Spanish Trial Of GTAC Bill Williams All But Certain

Cobre Las Cruces copper mine in Seville, Spain. GTac President Bill Williams was director at the mine and is alleged to be responsible for multiple crimes against the environment.

WCMC has obtained information from the Spanish organization pressing charges against Bill Williams, President of Gogebic Taconite (GTac), for alleged crimes perpetrated while he was director of the Cobre las Cruces copper mine in Spain. Ecologistas en Acción (Ecologists In Action) are seeking information on Williams’ current whereabouts to pass on to the Spanish court, so that he can be subpoenaed to face trial in Spain for his role in pollution of an aquifer near Seville, and other environmental violations.

According to Isidoro I. Albarreal Núñez, a member of Ecologistas en Acción who is responsible for coordinating the legal actions against Cobre Las Cruces, “In April 2008, there was a massive collapse of the slopes of the mine, for which Bill Williams was directly responsible. This collapse was predicted several years earlier (since 2002, before construction of the mine began) in several reports from CEDEX, a technical unit of the Spanish government, because the design of the slopes of the mine wasn’t safe. CEDEX indicated that it was necessary to modify this slope design to safer parameters.”

Núñez says that when Williams became director of the mine, he failed to follow what was suggested in the CEDEX report. “To reduce costs during the excavation, Williams did not make the mine with the correct grade of the slope that was recommended by CEDEX and those slopes collapsed in April 2008. Williams also failed to carry out a Geotechnical Sonar Project, a condition required by mining authorities.”

Núñez holds a doctorate in Mathematics from the University of Seville and is coordinator of the mines and quarries area of Ecologists in Accion-Andalucia. He was provincial coordinator in Seville between 2005 and 2009.

Williams, holed up in his Hurley office in northern Wisconsin, responded in an AP report by saying he is not sure how these charges will affect the opening of GTac’s 22-mile open-pit mountaintop removal mine in the Penokee Hills. Wisconsin law does not deny felons permission to operate a mine, but the charges should raise the red flag at the DNR.

In more difficult news for GTac, information arose last week about evidence of GTac sharing lobbyists with the group of organizations that have been subpoenaed in the latest John Doe investigation. An investigation has spread over five counties and is collaring election-rigging organizations that funneled Koch money into the state during the recalls. GTac, Wisconsin Republican leadership and Americans for Prosperity worked in close conjunction to make sure AB/SB1 became law. The evidence of possible collusion pushes GTac ever closer to the dragnet.

 

Back in Spain, according to Núñez, Court No. 19 is waiting for the prosecutor to submit his complaints and for Ecologists in Action to add theirs before they schedule the exact date of the trial. Once the trial is scheduled, the court will summon the accused. Núñez assured WCMC that there will be a trial.

Perhaps a clause should be written into the permit to deter any further ecoterrorist activities and hold LCO accountable financially if such activities do occur again. Are additional costs being incurred by Iron County due to security issues in this region? On August 15, 2013, the Wisconsin DNR is holding a hearing to take public testimony on whether to issue a bulk sampling permit to Gogebic Taconite LLC (GTac) for mining in the Penokee Hills.

 

GTac submitted their application for bulk sampling in late June. On July 2, the DNR issued a ten-point response requiring more information from GTac, including how they plan to deal with the asbestos found in the Penokee HIlls:

Wisconsin Geological Survey shows grunerite, one of the most toxic forms of asbestos, is present on and near the proposed mine site.

 

10. Additionally, given the documented occurrence of asbestiform minerals in ore bodies of similar nature in Minnesota and reports of similar minerals (amphiboles of the cummingtonite-grunerite series) in the vicinity of the proposed bulk sampling activity, it will also be necessary to evaluate the bulk sampling activity to determine whether regulations pertaining to the control of asbestos emissions under chapters NR445 or NR447 WI. Admin.Code is required. If there minerals are present or potentially present in an asbestiform habit within the excavated material, a percentage of total emissions would likely be asbestos emissions.


According to the National Academy of Sciences, grunerite is one of the most toxic forms of asbestos and causes lung cancer, mesothelioma and pulmonary fibrosis. The Wisconsin Geological Survey states on its website that grunerite is found throughout the Mellen area on and near the proposed mine site. (see above)

Tribal leaders in northern Wisconsin are requesting federal government intervention to stop mining activity in the Penokees. They’re doing that because they say the clock is running out to protect the ceded territory.

