Video: Truck Driver Stands Up To Unconstitutional Checkpoint

Video: Truck Driver Stands Up To Unconstitutional Checkpoint | gov and law skinny | Scoop.it

A truck driver who passed through an unconstitutional checkpoint 30 miles from the Mexican border stood up for his 4th Amendment rights by refusing to answer questions in another example of how Americans are re-asserting their liberties.

Noah Duncan's insight:

I think that it's great that people stand up against things that are unconstitutional.  If nobody stands up when the government does things like this then our rights were given to us for nothing.

I'm really impressed by the cold-heartedness of this man who's brave enough to stand up and fight for his rights. He seems to know very well his rights and he doesn't give up even when the officer becomes more and more inquisitive. Great example of a battle for rights.
Lauren Heim's curator insight, April 30, 8:48 PM

This truck driver had some  crazy bravery to stick up to the border patrol. And though he got pretty lucky he did have the right to do what he did. He held his ground when there was no probable cause and the border patrol had violated the 4th amendment or were about to. The man also plead the fifth in which he has the right to.

Abigail Beinborn's comment, May 2, 1:37 PM
I think it takes a lot of courage to stand up to any patrol. This man stood up for his rights of the fourth and fifth amendment. I think he did the right thing.

Well, well, well. Looky here. Yet another heated topic about gun control. While I understand that many people don't want any of their gun rights taken away or violated, think about if the situation was the complete opposite. Imagine if all of these shootings still happened but the president just waved them off as a fluke. He didn't even lift a finger to try and stop it. No changes. Just a slap on the wrist and "Off you go, Shooter!" with a smile and a football-esque butt slap. No! If anything, we should be happy that our president, although maybe to the extreme, is trying to bring about change after tragedies.

littlebytesnews's comment, April 26, 2013 2:37 AM
We don't need more gun control laws! You can pass a million new laws but criminals will always break them! @Andrew Lawrence and Noah Duncan and in the US we have a right to bear arms that shall not be infringed....and what they are trying to do is control and regulate what law abiding gun owners do. None of their new laws and legislation would have prevented the Newtown shooting nor any other shooting because criminals don't get background checks, etc...they steal their guns or buy them on the black market. More laws won't stop criminals it just makes it harder for law abiding citizens to obtain the protection they need to defend themselves.

Arizona Lawmakers Advance Bill Making Gold and Silver Legal Tender - BlackListedNews.com

Arizona Lawmakers Advance Bill Making Gold and Silver Legal Tender - BlackListedNews.com | gov and law skinny | Scoop.it

Concerned about the out-of-control Federal Reserve System and the increasingly unstable fiat dollar managed by the privately owned central bank, lawmakers in Arizona are following in Utah’s footsteps to come up with a potential alternative that protects citizens. Legislation to treat gold and silver as legal tender already sailed through the state Senate in late February, and last week, the Arizona House Financial Institutions Committee voted 4 to 2 to advance the bill as well. Activists are now working hard to keep it moving along.

If the legislation (S.B. 1439) passes through the full state House of Representatives and is signed into law by Republican Gov. Jan Brewer, gold and silver coins would become legal tender within Arizona. That means, among other important changes, that the precious metals would be treated just like debt-based Federal Reserve notes for taxation and regulation purposes. However, unlike fiat dollars, nobody would be forced to accept gold or silver currency.

The bill, which has found strong support among ...

Opponents of Islamic ideology face election ban

A considerable number of former members of the parliament, senior politicians and lawyers etc, who openly negate and oppose the Islamic ideology of Pakistan, are vulnerable to be declared unfit to contest the upcoming polls. It is not only the article 62 of the constitution but the nomination paper of the Election Commission of Pakistan (ECP) that bounds every aspirant of the parliament and provincial assemblies to respect, protect and preserve the Islamic ideology. The constitution and the nomination paper make it clear that the Islamic ideology has been the very basis for the creation of Pakistan. If You Can't Sue The Feds For Spying, Sue Them For Lying About Spying | Techdirt | gov and law skinny | Scoop.it

There have been numerous attempts by various parties (including, in a few cases, the EFF) to sue the US government concerning various aspects of its warrantless spying on Americans. Pretty much all of these cases end up failing, often for reasons that are suspect. However, it appears that the Electronic Frontier Foundation (EFF) is going to try again. As you may recall, back in July, the feds admitted to Senator Wyden that their own analysis discovered that they had violated the 4th Amendment on occasion in carrying out surveillance under the FISA Amendments Act.

