LAPIN LAW OFFICES HIGHLIGHTS

In terms of newsworthy cases, Lapin Law Offices was extremely proud of its efforts in representing the Estate of Joyce Meeks in its claims against the State of Nebraska and other defendants. Our representation began in 2013 and concluded in 2014. Lapin Law Offices was co-counsel with Chicago attorney Timothy Cavanagh of Cavanagh Law Group. Jeremy Dobbe killed Joyce Meeks in a vehicle crash in 2013. Mr. Dobbe was driving a Nebraska Department of Corrections van, under the Inmate Van Driver Program, at the time of the fatal crash. This Program permitted inmates to drive a correctional facility-owned vehicle. On June 25, 2013, while Dobbe was driving the vehicle, possibly under the influence of an illegal drug, crashed the van into a vehicle driven by Joyce Meeks at the intersection of Van Dorn and South 18th Streets in Lincoln, Nebraska. Joyce Meeks was married to Leonard Meeks, had three children, and was caring for three of her grandchildren. She died at the scene. Shortly after the crash, Nebraska’s Governor, Dave Heineman, terminated the Inmate Van Driver Program.

As this case involved the State of Nebraska, a claim had to be brought under the Nebraska State Tort Claims Act. The Tort Claim was filed on July 18, 2013. After six months had expired, as required by the Act, a lawsuit was initiated as the State of Nebraska failed to act on the Tort Claim. The parties agreed to mediate the case in an effort to get it resolved. Ultimately, the parties agreed to settle the Tort Claim for $2 million dollars. District Court approval was obtained on April 10, 2014, and Legislative Bill 949, in the 103rd Legislature, was passed on March 24, 2014, and approved by the Governor on March 29, 2014.

None of the popular messaging apps received a perfect score and some received a very low grade. Apple’s FaceTime and iMessage had some of the higher scores among the popular apps. The EFF’s results may be very surprising to some who thought their messages were very secure.

Using the 7 criteria, either a green checkmark or a red "no" symbol was placed on the Scorecard.
Only six apps received all green checkmarks: ChatSecure; CryptoCat; Signal/Redphone; Silent Phone; Silent Text; and TextSecure.
The EFF Scorecard results for some of the more popular messaging apps and tools:
  • Apple FaceTime: 5 green checkmarks
  • Apple iMessage: 5 green checkmarks 
  • Facebook chat: 2 green checkmarks 
  • Google Hangouts: 2 green checkmarks 
  • Skype: 2 green checkmarks 
  • SnapChat: 2 green checkmarks 
  • WhatsApp: 2 green checkmarks 
  • AIM: 1 green checkmark 
  • Kik Messenger: 1 green checkmark 
  • Yahoo! Messenger: 1 green checkmark
These scores may be surprising to some who thought their messages were more secure.

The EFF is quick to point out that the scorecard results “should not be read as endorsements of individual tools or guarantees of their security” and that closer examinations of many of the apps and tools will be conducted later.

OSHA recently announced its preliminary top 10 workplace safety violations for 2014. Unfortunately, these violations remain the same as 2013. This helps show that employers are not doing enough in these areas to protect workers.

 

Nebraska workers injured on the job, including for these types of violations, are entitled to workers’ compensation benefits.

For fiscal year 2013, which runs from October 1, 2012 through September 30, 2013, OSHA’s top 10 violations were:


  1. Fall Protection
  2. Hazard Communication
  3. Scaffolding
  4. Respiratory Protection
  5. Electrical – Wiring Methods
  6. Powered Industrial Trucks
  7. Ladders
  8. Lockout/Tagout
  9. Electrical – General Requirements
  10. Machine Guarding

Both 2013 and 2014 have all of the same workplace safety violations. The top 4 remain the same while some of the other violation’s rankings changed.

Hopefully, employers will examine these rankings and increase worker safety especially in these top 10 areas. Worker safety should be the paramount concern for employers.

The United States Supreme Court have held that a person does have a reasonable expectation of privacy in their public movements. However, no specific rule has been announced as to when law enforcement surveillance violates this right.

Last weekend's winter storm posed a challenge to many Lincoln, Nebraska, drivers with at least a 151 crashes and one fatality as of February 2, 2015. The actual number of crashes is likely a lot more. More snow is predicted for Lincoln this evening and tomorrow with a lot of roadways still ice and snow covered.

 

Drivers are urged to stay home if possible. If you have to drive, do so very carefully and safely.

A recent article in Consumer Affairs by Mark Huffman, "Why you might fall for a phishing scam" describes some of the problems there are in trying to warn people about phishing scams:

Information is power and, when it comes to the criminal underground, it might as well be gold. Scammers who pick up chunks of information about you can quickly pick your pocket.


An effective phishing scam almost always involves trickery and deception. A message in your email inbox is not what it first appears. ...


The challenge, then, is to find a way to identify these bogus pitches/threats and warn consumers before they make a costly error in judgment.

Two professors at the University of Alabama in Huntsville are studying phishing scams to determine the best way to help protect people from them:

The researchers say your response to a [phishing scam] warning is based on the strength of the authority issuing it. In addition, you have to understand it, remember it, change your attitude and be motivated enough to change your behavior. ...

Soon, California will make businesses civilly liable, up to $10,000, for limiting consumers from making negative reviews. California is the first state to prevent businesses from including non-disparagement in their contracts or otherwise prevent consumers from criticizing a business. However, there are questions that the statute does not answer about what a business can do about false reviews.

Court rejects free speech arguments of a child pornography conviction for sending a “morphed” image, which had a minor’s face superimposed over that of the female. The Man argued that the image, as it did not actually involve children engaged in sex, was not pornography and was protected by the First Amendment. Court said government had a compelling interest in protecting children from these types of images.

Essentially, district courts would have 120 days to render a decision or notify the parties when a decision will be entered. The court of appeals and Kansas Supreme Court would have 180 days. There is nothing in the Bill that imposes any “punishment” if a judge or court fails to abide by a deadline.


Representative Jan Pauls, a lawyer and member of the Kansas House Judiciary Committee noted the possible separation of powers issues in the legislature ordering courts when to issue court opinions. However, he noted, “We certainly make changes in the civil procedure, and you can regard this as perhaps a change in civil procedure.”

With regard to the lack of enforcement within the Bill, King noted that it would be up “to the public to decide what should be the recourse, such as how voters decide in retention elections for judges or pushing legislators to enact more measures to put teeth in the time limits.”


The bill is set for a hearing before the Kansas Senate Judiciary Committee for February 5, 2014. You can track the progress of SB 289 on the Kansas Legislature’s website: Bills and Laws.

Two lessons from this very unfortunate incident:

 

(1) To Consumers: Be careful what information you give out to companies. This information is likely being accumulated and sold. (2) To Marketers: Watch out what you send to customers or potential customers.

OfficeMax has issued a press release, which states, in part:
This mailing is a result of a mailing list rented through a third-party provider. We have reached out to the third-party mailing list provider to research what happened. Based on a preliminary investigation today we believe this to be an inadvertent error; and we are continuing the investigation.
Besides being extremely cruel and reminding this family of their loss, this shows how much information retailers have about their customers.