 

One factor is a Senate bill that could make 5½ square miles in mining areas off-limits to the public. Bad River Tribal Chairman Mike Wiggins says this would kick tribal biologists off the area they’re obligated to protect.

“We’ve seen enough now to understand that state legislators are willing to pressure scientists, are willing to try and restrict access to publicly accessible places that are critical for the data and the objective data-gathering and analysis that are going to be necessary to paint a picture of this eco-system,” he said.

 

Six tribal leaders ask in the letter to President Obama to stop mining activities to protect the ceded territory. But Republican State Senator Tom Tiffany of Hazelhurst, one of the sponsors of the “off-limits” bill, says this is not a place for the feds.

 

“Well, I sure hope the President doesn’t come in and usurp the state’s ability to manage its natural resources because that’s something the federal government has always delegated to the states,” Tiffany said.

But Wiggins says the difference is, this is state land in the ceded territory, so the U.S. government must act.

 

“In real time right now, we know what we need and we need intervention because of all of the efforts to obscure and cloud over GTac’s activities in the hydrology and the science of this site,” he said. “We expect from a trust responsibility perspective, we expect the federal government to be there for us and to honor those treaties.”

The federal government is being asked to stop any more mining activity in the Penokee Hills, exploratory or otherwise. 

 

When a new iron ore mining bill passed the state legislature last winter, Bad River Tribal Chairman Mike Wiggins figured his best bet to protect the watershed leading to his reservation and Lake Superior was through the federal government. He says the Environmental Protection Agency and the Army Corps of Engineers have more integrity than the new state law.

“Bulk sampling is a joke and was actually a mining company construct that they got in the state law,” says Wiggins.

 

Wiggins says bulk sampling is the beginning of mining by Gogebic Taconite (GTAC), and he wants an environmental impact statement before GTAC does any digging or uses explosives in the Penokee Hills.

“We’re into the start of GTAC trying to get down into the earth, trying to get started on exploding, and we’re going to engage heavily at the federal level,” he says. “Let’s put a stop to this madness.”

 

Wiggins says Bad River will not sit by and watch the state go ahead while they believe federal regulations are bypassed. So they’re reaching out to federal agencies to step in. “There’s no silver bullet to protect ourselves. We have to utilize a myriad of different entities and resources.”

 

The Department of Natural Resources says although the new state law doesn’t require an environmental impact statement, the old state law didn’t either.

The state is holding its first of two required public hearings in the mining permit process in Hurley tomorrow. The meeting will be streamed live on WPR.org.

According to an article in the Milwaukee Journal Sentinel, Governor Scott Walker’s office was in touch with the head of Bulletproof Securities before they entered the state and committed a felony by not securing proper licensing to carry machine guns in the Penokee Hills.


Several complaints were filed against BPS with the State Department of Safety and Professional Services and the Iron County District Attorney. However, those were ignored when the department finally granted Bulletproof their permits in mid-August. Iron County District Attorney Martin Lipske said on Friday that he was negotiating a deal with GTac to not prosecute them or BPS if they agree to patrol the area without guns.

 

“I’m going beyond simply not filing them,” said Lipske. “I want some more concessions so that hopefully we don’t have to have high-intensity security people like Bulletproof have or acting in a high intensive manner like being armed. If we can get some sort of agreement like that, I feel that then justice will be served.”

 

Bulletproof claimed that needed to break the law and not obtain legal license to do business in the State because of the “threat” caused by a protest that took place at the mining company’s core drilling site on June 11.

July 10, 2013 - At a press conference in Mellen, WI ahead of a joint committee of Anderson, Morse and Ashland and Iron County Mining Impact Committees, Ashland County Chairman Pete Russo discusses his history with Gogebic Taconite, the company that would obliterate the Penokee Hills for low-grade taconite.

 

This is the Chairman of the Ashland County Board of Supervisors, the board that voted 18-1 to implement an Metallic Mining Ordinance to protect the taxpayers of Ashland County and regulate mining the same way they regulate any other activities from dog licenses to building permits.

Eau Claire (WQOW) - The debate about a proposed iron ore mine in northern Wisconsin always seems to come back to two things:  the impact on the economy vs. the environment.  As WQOW News 18 examines Gogebic Taconite's plans, we're hearing what supporters and opponents say they stand to gain or lose depending on the fate of that mine.

Frank Koehn fights to protect the natural waters and habitat of this region.

"It's water.  It all comes back to water.  We need that water to sustain life and that's what's at risk here is our water," says Koehn. The DNR says mines can use water at more than 70 gallons per minute.