In response to this, the EFF filed Freedom of Information Act requests, asking for documents concerning the situation in which such searches were deemed unreasonable under the 4th Amendment. The feds more or less ignored the FOIA request. So the EFF is suing for violations under the FOIA.

Teenager tends war memorial in his village for 12 years... then the council accuses him of criminal damage after he added a pipe to water plants

Teenager tends war memorial in his village for 12 years... then the council accuses him of criminal damage after he added a pipe to water plants | gov and law skinny | Scoop.it

Kurtis Green has tended to the Dersingham memorial since he was sevenHe was questioned by police for two hours after installing the water pipe

For 12 years, Kurtis Green has diligently tended the war memorial in his village, cleaning up rubbish and planting bulbs at its base.

In January, the Queen congratulated the 19-year-old for his hard work revamping the memorial, near her Sandringham Estate in Norfolk.

But officials at Dersingham Parish Council have taken a rather different view and reported him to the police for his unpaid work – which they have labelled criminal damage.

Mr Green, whose grandfather fought in the Second World War, was quizzed for two hours at a police station after he added a pipe to water the flowers without permission.

The volunteer was just seven when he started tending the garden around the memorial opposite his parents’ fish and chip shop.

He saved up his pocket money to buy gardening tools, and over the past decade he has spent hundreds of hours working on his pride and joy.

When he was 15, he persuaded councillors to spend £20,000 on restoring the area with raised flower beds, new railings, seating and block paving.

Mr Green worked tirelessly to help with the project and won a Young People of the Year award after he was praised by villagers.

His efforts were then recognised by the Queen in a letter after the local Royal British Legion won a prize for having Norfolk’s most improved war memorial.

But Mr Green got into trouble in February when he connected a new water supply so the flower beds could be safely watered.

He and fellow villager John Houston, 65, assumed they were authorised to do the work because the pipes for the water supply had already been placed in the ground as part of the restoration project.

But Dersingham Parish Council complained to the police that they had done the work without its permission and accused them of criminal damage and theft.

Mr Green, who works as a chef at a care home, said: ‘It is just  so pathetic.

‘All we have been trying to do is help the community and we are being treated as if we are criminals.

‘We were accused of causing criminal damage by digging up earth to see if the existing pipe was OK, but we left the area just as we found it.

‘I can’t understand what the theft is supposed to have been.

‘All the soil we dug up was replaced in the ground and the only thing we took away was the dirt under our fingernails.

‘The policewoman was trying to trap us. She kept asking us the same questions in different ways.’

Mr Green started working on the site as a boy because it was full of weeds and rubbish and ‘not in a fit state’ to honour those who had fought for the country.

He said: ‘In those days, it was a complete disgrace. I just decided to do something to help.’

Mr Green, who had been forced by the parish council to take out his own insurance for work on the site, added: ‘The trench we dug was marked with cones and it  was all filled in the same day. We replaced the turf as best we could and put down new grass seed.

‘It actually looked better than when we started. But while we were doing it, a councillor came along and took pictures of us on his mobile phone. The next thing we knew,  we were reported to the police by the council.

‘Loads of people in the village are supportive of us.’

Tony Bubb, a Liberal Democrat district councillor, resigned as chairman of the parish council on Monday, but said his decision had nothing to do with the dispute.

Parish council clerk Sarah Bristow said she could not comment as the issue was being investigated by  the police, but added: ‘The parish council did not give anyone permission to do anything.’

