Beyond Scared Straight -Juvenile Justice Reform: Frustrated by Supreme Court ruling, Iowa Gov. Terry Branstad acts to keep teen killers behind bars | Juvenile Justice | Scoop.it
in a move some legal analysts say flies in the face of the Supreme Court ruling, the governor commuted the life sentences of 38 juveniles, reducing their terms to 60 years, in a bid to make sure they stay behind bars for a very long time. If the sentences hold, those offenders will face parole boards in their mid-70s, provided they live that long.

Within hours of the tragic shooting in Aurora, Colorado at a screening of the new Batman movie, the political machine is already gearing up to exploit the incident as a tool to demonize the second amendment and characterize Americans who are against big government as extremists.

Beyond Scared Straight -Juvenile Justice Reform: Wrongful Conviction of Youth - Davontae Sanford

Beyond Scared Straight -Juvenile Justice Reform: Wrongful Conviction of Youth - Davontae Sanford | Juvenile Justice | Scoop.it

False confessions by dysfunctional people are a fact of life. Sanford's confession is about as probative as those given under torture during the Spanish Inquisition, so what gave it enough legs to land Sanford in prison on a guilty plea? The sorry answer is that it made things easy for the criminal justice system.

Colorado Shooter Described As 'Smart Kid,' Quiet Loner By Classmates

Colorado Shooter Described As 'Smart Kid,' Quiet Loner By Classmates | Juvenile Justice | Scoop.it

New York Police commissioner Ray Kelly said at a press conference that Holmes had dyed-red hair and said that he was "The Joker," the arch-nemesis of Batman, during the shooting. In a news conference Friday afternoon, Aurora police chief Dan Oates confirmed he had spoken to the NYPD, but declined to confirm Kelly's statements.

"We are not speculating on motive," Oates said.

An FBI spokesman said Holmes had no prior criminal record. His only previous encounter with police in Aurora is for a traffic ticket, Oates said.

Holmes was armed with an assault rifle, shotgun and two pistols, and wore a helmet, gas mask, bulletproof vest and other body armor, police said.

He surrendered to police shortly after the shooting, and alerted them to the presence of explosives in his apartment, a university-managed building 5 miles from the suburban Denver theater, police said. In the news conference, Oates confirmed that Holmes had rigged his apartment with "chemical and incendiary devices."

"Our investigation determined that his apartment is booby-trapped," Oates said. The explosives are "linked together by all kind of wires," he said.

Want to help youth sentenced to life in prison with no parole?

Want to help youth sentenced to life in prison with no parole? | Juvenile Justice | Scoop.it

Dear Supporter of Fair Sentencing for Youth:

Today the State Assembly approved technical amendments to SB 9, bringing the bill one step closer to its final vote. SB 9 would give youth sentenced to life without parole the chance to be re-sentenced and a possibility of parole. Last summer SB 9 failed to pass by just one vote. The bill will be voted on again soon; possibly next week. We are so close to winning this, but our powerful opposition is hard at work against the bill. You can help right now:

Watch these two short, powerful videos and send them to as many people as you can; post them on Facebook, tweet them, and click "like."

Then, write or call your Assembly Members! Ask them to watch the videos and support SB 9. Below is a sample email.

Beyond Scared Straight -Juvenile Justice Reform: Judge to rule by Aug. 7 whether to suppress Cristian Fernandez interrogations Whether boy understood his rights or was tricked by police was argued. | Juvenile Justice | Scoop.it

By Jim Schoettler

Polished attorneys for and against Cristian Fernandez spent Tuesday weaving through a slew of case law and evidence left for a judge to decide whether to suppress critical interrogations of the Jacksonville boy. Their final arguments then turned basic. "I guess my somewhat rhetorical question is 'why are we here?' " said defense attorney Hank Coxe. He suggested that "both sides" agreed to everything from state and federal law to the opinions of psychological experts that Fernandez, then 12, couldn't have understood his constitutional rights. But prosecutor Mark Caliel made it clear that Coxe spoke for only one side. "My simple response is we are here today because both sides respectfully disagree with the interpretation of the law and we're asking this court to [make] a fair adjudication of facts, circumstances and the law in this case," Caliel said.

