Despite the resounding loss at the Nova Scotia Supreme Court in January, the Nova Scotia Barristers’ Society has decided to appeal.  Justice Campbell ruled that Trinity Western University’s Community Covenant was “not unlawful” .........  In his searing response to the Nova Scotia Barristers’ Society’s action against TWU, Justice Campbell clearly stated that the Charter is not “a blueprint for moral conformity.” . However, it would appear that the NSBS does intend to use the Charter as a blueprint for moral conformity.

Religious Freedom: A Communal Right | CCCC News & Blogs

On March 19, the Supreme Court of Canada released its long-anticipated Loyola decision and came very close to saying that there is a religious freedom right, protected by the Charter, for religious corporations. It was only one vote short. However, the entire seven-member panel of the Court ruled that religious freedom does have “communal aspects.” Three judges were prepared to go all the way to recognize religious freedom rights for a religious corporation, but the other four did not see the need to decide the question of religious corporations in this case. However, this decision is a major step forward in the evolution of religious freedom since the Charter came into effect in 1982.
