignore the amount of drugs found but on the level of the crime, was it a guy on a street corner or in his home or was the seller linked to a large criminal network.

I'm sure I could come up with more than 30 but I only need one...he's anti-American and his policies have proven that. Nothing he has done has helped Americans, the economy, our foreign policy and credibility in the world or strengthen our country. He is an absolute disaster!

 

He has waged economic jihad against our country and is in the process of destroying our military as well as national security by cowering and weakening our presence in the world.

This is Obama's America....he is doing nothing to fix the economy but once again making empty promises and speeches to distract people from all the scandals he calls phony, including the death of four Americans in Benghazi and 16 Navy SEALs in Afghanistan in 2011, along with 22 other special op forces who were left to die on Extortion 17. 

 

His last days in office can't come soon enough!

What a bunch of pathetic, useless people.......they can thank Obama for destroying the economy and giving them too much time on their hands to rob people and spend their time protesting on the streets. Unemployment among blacks has risen under Obama and is around 19% if not higher thanks to his failed economic policies, but more are on food stamps, so maybe that's a plus in their minds??
