As most American Indian communities are isolated, their rights at all levels are frequently abused. This case of abuse is devestating many families in the Sioux Nation communities. These groups have no lonnyists, advocates or protectors….often it is only public exposure and outcry that can help.

 

Consider contacting your state and federal representatives and ask for public transparency and protection of American Indian families.

“SIOUX FALLS, South Dakota — South Dakota willfully has violated federal law by removing too many American Indian children from their homes and placing them in foster care with non-Indian families, the state’s Indian Child Welfare Act directors said in a report they plan send to Congress.

 

Six of the state’s nine directors representing each of the nine tribes in South Dakota met Thursday on the Yankton Sioux Indian Reservation to approve the report that will be to Congress within the next few weeks.

The report is in response to a National Public Radio series last year that said the state routinely broke the Indian Child Welfare Act and disrupted the lives of hundreds of Native American families each year. Federal law requires that Native American children removed from homes be placed with relatives or put in foster care with other Native American families except in unusual circumstances. After the series aired, six members of Congress wrote to Indian Affairs at the Department of the Interior asking whether the NPR report was accurate and, if so, what the Bureau of Indian Affairs plans to do about it.

 

Federal officials said a summit would be held in South Dakota in the summer of 2012 to address concerns raised in the series, but that summit has not taken place, so the Indian Child Welfare Act directors prepared their own report to send to lawmakers.

 

“South Dakota for well over a decade has systematically violated the spirit and the letter of the Indian Child Welfare Act,” the directors wrote in the report. “The state appears to have done this willfully, and it may have done so at least partly to bring federal tax dollars into the state. … We ICWA directors request that Congress put pressure on the BIA to host the summit on Native American foster care in South Dakota immediately.”

July 1 marks the 10th anniversary of the entry into force of the Rome Statute of the International Criminal Court (ICC), the first permanent international court with a mandate to investigate, charge, and try people suspected of genocide, crimes against humanity, and war crimes worldwide. At the ripe old age of 10, the court has become a high-profile institution on the world stage -- central to nearly every call for international justice for the most serious crimes. Nearly two-thirds of the United Nations' membership, 121 states, have ratified the ICC's statute, which legally obligates them to cooperate with the court. And the ICC is staying busy: The current docket includes the cases of, among others, three heads of state, a former vice president from a fourth country, and two presidential candidates from a fifth.In August, judges will consider sending former Ivorian President Laurent Gbagbo, now in court custody, to trial. Meanwhile, there are growing, but initial diplomatic efforts are under way to have those Syrian officials responsible for alleged crimes appear before the ICC.

At the same time, however, the court has been unable to take custody of several leading suspects such as Sudanese President Omar Hassan al-Bashir and the Lord's Resistance Army's Joseph Kony, who continue to reap murder and sow mayhem. In addition, the Office of the Prosecutor has failed to pursue any investigations outside Africa. In just the last few weeks, in the starkest crisis in the court's institutional life, an ICC defense lawyer and three staffers visiting Muammar al-Qaddafi's son, Saif al-Islam, have been detained by a militia in Libya that is holding him.

 

The ICC is also managing a large investigative docket and caseload. It is conducting investigations in seven countries -- in the Central African Republic, Democratic Republic of the Congo, Darfur in Sudan, Ivory Coast, Kenya, Libya, and Uganda. The Office of the Prosecutor is also considering whether to open investigations in Afghanistan, Colombia, Georgia, Guinea, Honduras, Nigeria, and South Korea. Meanwhile, the court's investigations have spawned renewed interest in bolstering national prosecution of serious crimes in Congo, Guinea, and Uganda. These initiatives could be a lasting spillover effect of the ICC as "a court of last resort."

In establishing a judicial institution with this extraordinary mandate, there were bound to be shortcomings. And there have been serious problems. Some are caused by external conditions, while others are performance problems internal to the workings of the court.

First among external challenges is the ICC's dependence on countries to execute its arrest warrants because it does not have a police force. This causes delays and obstacles in getting custody of suspects. Thus, President Bashir and two other ICC suspects who are Sudanese government officials remain at liberty as Khartoum unleashes a new round of atrocities in southern Sudan. Robust diplomatic backup by the states that have joined the treaty, as well as the U.N. and the European Union, is crucial to bringing about compliance with arrest warrants, but support has been more of an inconsistent, on-again, off-again quality, depending on political circumstances.

The Chinese Year of the Green Wood Horse began on January 31st of 2014. Imagine a wild horse blazing across the landscape with the wind at its back.  Now, picture the many “horses” that were let loose across the planet in 2013, as well as during the previous decade since 9/11.  Each hemisphere and region, every continent and nation throughout the world has experienced it’s own version of a buckin’ bronco on steroids — breaking out of the rodeo pit — since the Crash of ’08. Now we see just where this “Wood Horse” will run to is a year that guarantees the most profound and fundamental changes of the modern era.

Amnesty International Ireland today welcomed the Government’s publication of the report of the independent Special Inquiry by the Ombudsman for Children into the removal of two Roma children from their families in October 2013 based on unfounded concerns regarding their identity.

Colm O’Gorman, Executive Director, Amnesty International Ireland said: “We welcome the Government’s mandating the Children’s Ombudsman to conduct this inquiry. Today’s public apology by the Taoiseach and Minister to the two families is also important and welcome. However, the substantive response to the report will be the real test of the Government’s resolve. We urge that the report’s recommendations are implemented fully and swiftly.  

 

The Ombudsman’s report finds the individual Garda in one of these cases did not hold prejudicial attitudes toward Roma. Nevertheless, the actions were discriminatory. In the second case, the Gardaí’s actions were deemed by the Ombudsman to meet the definition of ‘ethnic profiling’.

 

 “Steps must be taken to ensure this discriminatory approach is not repeated. While the Ombudsman found no evidence from these cases of systemic racial profiling within An Garda Síochána, measures must be taken to identify and address any such concerns.

 

”When Ireland declined recommendations made to it by members of the UN Human Rights Council during its Universal Periodic Review in 2011 concerning racial profiling by its police, it stated that ‘An Garda Síochána does not engage in, or carry out, this practice’.  It is time for the Government and the Gardaí to now determine if there is indeed a problem of racial profiling to be addressed.” said Colm O’Gorman.

Several victims of North Carolina's nearly five-decade-long forced sterilization program testified Wednesday to a board deciding how to compensate people whose ability to have children was taken away from them in the name of improving society.

Nearly 3,000 of the roughly 7,600 North Carolinians sterilized between 1929 and 1975 are still alive. The Eugenics Task Force is considering whether they should be given money or other types of assistance.

 

Elaine Riddick said she was sterilized in 1968 at age 13, a year after being raped by a neighbor and giving birth.

 

"They cut me open like I was a hog," a sobbing Riddick said. "My body was too young for what they did."

 

Other victims said they were lied to about the purpose of the surgery.