Beyond Scared Straight -Juvenile Justice Reform: 1 out of 67 adult males in the US is in prison. | Juvenile Justice | Scoop.it

Do you think that this might suggest that something is “out of whack”?  Does the US have 6-10 times as much crime?  Does the US have 6-10 times the drug problem?  Is US law enforcement 6-10 times better at “catching the bad guys” than in other industrialized countries?  My belief is that that answer to all these questions is “no.”

Beyond Scared Straight -Juvenile Justice Reform: Let him Testify: Vincent Smothers Evidence could free Innocent teen

Beyond Scared Straight -Juvenile Justice Reform: Let him Testify: Vincent Smothers Evidence could free Innocent teen | Juvenile Justice | Scoop.it

"Did you hit somebody in there?" Williams asked. "Three guys, and I believe there was a female in the house with them," Smothers replied. "I'm sure the three guys are dead." He said he and an accomplice named "Nemo" stole $2,000 - "I think we split it" - a half-pound of marijuana and a .40-caliber handgun that was used to kill Rose Cobb, a police officer's wife, three months later. McGinnis, an appellate lawyer, learned about Smothers' statements in January 2009, about eight months after her client was sent to prison. She had already failed to get the boy's guilty plea thrown out based on his recantation, a long shot. But this was completely different because someone else had admitted to being the triggerman. McGinnis figured the Wayne County prosecutor's office would back down, and Sanford would be freed. "I was stunned. They said, 'Too bad, too sad,'" McGinnis recalled. "The prosecutor has tried desperately to find a connection between Davontae and Smothers but there's no connection." Indeed, the prosecutor's office insists that Sanford's guilty plea should stick. Assistant prosecutor Joseph Puleo has conceded that Smothers may have had a role, but, he said, that does not clear the boy.

Stop the hurt - Advocates for Abandoned Adolescents

According to the (American) National Committee to Prevent Child Abuse, in 1997 neglect represented 54% of confirmed cases of child abuse, physical abuse 22%, sexual abuse 8%, emotional maltreatment 4%, and other forms of maltreatment 12%.[27]

A UNICEF report on child wellbeing[28] stated that the United States and the United Kingdom ranked lowest among industrial nations with respect to the wellbeing of children. It also found that child neglect and child abuse were far more common in single-parent families than in families where both parents are present.

In the USA, neglect is defined as the failure to meet the basic needs of children including housing, clothing, food and access to medical care. Researchers found over 91,000 cases of neglect in one year (from October 2005 to 30 September 2006) using information from a database of cases verified by protective services agencies.[2]

Neglect could also take the form of financial abuse by not buying the child adequate materials for survival.[29]

The U.S. Department of Health and Human Services reports that for each year between 2000 and 2005, "female parents acting alone" were most likely to be perpetrators of child abuse.
A child abuse fatality is when a child's death is the result of abuse or neglect, or when abuse and/or neglect are contributing factors to a child's death. In the United States, 1,730 children died in 2008 due to factors related to abuse; this is a rate of 2.33 per 100,000 U.S. children.[31] Child abuse fatalities are widely recognized as being under-counted; it is estimated that between 60-85% of child fatalities due to maltreatment are not recorded as such on death certificates. Younger children are at a much higher risk for being killed, as are African Americans. Girls and boys, however, are killed at similar rates. Caregivers, and specifically mothers, are more likely to be the perpetrators of a child abuse fatality, than anyone else, including strangers, relatives, and non-relative caregivers. Family situations which place children at risk include moving, unemployment, having non-family members living in the household. A number of policies and programs have been put into place to try to better understand and to prevent child abuse fatalities, including: safe haven laws, child fatality review teams, training for investigators, shaken baby syndrome prevention programs, and child abuse death laws which mandate harsher sentencing for taking the life of a child. -
