Jasper Johns Assistant Guilty Theft; Forfeits $3.9 million, Gets 18 months Jail

Jasper Johns Assistant Guilty Theft; Forfeits $3.9 million, Gets 18 months Jail | Jasper Johns | Scoop.it

James Meyer, Jasper Johns' Assistant for 25 years, agreed to a plea deal in the theft of 22 Jasper Johns works from Jasper Johns' Sharon, CT Studio. James Meyer faced a prison sentence of 37 - 46 months and received 18 months in jail.

According to a May 8, 2014 lawsuit initiated by Frank Kolodny, the Gallery that sold 22 stolen Johns' was identified as the Fred Dorfman Gallery, New York.

Frank Kolodny is suing  defendants James Meyer, former Assistant to Jasper Johns and Fred Dorfman, gallerist and his gallery, Dorfman Projects LLC (collectively, the “Dorfman Defendants”).

http://itsartlaw.com/2014/07/07/case_review_kolodny_dorfman/

The lawsuit indicates Dorfman Gallery realized $6.5 million gross over 6 years; Meyer agreed to forfeit his share of the proceeds, $3.9 million in illegal profits from the scheme

Kolodny claims the defendants falsely represented to prospective buyers, including Kolodny himself, that Meyer received 22 individual pieces created by Jasper Johns as a gift and produced accompanying fraudulent documents.

Joseph K. Levene's insight:

Frank Kolodny asserts Fred Dorfman could not have possibly believed Jasper Johns generously gifted artworks valued at $6.5 million.

Thus, he contends that the Dorfman Gallery defendants ignored significant red flags in agreeing to sell the James Meyer consignments: Not only did all the artwork lack exhibition history, but Meyer insisted that the sale of any artwork remain confidential and prohibited the buyer from selling, loaning or exhibiting the respective stolen artwork for  eight years.

In lieu of appropriate due diligence, Kolodny asserts the Dorfman Gallery defendants understood the risks and demanded an exorbitant 50% commission, substantially higher than the traditional 10% commission for secondary Works sold by Johns and other other major Artists.

With James Meyer pleading guilty, what is the status of the Frank Kolodny lawsuit as well as the other 21 stolen Jasper Johns Art sales.

Why Jasper Johns Doesn't Paint Each Number The Same Way

Why Jasper Johns Doesn't Paint Each Number The Same Way | Jasper Johns | Scoop.it

To create Numbers in Color, 1958-59, Jasper Johns painted the 0 through 9 numbers on the top row and down the left, repeating the sequence with a 0 in the second row, a 1 in the third and so forth.

Although the 0-9 sequence is consistent, the way Jasper Johns painted each number varies.

James Meyer, Jasper Johns Assistant, will be sentenced for $6.5 million theft | Jasper Johns | Scoop.it

#JamesMeyer,  #JasperJohns  Assistant of 27 years will be sentenced in December 2014 for theft of 22 unique Johns' including Flag work on paper purchased by Frank Kolodny.

Joseph K. Levene's insight:

Frank Kolodny purchased Jasper Johns Flag for $400K,  and filed a civil suit after learning the Work was stolen naming defendants  #JamesMeyer  and #FredDorfman , the dealer who invoiced the Work.

Frank Kolodny asserts "that the Dorfman defendants  understood the risk they faced and demanded an exorbitant commission in the form of 50% of the sale proceeds, exceeding the standard amount of commission paid to dealers for consigning artwork from private collections.

Moreover, the Dorfman defendants purportedly assisted in perpetrating the fraud by fabricating documents attesting that the stolen artwork was indeed gifted to Meyer.

Katonah Museum celebrates 30 years Printmaking of Jasper Johns & John Lund

Katonah Museum celebrates 30 years Printmaking of Jasper Johns & John Lund | Jasper Johns | Scoop.it

The Katonah Museum of Art presents #JasperJohns and #JohnLund, Masters in the Print Studio, a 30 year collaboration in Printmaking.

Together Jasper Johns and John Lund  have created about 70 limited print editions, the vast majority of which are made with intaglio techniques, including etching and aquatint.

“This is a story that’s never been publicly told,” says exhibition curator Ellen Keiter. While many of the works featured in Jasper Johns & John Lund: Masters in the Print Studio have been included in other museum and gallery exhibitions, they have not been viewed through the lens of these two masters’ working relationship.

Process is explored in proofs and plates, and Lund’s personal photographs of Johns at work are also on display. “Mr. Johns is a famously private person,” says Keiter.

Belinda Roth, Interim Executive Director, adds "I believe it is out of respect for Mr. Lund and his untold contributions that Mr. Johns has granted us open access to his print studio.”

“We are delighted to bring this new perspective to Jasper Johns scholarship. The works on display form a telling representation of the second half of his printmaking career. We’re equally proud to recognize John Lund and his singular role in contemporary printmaking.”

