Commission on Legislative, Judicial and Executive Compensation will be holding a public hearing on pay raises for New York State judges. It will be the one and only hearing that this Commission will be holding on judicial pay raises – and it will be in Manhattan, at 11 a.m., at the New York City Bar Association at 42 West 44th Street.

The Commission on Legislative, Judicial and Executive Commission – like its predecessor, the 2011 Commission on Judicial Compensation – is required, by statute, to “take into consideration all appropriate factors”. In 2011, our non-partisan, non-profit citizens’ organization, Center for Judicial Accountability, Inc. (CJA) took the position that systemic judicial corruption, involving supervisory and appellate levels and encompassing the Commission on Judicial Conduct and the court-controlled attorney disciplinary system, was an “appropriate factor”, disentitling the Judiciary to ANY pay raises. Indeed, we took the further position, which we demonstrated by an analysis of the New York State Constitution and decisional law, that it would be UNCONSTITUTIONAL for the Commission to recommend judicial pay raises, absent a determination that mechanisms were in place and functioning to remove corrupt and incompetent judges. Neither the 2011 Commission – nor by anyone else – ever denied or disputed the correctness of these two positions. Instead, they all simply ignored what we said – reflective of their knowledge that what we said was correct.

What was correct then, is correct now: “NO PAY RAISES FOR NYS JUDGES WHO CORRUPT JUSTICE. THE MONEY BELONGS TO THE VICTIMS”. And, once again, as in 2011, CJA is mobilizing citizen-opposition.

To be most effective, we must inundate the Commission with the EVIDENCE of New York’s systemically and pervasively corrupt judiciary -- judges who are biased and abusive and whose decisions are judicial perjuries, falsifying and/or omitting the material, dispositive facts and disregarding non-discretionary black-letter law -- and against whom there are NO FUNCTIONING REMEDIES: not disqualification motions; not reargument motions, not requests for supervisory oversight, not appeals, not complaints to the Commission on Judicial Conduct or to court-controlled attorney grievance committees – nor to anyone else.

Needless to say, those who are far away from Manhattan should be vigorously protesting to the Commission about its holding a hearing only in Manhattan – and should request that additional hearings be scheduled in Albany, Buffalo, Rochester, etc.

Please note that the salaries of district attorneys and clerks are statutorily-linked to judicial salaries – so victims who can attest to district attorney and clerk corruption – especially their cover-up of judicial corruption -- should use the opportunity to incorporate that evidence into their presentations.

By statute, the Commission is required to render its report with recommendations on judicial pay, etc. by December 31, 2015. After that, it will be conducting hearings on legislative and executive pay raises, as to which it must report by November 15, 2016. CJA is mobilizing opposition to legislative and executive pay raises as well, as the same principles apply: corrupt public officers are not entitled to pay raises – and their corruption is not only “an appropriate factor” for the Commission’s consideration, but one having constitutional magnitude.

I have created a link to CJA’s campaign of citizen opposition to the pay raises – accessible from CJA’s homepage,www.judgewatch.org. It is entitled “NO PAY RAISES FOR NEW YORK’S CORRUPT PUBLIC OFFICERS: THE MONEY BELONGS TO THEIR VICTIMS!” . It brings up a menu page whose first link is CJA’s webpage for the Commission on Legislative, Judicial and Executive Compensation. I invite you to call me so that I can guide you as to how to be most effective in your presentations to the Commission, whether at the hearings or by written submissions. It is most important to furnish documentary evidence. If you filed disqualification motions, reargument motions, requests for supervisory oversight, appeals, complaints to the Commission on Judicial Conduct and to the attorney grievance committees, these are all very important. Likewise, your complaints and correspondence to district attorneys – and to the Governor, Attorney General, Comptroller and Legislators, all of whom – you may be sure – believe themselves entitled to pay raises.

I urge you to provide me with copies of your written communications to the Commission so that I can keep a record of them and/or post them on CJA’s website for examination by the press, scholars, and others able to “blow the whistle” on a Commission cover-up. Such webpage will be similar to what I created for witnesses testifying on July 20, 2011 at the Commission on Judicial Compensation’s one and only hearing in Albany:http://www.judgewatch.org/…/…/7-20-11-commission-hearing.htm .

When Antonio Peña Arguelles opened an account in 2005 at Citigroup’s Banamex USA, the know-your-customer documents said he had a small business breeding cattle and white-tailed deer, ranch-raised for their stately antlers. About $50 a month would come into the account, according to the documents.
A week later, Peña Arguelles wired in $7.09 million from an account in Mexico, allegedly drug money from Los Zetas, a violent cartel founded by former Mexican soldiers, documents in his money-laundering case in Texas say. In all, Peña Arguelles shuttled $59.4 million through the account, according to a confidential report by banking regulators that berated Banamex USA in 2013 for its failure to comply with anti-money-laundering rules.
Banamex USA didn’t file a suspicious activity report about the account, according to regulators, even after Peña Arguelles’s brother Alfonso was killed in late 2011, his body dumped at the Christopher Columbus monument in Nuevo Laredo, Mexico, with a banner draped above it accusing Antonio of being a money launderer and stealing from the Zetas. The bank didn’t produce an activity report after U.S. prosecutors asked for the account documents at the end of that year or when Peña Arguelles was indicted in early 2012 for conspiracy to launder monetary instruments. And it didn’t file one until May 2013, months after the Federal Deposit Insurance Corp. and the California Department of Business Oversight issued a written order in August 2012 demanding the bank check old accounts.
