Aiding and abetting a culture of corruption

Aiding and abetting a culture of corruption | Ethics | Scoop.it

Jean Ensminger is studying a corruption network linked to aid money, using interviews and quantitative analytical methods to follow the money disbursed by a large World Bank project in Africa...

I'm an economic anthropologist. I have spent my career trying to understand how economic systems work from the grass roots up in developing countries. Right now I'm studying the role of corruption in that process. Most corruption studies look at grand scandals on the national level, but I also want to understand the impacts of corruption when it percolates down to ordinary people at the village level. Once corruption reaches this level, it has usually become the social norm and works like a vortex sucking more and more systems and individuals into its grip.

There is no methods book that teaches one how to conduct a study of this sort. But that has been part of the excitement, as I had to invent the process as I went along. Had I not built up a lot of trusted networks from 30 years of research in Kenya this would not have been possible. Trust is everything in a project of this sort. Another thing this process has taught me is that time is your friend. The data get better and better.

Navigating the minefield: Bribery and corruption in business

Navigating the minefield: Bribery and corruption in business | Ethics | Scoop.it

With harsh penalties and greater enforcement, businesses around the world are grappling with the challenges of effectively dealing with bribery and corruption.

Bribery and corruption are global concerns that undermine efforts to end poverty and have significant negative implications on trade and economic growth. As a result, most jurisdictions around the world have enacted legislation to criminalise such conduct by becoming signatories to the 1997 OECD Anti-Bribery Convention (the Convention).1

There are jurisdictional variations in the scope and specificity of the legislation introduced to give effect to the Convention, including:

whether the prohibition of bribes is limited to bribes paid to public officials (public sector bribery), or whether bribery in transactions with other corporates (private sector bribery) is also prohibited2;whether the bribe payer and the recipient are both deemed to have committed an offence;whether “facilitation” payments are permitted3; andin what circumstances a company can be held liable for the corrupt acts of its employees or agents.

Putting aside these nuances, the common theme of the various global laws is to impose a criminal prohibition on the bribery of foreign public officials, together with significant criminal and civil penalties (both pecuniary and imprisonment) for contraventions of that prohibition.

Whistleblower tip-offs soar in the UK - FT.com | Ethics | Scoop.it

Conscience, fear and the possibility of financial reward have spurred whistleblowers to offer information to regulators, raising the number of tip-offs to new highs.

The tough regulatory penalties emerging from the Libor scandal, as well as better incentives for whistleblowers, have encouraged more people to report potential wrongdoing to UK and US financial regulators, researchers have found.

As a result, in the year to October 31, the Financial Conduct Authority opened 72 per cent more cases based on intelligence from whistleblowers than its predecessor did in the preceding 12 months. In April, the FCA took over supervision of the conduct of regulated financial companies from the Financial Services Authority.