Joseph K. Levene's insight:

The exhibition at the Katonah Museum includes the retrosective Jasper Johns Color Aquatint Series titled The Four Seasons, 1987 which traces Johns' intrepretation of the cycles of life.

In addtion, the Exhibition includes Johns' Flag on Orange, 1998, the first limited print edition published by Jasper Johns' Low Road Studio imprint; the Shrinky Dink Series, from 2011/2012, and Untitled Flag & Vase, 2000, one of only five prints created by Jasper Johns in which the red-white-blue Flag is the dominant image.

The exhibition is on view at the Katonah Museum until June 15, 2014.

Foundry Owner Pleads Guilty To Creating Counterfeit Jasper Johns Bronze

Foundry Owner Pleads Guilty To Creating Counterfeit Jasper Johns Bronze | Jasper Johns | Scoop.it

A New York foundry owner admits trying to sell Counterfeit Jasper Johns sculpture, which he had made using the artist's mould and failed to return to Jasper Johns.  The foundry owner faces at least 10 years in jail and could face 30 years when sentenced May 30, 2014.

Brian Ramnarine, 59, pleaded guilty to three counts of wire fraud after duplicating a bronze sculpture of Johns' classic 1960 Flag painting.

Jasper Johns testified and stated that he had used Mr. Ramnarine several times because of his excellent work, and asked him to create a wax mould for him in 1990. However, Johns told the court he had not given Ramnarine permission to keep the mould or create any sculptures.

1963 Photograph shows Leo Castelli, Jasper Johns' Art Dealer at the time, one of the four authorized versions of the Jasper Johns Bronze Flag.

Joseph K. Levene's insight:

Mr. Ramnarine will be sentenced on May 30, 2014, and, as part of a plea deal, agreed not to challenge any sentence of 10 years or less in prison. The charges can carry a maximum of 60 years in prison and, after his arrest, Ramnarine admitted carrying out additional sculpture frauds.

Jasper Johns Achieves Control With Encaustic

Jasper Johns Achieves Control With Encaustic | Jasper Johns | Scoop.it

Purchased by The Whitney Museum of American Art, New York, Jasper Johns White Target, 1957 is created with oil paint and encaustic on canvas. Encaustic hardens very quickly, so each brushstroke appears on the canvas exactly as Jasper Johns actually placed it. The individual strokes don’t blend into each other like they would with just oil paint.

By using encaustic, a melted wax process, Jasper Johns is able to control the surface vs. just using oil paint. As a result, Jasper Johns is able to build up the surface into layers, sometimes incorporating old newspaper & collage.

Jasper Johns once told Leo Steinberg, the art historian, that he chose to paint things like Flags and Targets because they were “pre-formed, conventional, depersonalized, factual, exterior elements.”

He could include them in paintings, prints and works on paper without them having to mean anything specific—which meant, in a way, that Jasper Johns' paintings were abstract!

Joseph K. Levene's insight:

Jasper Johns Works of Art are very literal. Theoretically, one could play a game of darts on a Target painting like the one owned by The Whitney Museum of American Art, but you dare not try.  And Johns’s Flags have been considered as patriotic Works on many occasions.

So are Johns' Target and Flag Paintings actual things, or paintings of things?

For Jasper Johns, the philosophical problems of representation became part of the painting tradition in a way that they have never been before.

James Meyer, Jasper Johns Assistant for 27 Years, arrested in $6.5 million theft of 22 Unique Works by Johns. | Jasper Johns | Scoop.it
The long-time assistant of the Pop art master Jasper Johns was arrested on charges that he stole at least 22 works from his employer and sold them through an unnamed New York gallery for $6.5 million.
Joseph K. Levene's insight:

James Meyer, Jasper Johns Studio Assistant, was arrested on August 15, 2013, after having betrayed his employer, the Contemporary Master Artist.

Mr. Meyer was arrested for stealing at least 22 unique Works of Art from Jasper Johns, his employer, and selling them through an undisclosed New York Gallery for $6.5 million.

Mr. Meyer allegedly created an elaborate scheme by telling this New York Art Gallery and its buyers, that each of the 22 Works by Johns were initially received as gifts from the Artist, and that they would be included  Artist's Catalogue raisonné.

According to the New York Times, Mr. Meyer kept $3.4 million from the proceeds sold by the unnamed New York Gallery. Details from the indictment indicate that Mr. Meyer purportedly created an agreement to keep details of the respective sales private for at least eight years, without exhibiting and/or reselling the respective Works of Art stolen from the Artist's Studio.

Mr. Meyer failed to realize that Jasper Johns is compulsive regarding ownership details of every Work of Art ever created by the Artist over his legendary six decade career.

Mr. Meyer has pleaded not guilty to federal charges, and was released on an unsecured $250,000 bond.

