Investors encouraged by Russell’s merits for LSE while LME & CME seek to solve London’s silver fix problem. NASDAQ OMX close notes offering successfully. BATS chip away at the country club with a fascinating addition to the listing fees model. Molybdenum and other new metals contracts to trade in China, CFTC reviewing HFT trading ‘perks’ while we inch towards Bitcoin derivatives as well as a new Brazilian coffee contract.

NLX is one year old tomorrow (31st May), many happy returns to Charlotte Crosswell and her team. I will consider and report back on the exchange’s progress to date next week.

The major theme that we’re seeing in the world today is a movement of power from West to East. The recent ouster of the Gandhi family from power in India and their replacement with “a real nationalist” is just one more sign of a significant power shift in the world. India’s new leader, Narendra Modi is “Dedicated to India” a record in business that suggests that he really can deliver, and if he can deliver, it’s going to mean sharply increased competition for resources throughout the world, including silver.

Various stories about Euronext, NASDAQ upgrades eSpeed tech, Dar Es Salaam SE looking to do likewise (vendor unknown). A damning drip feed of audit reports concerning FTIL/MCX. TMX CEO Tom Kloet encourages crowdfunding and other market mechanisms to raise SME funds while south of the border, SEC still haven’t given the US rules to do so. ASX CEO insouciant, IEX come close to doing “God’s work” – perhaps appropriate for Ascension Day…

Elsewhere in Europe, it looks as if the knives are out for Jean-Claude Juncker, who is claiming a sort of divine right grasp on an EU Presidency by dint of leading the first placed party in the Euro-elections (that they actually lost seats is an afterthought). His European superstate leanings seem to have done his chances in, as opposed to his sheer inability to manage anything. This, after all, was a man forced from office as Prime Minister because the Luxembourg secret service (total headcount 60) ran amok.

…The great thing about the EU is that there is no need to make these stories up, fact is much whackier than fiction once Brussels gets involved it seems.

How about one that uses the Six Principals of Adequate Procedures relating to the UK Bribery Act as its guideposts? Or should a company follow the OECD Good Practice Guidance on Internal Controls, Ethics, and Compliance? More importantly, for anti-corruption enforcement under the Foreign Corrupt Practices Act (FCPA), what does the Department of Justice (DOJ) or Securities and Exchange Commission (SEC) look for when assessing a compliance program?

This week at Compliance Week 2014, I moderated a panel entitled Investigations Gone Global, Not Haywire. One of the panelists, Stephen Donovan, Chief Ethics and Compliance Officer, International Paper Company, said that one of his key reasons for setting out an investigation protocol was more than simply having a plan or guideline in place so that there would be consistency in investigations. The other key reason was to set expectations for all persons who might be involved in the investigation. The participants in the Great Emigration had a route to follow but that was about it. When it came to expectations, I think there were very little except hardship and the hope for a better future.

* LATEST MARKET DEVELOPMENTS *

Risk appetite in the world market place is on the upswing early this week, as U.S. stock indexes are at or near record or multi-year highs, while gold and the U.S. dollar index are weaker.

The Russia-Ukraine territorial crisis appears to have ratcheted down at least a notch over the long holiday weekend. The Ukraine held a presidential election on Sunday. The new president-elect of Ukraine, Petro Poroshenko, said he wanted to work with Russia and with Europe on integrating his country into both. Recent rhetoric from Russian president Vladimir Putin also seemed to be more conciliatory.  This news allowed some more risk appetite to creep back into the market place Tuesday. However, reports also said there is still significant fighting occurring between Ukrainian government troops and pro-Russian separatists.

When the three top finishers assembled for the 2013 World Cup Championship of Futures Trading® Awards Ceremony May 9 on the CME Group trading floor, three continents – North America, Europe and Asia – were represented.  When the top three finishers assembled for the 2012 ceremony a year earlier, the same three continents were represented, but by different traders.

Coincidence?  Or confirmation that World Cup Championship trading has truly international reach and appeal?  A look at the trophy winners suggests the latter.

Ed. Note-recently it was announced that Canada had made its first Canadian anti-corruption law, the Corruptions of Public Officials Act. I ask John Boscariol, a partner at McCarthy Tétrault LLP if he could explain  the case in a blog post he graciously agreed to do in this guest post. 

On May 23, 2014, Mr. Justice Charles Hackland of the Ontario Superior Court in Ottawa sentenced business executive Nazir Karigar to three years in prison for conspiracy to bribe foreign public officials. This is the first jail sentence handed down under Canada’s Corruption of Foreign Public Officials Act (CFPOA) since it came into force in 1999. All previous prosecutions have been against corporations and were disposed of with guilty pleas and fines.

While it seems that most of the news surrounding Bitcoin is negative (beware! – don’t buy! – they’re easily hacked! – it’s a bubble!), many journalists are reporting about the increasing number of online vendors as well as brick and mortar stores that have begun to accept Bitcoin as payment. It might even be true that merchants are adopting Bitcoin more than other people who are simply buying bitcoins as an investment.  There is a reason for this.

The men and women who control a third of the world's liquid assets - approximately $30 trillion - came together May 27, to put business and investors together to work on society's recalibration post financial crisis. According to a press release put out by nonprofit Inclusive Capitalism Initiative, which is a driver of the event, since the financial crisis, leaders have questioned whether the public will continue to support a system that nurtures growing inequality, permits and even rewards unethical behavior, and suppressed the importance of social purposes in favor of a primary focus on results. .

April showers bring May flowers, at least that is the old truism. One place it is decidedly correct is at the RHS Chelsea Flower Show, which began its run as one of the, if not the greatest, annual flower shows in the world in May 1862. The event draws some 157,000 people during its five-day run each May. The event has royal patronage and there is always a large contingent of royalty who visit the show.

Unfortunately one group of Englishmen and women who will not be stopping by to ‘smell the roses’ this year are those from the increasingly embattled UK company GlaxoSmithKline PLC (GSK)

EUREX leaps into Swap futures foray, develops fascinating GC pool future and confirms forex launch date. That’s two big new fronts in the post-OTC war in one sentence: collateral and of course the holy grail of swap futurisation. EEX powering on, NASDAQ tinkering with Philadelphia model, share shuffles at NCDEX, frustration growing over Mary Jo White’s management of SEC. ESMA clearly doesn’t understand HFT according to its own briefing documents.

Lots of interesting nuggets today with the news that EUREX has launched its swap futures product doubtless inspiring the good folks of NLX to stay awake all night working out how to copy it…

By the 20th century, Memorial Day had been extended to honor all Americans who have died while in the military service.

Crude Oil, United States Oil ETF (USO) absolute price rose above its highs of the previous 8 months on 5/23/14, thereby confirming its preexisting bullish uptrend. 

Financial stock sector ETF (XLF) absolute price crossed above its 50-day SMA on 5/23/14, thereby turning systematically bullish (from neutral).