A spokesman for Norfolk police said: ‘The circumstances are now being considered by the Crown Prosecution Service. Police are aware of Kurtis’s efforts in cleaning up the memorial and we will work with all concerned to try to reach an acceptable resolution.’

Mr Green’s mother, Sandra, 61, said: ‘All he is trying to do is some good. He’s got a heart of gold.’

Dersingham has a population of 4,500. Singer Phil Collins owns a house in the village.

Noah Duncan's insight:

This goes on to show how important it is for a judicial branch in any country to look at cases and offenses on a case to case basis.  This way people are not accused of wrong doing in simple cases like this where the accused did nothing wrong.  I find it terrible that he had to deal with that harrassment when all he was trying to do was something nice.

US President Barack Obama will snub Lady Thatcher’s funeral by failing to send a single senior member of his administration, The Sun can reveal.
.
Ageing former Secretaries of State James Baker, 82, and George Shultz, 92, will lead the US delegation, the White House will announce today.
.
The slight comes as German leader Angela Merkel also declines the official invite. She will send her foreign minister instead.

But Downing Street is most angered by rejections from Obama, First Lady Michelle and Vice-President Joe Biden.

And none of the four surviving ex-US leaders — Jimmy Carter, George Bush Sr, Bill Clinton and George Bush Jr — is coming either.

The response contrasts with glowing US tributes on the day Lady Thatcher died.

A No 10 source said last night: “We are a little surprised by the White House’s reaction as we were expecting a high-profile attendance.”

The snub came ahead of last night’s Boston marathon bomb outrage.

"Devout Islamists'' follow the Koran literally and the Hadith, as well as sharia law,all of which oppress non-Muslims and call for death to infidels/non-Muslims.

For example:

In the hadith collections, Muhammad proclaims:
"I have been commanded to wage war against mankind until they testify that there is no god but God and that Muhammad is the Messenger of God; and that they establish prostration prayer, and pay the alms-tax [i.e., convert to Islam]. If they do so, their blood and property are protected. [Emphasis added.][16]"

"This linguistic aspect is crucial to understanding scriptural exegeses regarding violence. Again, it bears repeating that neither Jewish nor Christian scriptures—the Old and New Testaments, respectively—employ such perpetual, open-ended commandments."

SpaceX chief appears before House committee

SpaceX chief appears before House committee | gov and law skinny | Scoop.it

The next SpaceX launch site will not only be a place to launch rockets: The company would eventually want a site nearby to build them as well.

Space Exploration Technologies founder and billionaire Elon Musk made the announcement Friday at a hearing before the Texas House of Representatives Appropriations Committee in Austin, where he explained to committee members what SpaceX, as his company is known, is all about.

Musk said the company will continue to build its Falcon 9 rockets in California, but when it begins manufacturing rockets larger than the Falcon 9, they would be built at or near the launch site.

“The logical thing is to build near the launch site,” he said. “That is something that will occur wherever the launch site occurs.”

5 Mobile Ad Campaigns That Worked

5 Mobile Ad Campaigns That Worked | gov and law skinny | Scoop.it
Although a lot of digital executives say that mobile advertising has yet to live up to its promise, brands like Yamaha, Olympus and Adidas would say otherwise.

I like how this artical shows that campaigning in politics and other types of aspects are all the same in ways that they lure the audience and capture your attention.  They have very similar tactics.

This article talks about the different mobile campaigns that are all around us.  These different campaigners do a lot of different campaigns to catch peoples eye so then they canremember their   campaign.  This article relates to government and law because these campaigns are all around the United States and a lot of different people see campaigns all the time.

Katie Gilbertson's comment, March 15, 10:15 PM
This was a. Interesting article, especially when they are using the seemingly not popular mobile ads, to get attention. As annoying as they are, the mentioned ads do seem to do their job of getting folks attention.

Today, President Obama spoke in Burma – or as he termed it, Myanmar, despite official US practice to call the country Burma – and repeatedly botched the name of the country’s famed Nobel laureate Aung San Suu Kyi, instead calling her Aung YAN Suu Kyi. Then he called President Thein Sein “President Sein,” which was a diplomatic snafu, since the president of Burma is to be called by his full name.

