Schleswig-Holstein’s interior minister confirmed Friday that the breakaway German state may issue more gambling licences as legislators clashed over the gambling rules the new government would like to repeal.

 

Schleswig-Holstein needs a "well thought out, reasonable and legal" way to proceed, and simply repealing its gambling rules would lead to a "lawless state", interior minister Andreas Breitner told the northern state’s parliament Friday.

Long-awaited legislation which will tax and license Irish-facing online bookmakers was published yesterday by the Department of Finance.

 

Just days before parliament adjourns for its summer recess, the Irish Department of Finance published the Betting (Amendment) Bill 2012 which will amend the Betting Act 1931 to include provisions on online gambling for the first time.

 

The draft bill, which is expected to kick off a period of fierce lobbying, introduces online betting taxes, extends opening hours of retail bookmaker, and outlines a number of new enforcement methods by which Irish courts can tackle unlicensed operators.

 

Minister for finance Michael Noonan said: “This bill will bring into place a fair and equitable licensing and regulatory regime for all bookmakers and betting intermediaries.” ...

Disgruntled operators are tooling up to challenge Cyprus’ new betting law in court, just as Cypriot police threaten to enforce the online gambling prohibitions without delay.

 

For firms reliant on betting exchanges and online casino games, both banned under the bill, there is no other way to keep operating in Cyprus’ estimated €2bn gambling market.

 

They believe the law, passed unanimously by Cyprus’ parliament earlier this month, can be tested on constitutional and European Union legal grounds.

 

A lawyer for one local firm, which has 16 shops offering online casino and slot games, said this week it was considering suing the Cyprus Republic by taking it to the European Court of Justice and appealing to the European Commission.

 

Betting exchange Betfair, which stands to lose €9m, has also threatened to take action against Cyprus.

 

The London-listed company put out a statement last Monday that “the legislation contains serious flaws and, in certain areas, is inconsistent with European Union law”. ...

As calls to regulate the fledgling social gambling industry grow louder, business leaders from social gaming firms have pushed back against the criticism, saying their games are entertainment not gambling.

 

In a recent outspoken blog post, William Hill chief executive Ralph Topping said it is imperative that regulators address social gaming applications on platforms such as Facebook because they are not adequately protecting minors and use game mechanics that simulate unrealistic play and inevitable losses.

William Hill will not participate "until appropriate regulation is in place", Topping said.

 

At last week’s annual Gaming Executive Summit (GES) in Barcelona, leaders from the world of social gaming responded that the controversy was misbegotten.

 

Hal Bringman, a founding partner and spokesman for online casino game business Double Down, said the brouhaha was "a knee-jerk reaction by some people who don’t fully understand what’s going on".

 

“At Double Down we self-regulate. We don’t let people go crazy with a credit card — we cut them off at a certain level, put them in a VIP area and give them tons of free chips and don’t let them bet the mortgage.”...

The Cypriot House of Representatives has passed controversial legislation that prohibits online casino games and exchange betting. Sports betting has been regulated with authorities levying a ten percent revenue tax on all operators.

 

The betting bill made it through the House of Representatives Legal Affairs Committee last week before a full parliamentary vote on Friday saw a majority of Representatives approve the measure.

 

The legislation also establishes a new Gambling Board, which is to receive three percent of all tax revenues from gambling before parceling the entire amount to the Cyprus Sports Federation. The Cyprus Football Association is then to receive 1.5 percent of this sub-total with a further 0.5 percent earmarked for other sports associations and the remainder going to programmes dedicated to fighting problem gambling. ...

Online gambling operators will find it easier to advertise in Germany after victory for companies including Bwin in a Bavarian Administrative Court, according to lawyers.

 

The Higher Administrative Court in Bavaria published a ruling on Thursday that German regulators discriminated against Austrian bookmaker Bwin and other offshore gambling companies.

 

Regional regulators broke European Union law by dealing more roughly with adverts by foreign gambling firms than state-owned lotteries, the court found.

 

“The ruling makes it easier for media portals to advertise private gambling operators. Up to now some big media companies were reluctant to place adverts from gambling companies,” said German gambling lawyer Martin Arendts ...

Greek gambling giant OPAP reported an 18 percent increase in second quarter net profit, as sports betting and reduced tax liabilities softened the impact of the ongoing national economic crisis. ...

OPAP, Europe’s largest listed gambling company, reported second quarter net profit of €126.1m, up from €106.9m in the same period last year and outdoing an average analyst forecast of €105.4m.

 

The gains were on the back of improved sports betting revenues as well as lower deferred tax rates and the partial reversal of the 2011 tax provision, the company said in a filing with the Athens bourse yesterday.

The regulators (Glücksspielreferenten) in each of the 16 German states have written draft guidelines for the implementation of the new State Treaty on Gaming that will make internet gaming practically impossible.

 

The age verification laws would require players to attend a face-to-face meeting in a post office or similar institution and show his or her identification.

 

A similar provision existed in a previous version of the State Treaty in 2008. Tipp24 lost 80 per cent of its customers and state operators such as Lotto Bavaria saw 78 per cent of its players depart.

Net Entertainment Eyes Expansion Into UK Market | GamblingCompliance

Sweden-based online casino supplier Net Entertainment says it wants to expand further in the UK despite a planned increase in tax for operators taking bets from the already crowded domestic British market. 

 

Net Ent this week said it was in negotiations with several big operators in the UK, after signing agreements with Irish independent Boylesports and Harrogate-based Sky Betting earlier this year.

 

Despite the UK government’s introduction of its planned point of consumption tax (POC) that could see operators pay a 15 percent tax on its profits by 2014, Net Ent said that will not affect its plans to expand in the UK.

 

Chief executive Per Eriksson told GamblingCompliance: “We will have to wait and see but at the moment it is not something we believe will affect our business.” ...

On June 19th and 20th, online gaming regulators from four European countries France (ARJEL), Italy (AAMS), Portugal (Santa Casa da Misericordia de Lisboa) and Spain (DGOJ), met in Barcelona (Spain).

 

The meeting aimed at confirming their common willingness to promote an operational cooperation in the field of regulation and enhancing exchanges of information.

 

All four participating regulators act according to a legal framework that considers: gambling is not a normal activity but an activity where each national state must guarantee public order in its territory, protecting consumers against fraud and criminal activities, preventing addiction, especially amongst vulnerable groups, assuring the integrity of the game and fighting illegal gambling. These objectives can only be effectively pursued by each individual state regarding each specific ethical, cultural and social reality, trough strong regulatory instruments, exercised by public authorities, not relying on market forces only. These common political vision and objectives make possible an operational cooperation aimed at laying the foundations for a better protection of the ends provided for by the legislation and for exchanges on the licensing criteria in each jurisdiction. ...
