The British parties' deceit about a No vote being a vote for "more powers" is unravelling pretty much as anticipated. We've had Ruth Davidson for the Tories ruling out any possibility of the British parties agreeing on a common set of proposals. And now we have her British Labour allies squabbling about how little they can offer the people of Scotland and still manage to maintain the pretence of favouring further devolution.

The conditions necessary for any offer of "more powers" to be in any way credible were never going to be met. It really is time that people accepted the fact that there is no "more powers" option available. Only a Yes vote can guarantee the powers that the people of Scotland want for their parliament. Only independence will protect that parliament from the depredations of British politicians whose fondest wish is to see it emasculated or abolished.

In his opinion, Judge Gardephe stated that the evidence used to originally convict Valle did not sufficiently prove that the former officer acted on what his attorneys said were sexual, cannibalistic fantasies involving women he never met, as well as his wife.

 

“The evidentiary record is such that it is more likely than not the case that all of Valle’s Internet communications about kidnapping are fantasy role-play,” the judge wrote.

 

Gardephe did uphold Valle’s conviction on a less serious charge, which alleged that he used the NYPD’s federal database to collect information on various women he intended to target. That conviction carried a sentence of up to one year in prison, but since Valle has been in jail since 2012, he can be set free as early as Tuesday.

 

Although prosecutors originally argued that Valle’s access of the NYPD database signaled that the former officer was taking steps to carry out his lurid plan – they also claimed he had searched the internet in order to learn about using chloroform to knock someone unconscious – defense attorneys said his involvement with a dark fetish website was simply fantasy. When Valle appealed his conviction, his lawyers claimed the jury could not differentiate between the details of his fantasy and real steps toward making it a reality.

Cannon 3 of the Code of Judicial Conduct entitled Performing the Duties of Judicial Office Impartially and Diligently states that a judge shall accord to every person who has a legal interest in a proceeding, or the person’s lawyer, the right to be heard according to law and that a judge shall not initiate, permit, or consider ex parte communications made to the judge outside the presence of the parties between the judge and a party, an attorney, a guardian or attorney ad litem, an alternate dispute resolution neutral, or any other court appointee concerning the merits of a pending or impending judicial proceeding.

With Britain’s population ageing fast and greater numbers of people unable to control their finances unassisted, a record 250,000 powers of attorney are being registered each year. The attorney system enables family members and others to take legitimate control of someone else’s affairs.

 

The relevant government authority – the Office of the Public Guardian – is struggling to keep pace, and registrations of new attorneys currently take more than three months to process. A spokesman told the Telegraph's Your Money it was “recruiting additional staff” and the processing period would “shortly” be reduced to eight weeks.

 

The increase in numbers of attorneys is resulting in more disputes among families. The will, trust and estate division of national law firm Irwin Mitchell, for instance, has experienced a 75pc increase in attorney-related disputes in 12 months. And at the Financial Ombudsman Service, which arbitrates disputes between individuals and finance firms, new complaints concerning powers of attorney are up by 40pc since the beginning of 2013 and running at 35 a month.

This article honestly made a lot of sense to me. Federal Judge Alex Kozinski may seem a bit wild and on the fringe to a lot of people, but like the article says, he’s also willing to say what’s on his mind, and that seems to be the same as what other people are thinking. I can honestly agree that there is no ‘humane’ method of execution and that by using drugs meant for the easing of pain for hospital patients in overdoses designed to kill a person, we really are avoiding the reality. When we execute someone, it is a brutal thing, no matter how nicely we try to do it. The taking of a human life is not humane. It’s an execution, which means we are ending the life of a human being for whatever their crimes might have been. Though I have my own reasons for arguing against the death penalty, I find that I agree with Judge Kozinski’s thoughts. If we are going to execute someone, what is the point in using a method that can and has failed? I think he’s right, and the guillotine is a bit inappropriate for our day and age, but a firing squad is still a realistic and sure method. Yes, there is trauma involved in firing squads for the people squeezing the trigger. Killing a person is a traumatic experience. Oh, unless you decide to drug them to death instead. Which might or might not work of course. It’s no more or less brutal if you have them lined up by a squad than if you inject them. Though I don’t think the death penalty is the best solution, if we are going to execute people, let’s not pretend we’re just putting them to sleep. If people want to make the choice to kill a human being for their crimes, let them face that execution with the reality that it is.

I do thank ypu for your opinion. but as this is a new age even per you the thing is there is more than one way to kill as there are people that are innocent of crimes but have been found to be guilty by the court system only to find out 20 years lather in their serving time and others are dead that they didn't commit the crime at all but what then we cant go and exume the bodies say we are sorry for the horrible mistake and breathe life back into their dead bodies. then we have those that have been killed but are yet alive the court nd all the other systems of government has been used against them and their families to the point they just cant take it any more so yes their bodies are alive but the abuse of authority has been so severe that they are scared to fight or even say they have been done or is being done wrong. a firing squad is used in more than just one way in this age of technology firing guns is not even considered because those that do the shooting will be forever remembered by themselves an others as murderers themselves and that person's blood will be required upon their hand before God and I as just doing my job is not going to work for him. Then who be we if one day we find ourselves standing in as a firing squad participant and you find out the person we have to shoot to death is one of your own loved ones would you be able to pull the trigger and then find out your love one was innocent all the time but it was your hand with the help of other firing arm participants that killed your innocent relative.

Australian journalists could face prosecution and jail for reporting Snowden-style revelations about certain spy operations, in an “outrageous” expansion of the government’s national security powers, leading criminal lawyers have warned.

 

A bill presented to parliament on Wednesday by the attorney general, George Brandis, would expand the powers of the Australian Security Intelligence Organisation (Asio), including creation of a new offence punishable by five years in jail for “any person” who disclosed information relating to “special intelligence operations”.

 

The person would be liable for a 10-year term if the disclosure would “endanger the health or safety of any person or prejudice the effective conduct of a special intelligence operation”.

 

Special intelligence operations are a new type of operation in which intelligence officers receive immunity from liability or prosecution where they may need to engage in conduct that would be otherwise unlawful.

FSALT LAKE CITY, July 15 (Reuters) - FBI agents arrested two former Utah attorneys general at their homes on Tuesday and charged them pair with felonies stemming from a two-year investigation into claims of bribery and corruption, prosecutors said.

 

Republicans John Swallow and Mark Shurtleff are accused of establishing a pay-to-play culture in office, and of taking bribes to look the other way or offer protection when donors to their political campaigns ran into legal trouble.

 

"This has been a complex, nuanced, large investigation and there are multiple players in it," Salt Lake District Attorney Sim Gill said at a news conference. "We have filed what we think are appropriate charges. We could have filed more."

 

Both men deny any wrongdoing. They were booked into Salt Lake County jail and released by midday.

Swallow told reporters outside he would clear his name.

 

"I absolutely maintain my innocence. I look forward to being able to confront my accusers and to have my day in court," he said.