His speech was just as bad. After getting through the basics – acting as though his doctrine, not President Bush’s multiple actions on behalf of democracy in Burma, had created more freedom in Burma -- Obama cited Franklin Delano Roosevelt’s “four fundamental freedoms: freedom of speech, freedom of worship, freedom from want, and freedom from fear.”

When it came to freedom of speech, Obama said all the right things – after all, he was not talking about an anti-Islam YouTube video in Burma. But he then followed up that glowing language with this bombshell: “Now, on other hand, as President, I cannot just impose my will on Congress -- the Congress of the United States -- even though sometimes I wish I could.” Yes, he does. And he does everything in his power to exceed his constitutional bounds. And he said this in Burma, a military dictatorship for decades, shortly after calling it Myanmar, the name for the country used by the military dictatorship. Talk about undermining America on the world stage.

Obama moved on to freedom from want, which he said was accomplished through private property which could be seized by government. Really. Here was his take on how economics makes peoples prosperous:
When ordinary people have a say in their own future, then your land can’t just be taken away from you. And that's why reforms must ensure that the people of this nation can have that most fundamental of possessions -- the right to own the title to the land on which you live and on which you work. When your talents are unleashed, then opportunity will be created for all people …. as more wealth flows into your borders, we hope and expect that it will lift up more people. It can't just help folks at the top. It has to help everybody. And that kind of economic growth, where everybody has opportunity -- if you work hard, you can succeed -- that's what gets a nation moving rapidly when it comes to develop.

So property ownership is good, except that it promotes inequality, so it must be redistributed. Got it.

When Obama moved on to freedom of worship, he moved back into his “red states and blue states” nonsense from the campaign.

Obama addressed freedom from fear. He didn’t talk about the need to discard tyrannical societies. Instead, he talked in vague terms about xenophobia, fear of change, and the like.

LBN:

We know the wannabe tyrant would love to do away with the Congress and will bypass it even more in his second term. Another reason we must fight back against the coverup the media will use to protect him and the DEM party.

Therefore, we must do the following:

Noah Duncan's insight:

I feel like this situation hurt both the United States as a nation as well as the democratic party in particular.  With Bush and now Obama, we've had a succession of flaws in speeches that result in the leader of our nation looking like an illiterate and uneducated person that's unfit to lead.  Speech writers, as well as the president and his advisors should take more time into research and editing to make sure they're politically correct.

Dwayne Giles wanted to reverse his sentence because he was not able to confront the witness against him. He shot and killed her, but his argument will probably hold up in court. His 6th amendment rights are being protected.

Noah Duncan's insight:

I don't like how you can use loop holes like that to get out of murder.  Just because you didn't get a right in court doesn't mean that you aren't guilty or murder.

Madison Blazing's comment, March 9, 8:40 AM
The outcome of this trial will likely make a strong statement about the United States judicial system. While Giles is entitled to "confront" the victim under the United States Constitution, I find it kind of ridiculous that he is using this argument as his defense. Because Giles murdered her, the woman obviously is unable to testify and be confronted in a court of law, and it seems like he is just using this right to his advantage. While I am assuming there is a lot more to this case than is stated in the article, I still don't think Giles should be absolved of his crime. After reading this article, I think that this case will likely be discussed for awhile, as many arguments can be created for both sides, regardless of the outcome.
Buster Meyer's curator insight, May 1, 3:56 PM

this article relates to the  6th amendments because a guy  wants his rights protected because he shot and killed his ex wife.

Michael Hanson's comment, May 4, 3:06 PM
This is wrong on every level if this guy gets murder conviction gets reversed. The 6th amendment is being abused in this situation, and if the court doesn't see that it's gonna let a murderer back onto the streets.

Andrea Pastorino's comment, March 16, 2013 2:13 PM

I think that there should be a seperation of church and state. Even though the people who wrote the Constitution probably all believed in God and most people in Pennsylvania probably also believe in God, they should not make a year dedicated to the Bible.
