Obama administration said Thursday it had rearrested and brought back four of the most dangerous immigrants it released from detention last month in the run-up to the budget sequestration.
U.S. Immigration and Customs Enforcement Director John Morton testified to Congress that his agency released 10 “level one” offenders, and has gone out and apprehended four of them. He said the other six are nonviolent.
Mr. Morton also acknowledged that overall, 2,228 immigrants were released — far more than the several hundred the agency had initially acknowledged. Of those, 629 had criminal records, though Mr. Morton said they were low-level offenders.
The releases have drawn a stern rebuke from Republicans, who said it showed mismanaged priorities. They also said ICE’s concession that it released far more immigrants than it first acknowledged dents the agency’s credibility.
“Today’s ICE testimony directly contradicts repeated assurances and explanations peddled by the Obama administration in the days after the mass release of illegal aliens became public knowledge,” said Arizona Gov. Jan Brewer. “The American people were initially told there were hundreds, not thousands, of individuals released. We were assured they were low-level detainees of little public risk. As we now know, neither of these claims was accurate.”
Dozens of members of Congress have written Homeland Security Secretary Janet A. Napolitano and demanded she give more details on the decision-making.
But Mr. Morton said he made the choice on his own without any input from the White House or Ms. Napolitano. Still, he was unable to give many of the exact figures members have demanded to know.
Sen. John Cornyn, Texas Republican and one of those who wrote demanding answers, said Mr. Morton didn’t clear up very much.
“Why was the secretary of Homeland Security not aware of the release of convicted criminals by her own agency? Why did she tell us it was only hundreds who were released when we now learn it was thousands?” he said. “This is evidence of serious mismanagement at DHS under Secretary Napolitano.”
Morton and Incompetano should both be fired or arrested for releasing these criminals without a court order. They are ignoring the rule of law and our justice system, in addition to endangering Americans. I also heard many of these criminal aliens released are high level offenders and undeportable, meaning their country of origin won't take them back because they are high level offenders.
As reported by National Review in January, the Boston Globe ran an article that stated: “US quietly released 8,500 criminals who were supposed to be deported — with deadly consequences.” The State Department takes no meaningful action to pressure foreign countries to take back their own citizens who have committed vicious crimes here. Immigration and Customs Enforcement almost never uses the authority it has to try to hold undeportable criminal aliens beyond the six-month period allowed by the Supreme Court. ICE also seldom tells crime victims or even local police that killers are being released back into the community. And the White House has made no effort whatsoever at getting a legislative fix to give ICE more leeway to hold dangerous criminals until they are deported.
So prior to the sequestration which occurred in March of 2013, ICE was already releasing criminal illegal immigrants in our country back in December 2012 if not before that. Since then they have released at least 2000 more that we know of, not hundreds more that DHS first stated they released in February 2013.
Additionally, National Review reveals "the Obama administration’s lack of interest in immigration enforcement came last month, when an illegal-alien registered sex offender, Luis Abrahan Sanchez Zavaleta, was found to be working as an intern in the office of New Jersey senator Robert Menendez. Bad as that is, the real problem was that, as the AP reported, Homeland Security officials told ICE field agents “several times” not to arrest Sanchez until after the election. On top of that, Sanchez had so little concern that authorities would investigate him that he actually applied for Obama’s unilateral (and illegal) quasi-amnesty for illegal aliens who came to the U.S. before their 16th birthday."
"That quasi-amnesty is yet another example of past performance that indicates future results. Known as Deferred Action for Childhood Arrivals (DACA), this administrative version of the DREAM Act provides a work card and a (legitimate) Social Security number to pretty much any illegal alien under 30. So far, more than 100,000 people have received the amnesty, and the sex offender Sanchez, mentioned above, appears to be the only person whose application has actually been rejected on the merits."
