Tennessee Criminal Law Review: U.S. Supreme Court to consider "late" actual evidence proof

An issue before the U.S. Supreme Court involves the late appearance of evidence that may demonstrate a criminal defendant’s innocence. Though many people assume that if evidence were to arise showing that someone was clearly innocent of the crime they were accused of committing, no matter how late, then it would be considered by the court. Perhaps it may come as a surprise to some, this is not always the case. Here is the petition for certiorari granted by the Supreme Court on this issue filed by Floyd Perkins.

The actual issue presented states: The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) contains a one-year statute of limitations for filing a habeas petition. In Holland v. Florida, 130 S. Ct. 2549, 2562 (2010), the Supreme Court affirmed that a habeas petitioner is entitled to equitable tolling of that one-year period “only if he shows: (1) that he has been pursuing his rights diligently, and (2) that some extraordinary circumstance stood in his way and prevented timely filing.

Floyd Perkins' petition presents two recurring questions of jurisprudential significance involving equitable tolling under AEDPA that have divided the circuits:
1. Whether there is an actual-innocence exception to the requirement that a petitioner show an extraordinary circumstance that “prevented timely filing” of a habeas petition.
2. If so, whether there is an additional actual- innocence exception to the requirement that a petitioner demonstrate that “he has been pursuing his rights diligently.

As Justice Antonin Scalia wrote in 2009, the Supreme Court has never held that “the Constitution forbids the execution of a convicted defendant who had a full and fair trial but is later able to convince a habeas court that he is ‘actually’ innocent.”

The Supreme Court now has agreed to hear a case that demonstrates exactly why the issue can be a tricky one. The case involves a Michigan man, Floyd Perkins, who is serving a life sentence for murder. New evidence was uncovered and a long time passed before it was presented. The issue now is whether it can be raised or whether Perkins should spend the rest of his life in prison for a crime he says he did not commit.

The details of the incident begin with a house party in 1993. Perkins was in attendance and left with two other men, one of whom was later found dead in the woods, having been stabbed in the head.

Electing judges is a bad idea because judges are not like politicians. It is fine for a politician to make deals with voters; to say, “Vote for me and I’ll raise the minimum wage” or “Vote for me and I’ll cut taxes.” But it is an abuse of power for a judge to promise—or even hint—that he will decide future cases on any basis other than the facts and the law. Standing for election gives judges an incentive to smile on people voters like and get tough on those they hate. That is hardly a recipe for impartiality.

How possible is it that the government could have your home or other areas under surveillance and a person just not know such as was alleged by a lady that resulted in the government including the courts system doing her so dirty they cleared themselves by ordering her to be placed in mental hospital and then defining her mentally unstable to be a party in her own court case against the government police after the police failed to appear in court  over 20 times. Now that which she has alleged in one state is made true in another. I salute you things as you alleged and caught sheer hell for government style and was denied and said could not happen, happens this article is evidence of such.

North Lanarkshire Council has opened an investigation into what it calls “serious allegations of corruption” in its procurement processes.

Council leader Jim Logue instructed chief executive Paul Jukes to launch the probe following an anonymous tip off in a letter to council.

Logue said: “These allegations, which are detailed, concern some of the council’s procurement processes. If true, they are extremely serious.”

The council’s internal audit team has already begun to investigate the allegations and will hand the case to the police if further evidence of wrongdoing is found.

The internal audit team has access to all files held by any part of the council and all IT systems.

“It is essential that the people of North Lanarkshire are able to have full confidence in the way the council conducts its business and I am determined that we are transparent at all times,” said Logue.

“Although these are currently unsubstantiated, anonymous allegations, I believe that it is right to carry out a full investigation and share any evidence which comes to light with the police.”

The council declined to comment further‎.

On Sunday, at the culmination of the annual Chief Justices Conference, Justice Thakur declared a decision to appoint retired judges as ad-hoc judges as an "exceptional and extraordinary" measure to tackle the dual problem of vacancy of Judges and backlog of ailing cases. Article 224-A of the Constitution allows such a measure in certain circumstances. But this is only a stopgap arrangement. A permanent solution is still pending as hundreds of cases pile up in Indian courts.