Counterfeit Jasper Johns Bronze Flag leads to FBI arrest

Counterfeit Jasper Johns Bronze Flag leads to FBI arrest | Jasper Johns | Scoop.it

The FBI arrested Brian Ramnarine, 58, on charges that he created a purported Jasper Johns Bronze Flag sculpture and attempted to sell it for $11 million to art collectors. In 1990, Jasper Johns had provided Mr. Ramnarine with a mold so that he could create a wax cast, which he completed for the Artist.

Although Mr. Ramnarine claimed the Johns wax mold was destroyed about 12 years when a landlord evicted him and discarded all his possessions, Mr. Ramanarine allegedly not only created the1989 Bronze Flag but also forged Jasper Johns distinctive signature on the sculpture", prosecutors said.

The FBI began an investigation in 2010 when "Ramnarine tried to sell the bronze piece to a wealthy art collector, claiming that it was a real Jasper Johns",  according to prosecutors.

Mr. Ramnarine, pleaded not guilty to a wire fraud charge in Manhattan Federal Court and was released on $250,000 bond. Mr. Ramnarine was sentenced to five years probation for a similar scam 10 years ago after he pleaded guilty to falsifying business records and was ordered to pay $100,000 in restitution.

Jasper Johns testifies at Jury Trial for unauthorized, forged Bronze Flag

Jasper Johns testifies at Jury Trial for unauthorized, forged Bronze Flag | Jasper Johns | Scoop.it

A prosecutor has told a New York jury that artist Jasper Johns will testify against a foundry owner charged with trying to sell a fake bronze sculpture of his iconic 1960 painting “Flag” for $11 million.

Assistant U.S. Attorney Zachary Feingold told a Manhattan jury Wednesday that Johns will say Brian Ramnarine (RAM’-nah-reen) lied by claiming the artist gave him the sculpture as a gift.

Joseph K. Levene's insight:

Unlikely   Brian Ramnarine  can convince Jury counterfeit Jasper Johns Flag was authorized especially since Jasper Johns will testify.

After all, Jasper Johns creates all his Art, never even using an Assistant to help create.

Did The Wrong Gerhard Richter Set The Right New Living Artist Record?

Did The Wrong Gerhard Richter Set The Right New Living Artist Record? | Jasper Johns | Scoop.it

Blake Gopnik, The Daily Beast, questions whether the wrong Gerhard Richter painting, sold last week at Sotheby's London, set the right new living artist auction record previously held by Jasper Johns Flag Painting.

Sotheby's London sold Gerhard Richter's Abstract Painting (809-4) for $34.2 million, property of Eric Clapton; that price eclipsed the previous record held by Jasper Johns Flag Painting, which achieved $28.2 million when sold by Christie's in 2010, from the Estate of Michael Crichton.

While Mr. Gopnik does not dispute Mr. Richter's greatness, he questions whether Richter's Abstract Painting (809-4) should command a record price when the Artist's photographic/realist paintings, many of which have tougher subjects, are actualy rarer, but admitedly less visually appealing.

On a sheer numbers basis, Gerhard Richter has made about 3,000 paintings during his six decade career, of which 65 are Squeegee Works of at least 6 feet in size, created from 1988 to 1994, and approximately one-third are in Museums.

Jasper Johns, by contrast has created approximately 30 Flag paintings, 14 prints and 50 drawings in six decades, underscoring the Flag's importance and scarcity in Johns Works.

SF MOMA Interactive Website Explores Jasper Johns Fascination With Numbers

SF MOMA Interactive Website Explores Jasper Johns Fascination With Numbers | Jasper Johns | Scoop.it

Visit the Interactive Site from San Francisco MOMA which explores the reasons Jasper Johns has created hundreds of Works in a variety of media, including limited edition prints, encaustic, acrylic, aluminum, sculp-metal, lithographs, etchings that incorporate Numbers since the mid 50's.

This SF MOMA site explores the reasons Jasper Johns continues to paint variations in Numbers over and over again?

Specifically, Jasper Johns has incorporated Numbers in these 4 categories:

-- Numbers superimposed over another as seen in the Johns 1960 0-9 Masterpiece above.
-- Numbers arrayed sequentially in groups, i.e., 0,1, 2, 3, 4, etc.
-- Numbers isolated on their own
-- Numbers in groups of 10, i.e., 0-9 Sets

The Interactive SF MOMA Site uses the Jasper Johns 0-9, 1960 Masterpiece on Canvas, which will be one of 90 Works of Art included in the 60 year Career Retrospective titled "Seeing With The Mind's Eye", which opens November 3, 2012 until February 3, 2013.

Organized in close cooperation with Jasper Johns, the San Francisco Museum Exhibition features approximately 85 major paintings, works on paper, lead reliefs and sculptures representing all periods of the Johns' Work from the 1950s to the present.