"Finally, this administration is dismantling local partnerships with federal immigration authorities. This isn’t a dispute over congressional intent regarding the scope of local authority in enforcing immigration law, as was the case in the lawsuits against Arizona and other states. Congress created the 287(g) program in 1996 specifically to promote such cooperation, but ICE has just canceled 32 such partnerships, saying that these congressionally created programs were not “appropriate.” On top of that, new rules issued by ICE in apre-Christmas news dump prohibit agents from taking into custody any illegal alien held by local law enforcement whose only offenses involve immigration violations. This is part of the continuing push to make immigration violations a “secondary offense,” like the failure to wear a seat belt is in most states — i.e., you can be punished for immigration violations only if you also violate another, “real” law."
Additionally, the Orlando Sentinel had a 2011 story that explains how illegal immigrants in Florida are not being deported because they are not deportable but DHS won't deport them because of groups like the ACLU and SPLC [Southern Poverty Law Center] who claim it is inhumane.
US Representative and former Florida Deputy, Sandy Adams:
“Adams has also pressed the Obama administration to reduce the number of visas it issues to citizens of countries that don’t accept their people back.”
The people Adams is talking about — mostly criminals released from immigration detention centers after serving jail or prison time for their crimes — totaled a bit fewer than 13,000 during the past three years. By comparison, the U.S. in 2010 deported nearly 400,000 immigrants, about half of them convicted criminals — a rate that ICE called a one-year record.
"These releases are a very small part of what we do," said a senior ICE official not authorized to speak on the record.
According to ICE, about 4,000 — fewer than a third — of those released in the past three years were Cubans, whose government refuses to take them back.
Others are from nations, such as China and India, that require time-consuming investigations before accepting deportees. Once released, all are monitored by either parolelike visits or more-sophisticated tracking such as GPS devices as the U.S. tries to deport them.
Though ICE doesn't keep crime statistics, it has tracked at least two murders since 2008 — the ones Adams cites — and says that anyone convicted of a crime goes back to jail.
One of the solutions Adams supports — an allowance for indefinite detention of immigrant criminals who can't be deported — has drawn the ire of human-rights groups.
As reported on "Just The Facts", Of the 12,871 immigrants released from immigration detention centers from October 2008 to April 2011, about 68 percent had criminal records, according to ICE statistics.
…the most common crimes were drug charges, assault, and driving under the influence.
Apparently these crimes committed in the US are not seen as “serious” crimes. If you are a US citizen killed by a drunk driver – who is an illegal alien with a prior drunk driving arrest, “Oh well” says the Fed.
Meanwhile the Obama administration and some RINOs want to push amnesty on us and tell us only 11 Million illegal immigrants would be given a pathway to citizenship and then they would secure the border, but the fact is according to Bear-Stearns, an estimated illegal alien population of 20 million is the actual number in the US, and this was as of 2005.
However as reported in 2006 “More than a year has passed since those studies were done so we should add another 2 to 3 million to both figures given the continued ‘sieve’ called our southern border. That would make the Pew Study actual count at 13 million, minimum and the Bear Stearns Report count at 22 million, minimum.”
Since 2006, another six years, nearly seven years has passed, so if you consider at least 2 million illegal immigrants come each year, that would make it another 14 million in addition to the 22 Million that were estimated to have entered the US since 2006. That means in reality we have over 30 Million illegal immigrants living in the US, who could potentially gain citizenship and the right to vote, and receive government entitlements which will bankrupt our country even faster than expected.
Lastly, it is estimated that illegal immigrants cost our country far more than it would to deport them and enforce the laws and secure our borders, as real estate prices would drop, companies would be forced to hire American workers and pay slightly higher wages and offer benefits or risk fines or jail time, but our overall cost of living would drop.

Although not explicity stated in the text of the Constitution, in 1890 then to be Justice Louis Brandeis extolled 'a right to be left alone.' This right has developed into a liberty of personal autonomy protected by the 14th amendment. The 1st, 4th, and 5th Amendments also provide some protection of privacy, although in all cases the right is narrowly defined.
