Why The USTR Is Working So Hard To Kill American Innovation And The Economy - Mike Masnick on Techdirt

A really logical and interesting viewpoint courtesy of Mike Masnick writing for Techdirts blog this week.

And whilst open source does not mean everything is free to use and build upon as the innovation driver without credit or remuneration to Originators - it does however out a good case forward for corporates to be more generous and supportive of next generation innovators. More collaboration I say but with trust frameworks in place to ward off greed, bullying and forgetfulness

3 Things Drug Dealers and Misfits Can Teach You About Business
Forbes
Misfits can't rely on the support of entrenched structures, so survival requires being adaptable, flexible, ready to pivot on a dime.
Maxine Horn's insight:

Don’t miss Alexa Clay and Kyra Maya Phillips new book (to be published in 2014 by Simon & Schuster) exploring the Misfit Economy—innovation and entrepreneurship demonstrated in underground, shady and outright illegal enterprises.

“Hierarchy really deflates self-governance, or guerilla governance, as we call it. And because of that, people become saboteurs instead of enablers of change.” Alexa Clay cites a report from the management consultant group LRN, who surveyed over 36,000 people in eighteen countries and found that a full third of employees were actively working against their employer. “That doesn’t mean they’re just checked out and messing around on Facebook. They’re literally undermining the organization.”

The First Consumer 3D Printer Is Now In Crowdfunding

The First Consumer 3D Printer Is Now In Crowdfunding | Intellectual Property | Scoop.it
It’s called the Micro and developers of the device call it the first consumer 3D printer. A crowdfunding campaign is under way on Kickstarter, and has already raised well over the amount needed to put the device into production.
Maxine Horn's insight:

It was only a matter of time before 3D printing technology reached the consumer and whilst it is still early days it does open up IP Issues in the same way the digital age and internet file sharing, downloads and Creator uncredited has.

Whilst manufacturing own products from a photograph is likely to only apply to low tech and crudely implemented items in the short-term, longer term it made lead to wholesale copying of hi-tech designs and near perfect implementation

I have been saying this for many years now,  designers need to change their business models before technology renders them redundant ......

Has anyone every copied one of your designs? | Voxpop | Design Week | Intellectual Property | Scoop.it
Tales of industrial espionage, copycat students and even clients copying from designers…
Maxine Horn's insight:

Lesa said " they said in a rather curt letter refuting my suggestion that they had acted in a somewhat less than honourable way and inviting me to see them in court".

It's a common approach of guilty parties to 'refute' allegations - attack as a form of defense. And when people have acted in a less than honourable way they will say and do anything to save their own reputation at your expense by denying any wrong doing on their part.

They'll do that even when it is in black and white in front of them, deny, dismiss, ignore, distract, bully - just lucky that you incorporated your own car registration number into the illustration -

Others might only have the law as recourse or no such means to reach a fair outcome if legal fees outweigh financial settlement.

But perhaps of more value you at least retain good moral fibre and ethics and the reprehensible behaviour of others will return to haunt them one way or another - particularly reputational damage

Maxine Horn's insight:

Useful article by Colin Hulme partner and head of dispute resolution, Burness Paull LLP which principally focuses on Intellectual Property in employment, freelance and consultancy contracts.

It's interesting that even creative firms have such a low level under-standing or a high level misunderstanding of IP that disputes arise all the time that could have been so easily avoided.

A quarterly IP workshop should be mandatory  for all staff and IP policy agreements / temp[ates for consultancts, supplers, freelancers and staff should be issued as standard practice, signed, before appointment.

IPtheft in the work place is rife due largely to ignorance rather than dishonesty

Alien Technology is reborn as a maker of tiny sensors for identifying small gadgets. An RFID tag is like a super bar code with radio connectivity. RFID readers can wirelessly detect and track RFID-tagged products in the supply chain. Creator 'Unknown'

Creator 'Unknown' | Intellectual Property | Scoop.it
Maxine Horn's insight:

Creative Barcode is gaining huge momentum worldwide as Creators, Innovators, Entrepreneurs start to take action to turn the tide against being unpaid, unattributed or miscredited for their work.

And that's not a surprise if you believe the recent statistics that state in the digital age images and content uploaded to the internet in one day today is the equivalent of what 5 years ago was the quantity of material uploaded in an entire year. -

See Wild West and IP article at http://www.creativebarcode.co.uk/newsitem.html?item=102

It's brilliant to share in the digital age with speed and reqularity but unless Creators of all type start taking responsibility to marque their work before releasing it into the wild for search engines to sweep up and re-serve to an internet audience that by and large believes that everything digitised and returned by internet portals is free to use without payment or permission, might regret not paying attention.

Here's food for thought - roll forward the years and consider what damage might be caused to the World's Creative and Cultural History if the result of the digital age is 'Creator Unknown'

Journalism and Collaboration: Where Is the Content Creation Ecosystem Headed?

Journalism and Collaboration: Where Is the Content Creation Ecosystem Headed? | Intellectual Property | Scoop.it
I once worked at a content creation agency in Boston where we churned out an exorbitant volume of content for client companies’ websites on a daily basis. Each writer was responsible for 15 to 20 stories per day that ranged from 200 to 500 words.
Maxine Horn's insight:

This article is about collaboration between writers in context of producing content and 'version control' but it does actually impact on Intellectual Property management in two areas

1. Ensuring that a publisher / commissioning organisation always has access and control over the files

2. IP Management - who is attributed and how and who owns the IP in the final published version.

Creative Barcode can assist with the second point as the IP Tag is contained in the final product with a link to Meta Data that states ultimate owner but also list of contributors and IP interests.

Maxine Horn's insight:

This article by Joanne Frears lawyer for Jeffrey Green Russell, London is excellent. The article focuses on Augmented Reality and how developers using it to create campaigns and Apps for their clients or new retail experience products and services are being targetted by Patent Trolls.

The Trolls are more likely to pursue the developers clients as they have deeper pockets but it will badly affect the developers who will lose clients, money and reputation.

Creators, developers, entrepreneurs need to understand the basic IP position and permissions or licenses needed before they blindly commit themselves and their clients.

It'ssomething every business that is outsourcing sotware development work or using open-source in-house should read and be very aware of.

I know of a start-up firm that lost a really important licensing opportunity recently because the core software driving their product was all based on open-source software and thereby not theirs to license exclusivly to another party.

Be aware - free can sometimes be very expensive
