Attorney Brian P. Lundgren: EEOC: New Guidance on Preganancy Discrimination

The EEOC issued the guidance approximately two weeks after the United States Supreme Court granted an appeal of the United States Court of Appeals for the Fourth Circuit's decision in Young v. United Parcel Service.  In Young, the Fourth Circuit held that the Pregnancy Discrimination Act ("PDA") does not require pregnancy related accommodations or light duty assignments because pregnant employees are not disabled under the Americans with Disabilities Act ("ADA"). The EEOC's new guidance interprets the interplay between the PDA and ADA and reaches a different conclusion than the Fourth Circuit.
