- SHIELD Act would not solve the problem of startups that can’t afford to litigate a case through trial in order to win and recover attorneys’ fees.

- significant asymmetries still exist between NPEs and small companies, particularly given that many NPEs use contingency-fee lawyers and therefore incur no legal expenses (other than expert witness fees) until a jury verdict or settlement, whereas defendants almost always have to pay their lawyers by the hour.

- "Stopping Offensive Use of Patents Act"...could particularly benefit Internet startups since many business-method patents relate to software and e-commerce applications and USPTO review is much cheaper than full-blown litigation.

The technology CFO organized a coalition of about a dozen Vermont technology and e-commerce companies who had faced threats from patent holders. The firms pooled their money and hired Vermont attorney Peter Kunin to craft a legal strategy for responding to the troll threat.

Well, well, look at this. Just yesterday we wrote about how the Supreme Court said this week that patent holders can't use their patents as a get-out-of-jail-free card when facing antitrust investigations from the FTC.

 

While many had focused on the specific pay-for-delay situation in the case, we wondered if this would unleash the FTC to really go after a whole variety of patent trolls. The FTC has been gearing up to go after patent trolls for quite some time, and now it looks like it's finally happening.

The FTC is launching a "sweeping investigation" of patent trolls that will hopefully expose some of the more nefarious practices of those shakedown houses:

In its latest effort to combat patent trolls, the Electronic Frontier Foundation is leading a group organizations and law schools to launch a new online resource called Trolling Effects that will crowdsource data - including demand letters - with the goal of enabling true innovators to resist bogus legal threats.
