The controversy over writer Nate Thayer’s failure to credit his sources, which some alleged amounted to plagiarism, is just part of an ongoing debate over how we use — and give credit for — information in a digital age.

 

The problem is that while adding hyperlinks is a great way of avoiding a charge of plagiarism — something that might have helped Fox News opinion writer Juan Williams and other alleged plagiarists — there is no accepted protocol for how or where to add those links, or how much content someone can cut and paste into their story or blog post without crossing the line from borrowing into plagiarism or copyright infringement.

As a hyperlink embedder, I would like to think I have remained true to the source author, but this post is a great timely piece to insure we contemplate, and reflect on how we are attributing the work of others.  In our hurried-fast-pace-production world, we need to slow down and insure that we are practicing what we preach.

Wired 10.10: Lawrence Lessig's Supreme Showdown

It's not just a vision he's promoting — it's a cause. His speech and his slides tell his Harvard audience the story of a valued commons of ideas threatened by big powers. The vast majority of intellectual property used to be in the public domain; now most is available only by permission. He takes particular delight in singling out the Walt Disney Company as the symbol of how the past is using its power to kill the future. The company was a major lobbying force behind the Sonny Bono Act, the law that Lessig is urging the Supreme Court to overturn. The measure was only the latest extension of copyright — which the Constitution explicitly dictates should be "limited" — from an original 14 years to an automatic 70 past the death of the creator. Most notably, the law protects Steamboat Willie, the first Mickey Mouse cartoon, from slipping into the public domain. (Lessig shows a clip of it in his PowerPoint presentation — fair use, one assumes.) The big problem, as Lessig sees it, is that continual extensions of copyright prevent anything new from entering the public domain. This is most ironic, notes Lessig, since Disney dredged the public domain for its most lucrative properties. A PowerPoint slide lists the examples, from Snow Whiteto The Hunchback of Notre Dame. Because of the Bono Act, Lessig asserts, "no one can do to Disney as Disney did to the Brothers Grimm."


The Berkman crowd is predictably appreciative, but being lawyers, they don't get as rowdy as, say, the Usenet conference Lessig spoke to a couple of weeks before. "That was the first standing ovation I ever had," marvels the professor. And it wouldn't be the last. As the Eldred case approaches, Lessig has embarked on a sort of barnstorming tour of conferences and seminars around the world, inveighing about Hollywood's "insane rules," upbraiding like-minded geeks for not taking action, and advocating a "million-bit march" on Washington to urge politicians to understand and embrace intellectual property rights. As he neared the end of his tour, Lessig was frustrated. They stand and applaud, he told himself, but why don't they fight?

A couple of weeks earlier, I'd asked Lessig a slightly different question: Why do you fight? The very question propelled Lessig — who seems to casual observers so able and confident that he can resolve even the knottiest dilemma with a built-in Occam's razor — into a surprising bout of self-examination. But for a chronically straight arrow, Larry Lessig has always had a flair for surprise.

Lessig was born in 1961 in South Dakota. His father, Jack, was an engineer, and helped build silos for Minuteman missiles. Within a few years, the family moved to Williamsport, Pennsylvania, where Jack bought a steel-fabricating company. Larry remembers Williamsport as "a tiny town — not tiny in population, but in its understanding of the world." Jack Lessig was doggedly traditional, and moral in a way that would have won Ayn Rand's approval: Once, when he underbid a job, he refused to change the assessment and performed the work at a loss. The family was churchgoing, law-abiding, and above all, faithful to the Grand Old Party. "I grew up a right-wing lunatic Republican," says Lessig.

This is an interesting article I ran across from Wired. A great short history of cyber law is presented here. There is also a serious look at what cyber law was, is, is becoming, some of the critical areas everyone should give serious thought over, and what is at risk if we allow the wrong laws and regulations to stand and the right ones to fail. There is also an story line here of a quiet strong man behind the scenes. Great article that really gets you thinking about the real questions.

Are you going to let your ISP tell you where you can and can't go and want you can do on your web contacts and searches They should be paying us to force their ad junk on us and close off what we pay to get..Not to mention this was in a anti-consumer, pro-corporate court this time, Our open Net should not depend on what judge someone managed to get and go back and forth with how ISPs can make us losers on our own dime.

Legislation that would make it official U.S. policy to promote a global Internet free from government control could restrict the U.S.

Those that block need to be stopped and we need public servants that don't intend to go through revolving doors of those they regulate to enforce this. An honest FCC in this country is fine for that ...just make sure they don't cut deals with those they regulate. This is why we have a police department ...because things that involve billions of dollars create cheats and thieves and the control of the Internet is a worth billions. Don't be fooled.

 

Congress (GOP) once said they would handle such cases directly...and we all know who they work for....   it ain't us anymore. Net Neutrality has been the basis of Internet success and the many Arab Spring style and other grassroots changes. Many seek to but the old bad style big media and sponsor or owners decide what we here model back. They are afraid.... make sure they are more than afraid if they try to oppress what the internet has become...make sure they lose charters...lose elections.... lose money and lose power ...stand together and I know the citizens of the world stand with us...that is the power of an open (enforced and guaranteed) neutral internet and human connections. Refuse to be the losers....ring all the represntaives and the white house's phone off the wall and make them have open neutrality enforced as Law just like the police and courts are intended to enforce the Law.

 

The very way this bill sets out not to have planned enforcement  to prevent blocking and limiting connections should tell us both the industries and our government is about to walk all over us and allow us no legal authority to stand against it.

Who is planning to line their pockets with our money. Yep your lucky ISP comcast and they others just got richer for years on stealing from us with rip off deals like all the other stuff they deliver to us and we just got poorer unless we fight back. They think they will now get to run the internet the lousy way they run cell phones and TV station charging us lots for stuff we don't want limiting what we want and yes blocking competition,and charging through the roof if we want more and so they don't have to improve their service.
