In a high-stakes bid to wrest control of California's prison system from federal oversight, opposing lawyers for the state and for 33,000 inmates sparred Wednesday over whether the state violated legal ethics by interviewing mentally ill prisoners...

The lawyers describe the sessions as being conducted in secret despite the legal requirement that they be present for all those tours and interviews.

"They interviewed our mentally ill clients without our knowledge about the case and then they used the evidence (to buttress their claims that conditions in the prisons have improved)," Don Specter, head of the Prison Law Office, told reporters after the hearing.

"They didn't really explain to the mentally ill clients what the purpose of the interviews were, so the inmates had no idea who they were speaking to, they had no idea for the reason."

Those interviews and the 50 expert declarations based on them that were filed with the court by the state now are at the heart of a heated dispute over whether California has made enough progress in improving access to mental health care at a constitutional level inside its prisons.

The inmate attorneys want the declarations thrown out, a move that would cripple the state's efforts in court to rid its self of the 23-year-old class action.

“I just watched it again and recognized the low block wall and the elementary school! It was right there where my sister and her husband live! OMG how frightening!” one YouTube commenter responded, while others insisted the patrols were a routine occurrence.

However, another respondent insisted that the patrol was not normal.

“During the last few seconds I got a quick glimpse of my sister and brother-in-laws house on Fuschia. Ave,” wrote the commenter.”That motorcycle was parked almost in front of their house. They told me they saw this procession going on from their front yard. They have lived in that house for 30 or so yrs and this is the first time they have seen this type of thing in their neighborhood. Might be a common thing to do their training someplace else but not in that area.”

Concerns about the presence of troops on American streets have heightened since the announcement of Jade Helm, an upcoming nationwide military exercise which some fear is a dry run for martial law.

As we reported earlier this week, a National Guard drill based around dealing with civil unrest after a dirty bomb attack in Richmond, California featured role players acting as angry Americans yelling ‘right-wing’ rhetoric.

Footage captured by a local shows Guard troops pushing irate citizens away with batons before one of the protest group states, “I’m a sovereign citizen, I refuse to recognize you guys, I refuse to recognize you.”

Disturbing video out of Fort Lauderdale, Florida last month also showed military and law enforcement practicing the internment of citizens during martial-law style training.

Lindsay Rains has worked steadily for the last few years as an environmental scientist at the California Department of Food and Agriculture’s offices in downtown Sacramento.
Doingtime2's insight:

The maneuver is one state departments have used to pad their budgets with millions of tax dollars earmarked for employee salaries. By law, they are supposed to lose the money when a position goes unfilled for six months. Instead, they have simply altered the identifying numbers to make it appear that a job was filled with a transferred employee, thus avoiding a cut to their budgets.

The unspent salary money can then be used to cover other operating costs, such as leave balances, office rent, new equipment or employee raises.

The transfers don’t promote the employees, who may not even know about the numerical changes. Officials at the Department of Food and Agriculture declined to respond to inquiries.

Thousands of personnel transfers reviewed by The Sacramento Bee show similar patterns throughout state government.

Mike Genest, former Republican Gov. Arnold Schwarzenegger’s finance director, looked through some of the state transfer data and called the patterns he saw “smoking-gun stuff” that strongly suggests departments have gamed the law.

“If you think about it, people had to scheme to do this,” Genest said. Now outside government, he sees the practice as a problem, but he acknowledged he allowed it when he worked as a deputy director for the Department of Social Services and the Department of Health Services in the 1990s.
