From the time Barack Obama has been president, he has made a strong showing for Indian people. He’s done it holding summits of tribal leaders in Washington and sat down with Native leaders for face-to-face chats wherein he has committed to bettering Indian Country on his end. Rome was not built in a day and in this case, not in six years, either. But tribes can read intent through actions.

However, a recent State Department report was recently released that found the Keystone Pipeline XL posed no significant environmental impact if it were opened. Cue the flashing red lights. This is indeed the part where I decided to look past the surface of what I was being told so I could get a clearer picture about this proposed serpent that will snake through the heart of Indian Country.

The Trans-Canada pipeline has spawned a whole litter of issues that I don’t want to get into such as the politics of energy.  But what should be of great interest to tribes in South Dakota, Nebraska, Kansas and Oklahoma is the risk of potential and possibly irreversible consequences if the pipeline is in our backyards.

This pipeline is slated to move 830,000 barrels of oil a day from Canada through Texas, that little republic which is an ethnographic oddity as a state to have virtually no tribes in it for an expanse so big. Back to the pipeline: We know that the pipeline will move oil strained from the tar sands in Canada down to the Gulf of Mexico.

MADISON - For the third time in a month, the state Justice Department has reached a settlement in a case against a frac-sand mining operation.

"The attorney general's office said yesterday that the Tiller Corporation and Interstate Energy Partners agreed to pay 80-thousand dollars."  THAT'S IT? For destroying lives? "Supporters say the mines help the U.S. reduce its dependence on foreign oil, but opponents cite numerous pollution concerns -- and they previously accused the state of being slow to prosecute violators.  The DNR has referred six frac-sand pollution cases to the Justice Department for prosecution.  Three of those referrals came since last August.  As of last summer, 19 companies received pollution violation notices from the DNR."

Spanish Trial Of GTAC Bill Williams All But Certain

Cobre Las Cruces copper mine in Seville, Spain. GTac President Bill Williams was director at the mine and is alleged to be responsible for multiple crimes against the environment.

WCMC has obtained information from the Spanish organization pressing charges against Bill Williams, President of Gogebic Taconite (GTac), for alleged crimes perpetrated while he was director of the Cobre las Cruces copper mine in Spain. Ecologistas en Acción (Ecologists In Action) are seeking information on Williams’ current whereabouts to pass on to the Spanish court, so that he can be subpoenaed to face trial in Spain for his role in pollution of an aquifer near Seville, and other environmental violations.

According to Isidoro I. Albarreal Núñez, a member of Ecologistas en Acción who is responsible for coordinating the legal actions against Cobre Las Cruces, “In April 2008, there was a massive collapse of the slopes of the mine, for which Bill Williams was directly responsible. This collapse was predicted several years earlier (since 2002, before construction of the mine began) in several reports from CEDEX, a technical unit of the Spanish government, because the design of the slopes of the mine wasn’t safe. CEDEX indicated that it was necessary to modify this slope design to safer parameters.”

Núñez says that when Williams became director of the mine, he failed to follow what was suggested in the CEDEX report. “To reduce costs during the excavation, Williams did not make the mine with the correct grade of the slope that was recommended by CEDEX and those slopes collapsed in April 2008. Williams also failed to carry out a Geotechnical Sonar Project, a condition required by mining authorities.”

Núñez holds a doctorate in Mathematics from the University of Seville and is coordinator of the mines and quarries area of Ecologists in Accion-Andalucia. He was provincial coordinator in Seville between 2005 and 2009.

Williams, holed up in his Hurley office in northern Wisconsin, responded in an AP report by saying he is not sure how these charges will affect the opening of GTac’s 22-mile open-pit mountaintop removal mine in the Penokee Hills. Wisconsin law does not deny felons permission to operate a mine, but the charges should raise the red flag at the DNR.

In more difficult news for GTac, information arose last week about evidence of GTac sharing lobbyists with the group of organizations that have been subpoenaed in the latest John Doe investigation. An investigation has spread over five counties and is collaring election-rigging organizations that funneled Koch money into the state during the recalls. GTac, Wisconsin Republican leadership and Americans for Prosperity worked in close conjunction to make sure AB/SB1 became law. The evidence of possible collusion pushes GTac ever closer to the dragnet.

 

Back in Spain, according to Núñez, Court No. 19 is waiting for the prosecutor to submit his complaints and for Ecologists in Action to add theirs before they schedule the exact date of the trial. Once the trial is scheduled, the court will summon the accused. Núñez assured WCMC that there will be a trial.

An article that reveils the underside of foster care. However, it's important not to create generalizations of foster care that all foster children are abused and neglected in foster homes. Certainly there are bad foster homes, but there are also good fosters and foster families as well.

Settlements announced Monday bring penalties against sand mining companies to $360,000.

Two Minnesota companies have agreed to pay $80,000 to settle a pollution case at a sand mine in northwestern Wisconsin where sediments from the mine infiltrated a wetland, a creek and ultimately flowed into the St. Croix River. The settlement was announced Monday by Attorney General J.B. Van Hollen and involved Interstate Energy Partners and Tiller Corp. for their failure to stem the flow of sand and sediment from the mine in the Town of Grantsburg in Burnett County. The companies settled with Justice Department lawyers for failing to maintain dikes and berms to control runoff from the site. The case is the third involving a sand mine since mid-December. Altogether, the parties have agreed to pay $360,000 to settle.

The U.S. Army Corps of Engineers has rebuffed an overture from Wisconsin officials to collaborate on an environmental impact statement for a $1.5 billion open pit mine.

The impact statement is an extensive environmental assessment for the massive project that will play a pivotal role in helping regulators decide whether to approve permits allowing the mine to go forward.

 

Tamara E. Cameron, chief of regulatory branch of the Corps district office in St. Paul, Minn., told the DNR in a Dec. 23 letter that her agency couldn't work with the DNR — for now — because of key differences between state and federal review requirements.

 

In March 2013, Gov. Scott Walker signed into law a bill that rewrote regulations governing iron ore mining. The law relaxes some environmental provisions, and for the first time, set a deadline — 420 days — for the DNR to act on a mining permit. There is also a provision for a 60-day extension.
