Federal judge accuses state of ethical lapses in prison case - The Sacramento Bee

Federal judge accuses state of ethical lapses in prison case - The Sacramento Bee | Educating & Enforcing Human Rights For We The People !! | Scoop.it
In a high-stakes bid to wrest control of California's prison system from federal oversight, opposing lawyers for the state and for 33,000 inmates sparred Wednesday over whether the state violated legal ethics by interviewing mentally ill prisoners...
Doingtime2's insight:

The lawyers describe the sessions as being conducted in secret despite the legal requirement that they be present for all those tours and interviews.

"They interviewed our mentally ill clients without our knowledge about the case and then they used the evidence (to buttress their claims that conditions in the prisons have improved)," Don Specter, head of the Prison Law Office, told reporters after the hearing.

"They didn't really explain to the mentally ill clients what the purpose of the interviews were, so the inmates had no idea who they were speaking to, they had no idea for the reason."

Those interviews and the 50 expert declarations based on them that were filed with the court by the state now are at the heart of a heated dispute over whether California has made enough progress in improving access to mental health care at a constitutional level inside its prisons.

The inmate attorneys want the declarations thrown out, a move that would cripple the state's efforts in court to rid its self of the 23-year-old class action.

Go Left America - WHOA: Forbes Counts $2 Trillion in Corporate Offshore Profits: Obama Wants to Tax

Go Left America - WHOA: Forbes Counts $2 Trillion in Corporate Offshore Profits: Obama Wants to Tax | Educating & Enforcing Human Rights For We The People !! | Scoop.it
Doingtime2's insight:

Corporations like GE, which receive many benefits by being registered as American companies, are making a boat load of profits, and not paying taxes on that money when deposited in offshore accounts. President Obama has a good idea. Tax it.

Joseph Kennedy told Forbes Magazine, “Companies are strongly driven by the need to increase shareholder value, and especially any public company has to meet market expectations." That means, if you don't have to report it, why do so?

Says Forbes, "Whatever the reasons, the potential tax revenue from offshore profits is tempting to U.S. lawmakers, who have been struggling to fund road projects" and other infrastructure issues which would provide jobs as well.

These companies enjoy the benefits afforded to American companies exporting goods and services, but are not paying their fair share to the nation through which they derive those benefits and which needs their help. In fact, those benefits are given with the expectation that it will be a boon to the country.

President Obama doesn't want to repatriate the money, but simply impose a 14 percent mandatory tax on stockpiled profits and a 19 percent minimum tax on foreign earnings going forward.

That would generate nearly $300 billion dollars which could create jobs repairing the nation's crumbling roads and bridges.

After decades of conflict, Israeli women say 'enough'

After decades of conflict, Israeli women say 'enough' | Educating & Enforcing Human Rights For We The People !! | Scoop.it
As Israel readies for a general election, the issue of peace with the Palestinians has been noticeably absent from debate. Braving intermittent rain to stand for hours outside Israel's parliament building in Jerusalem this week, thousands of women, young and old, religious and secular, Arab and Jewish, chanted and waved placards, demanding a solution to the conflict be found, or at least discussed, by politicians. The Women Wage Peace organisation, formed after a devastating summer war in the Gaza Strip that killed nearly 2,200 Palestinians and 73 people on the Israeli side, are hoping their voice will be heard as Israelis go to the polls on March 17. The group's aim is to push the next government, whichever that is, to resume peace talks with Palestinians and come to a final agreement that will end decades of often bloody conflict.

I Was Alabama’s Top Judge. I’m Ashamed by What I Had to Do to Get There.

I Was Alabama’s Top Judge. I’m Ashamed by What I Had to Do to Get There. | Educating & Enforcing Human Rights For We The People !! | Scoop.it
I felt trapped. I had made it to the top of my profession. I was the chief justice of Alabama, the first woman to head the state Supreme Court. It was, for a lawyer like myself, the pinnacle of achievement. And I’d earned it the hard way. To get to the justice’s chambers, I had won the nation’s most expensive judicial race that year. But at what cost?

I had needed $2.6 million to win—and that money had to come from somewhere. My opponent had raised even more, nearly $5 million in all. It’s terribly awkward and uncomfortable for a judge to have to ask for campaign money. But how are you going to win without it? My biggest concern is how shameful all of this looks to the public.

Two days after my election in 2006, I was with my daughter, Caitlin, on a school field trip when my cellphone rang. A reporter from a national legal publication was calling. Would she ask, I thought, about my election as Alabama’s first female chief justice? Or my plans for reform after holding court in some 40 of Alabama’s 67 counties over 25 years?

“Judge Cobb,” she asked, “how does it feel to be the victor of the most expensive judicial race in the United States this year? And how can you assure the people of Alabama that the contributions you sought are not going to impact how you rule? And how can you convince the people of Alabama not to believe that their courts are for sale?”

cheryl-dorsey-175Our collective voices are now magnified and unified. We demand an end to the pandemic of deadly force being perpetrated, by some in the law enforcement community, against unarmed and non-threatening citizens;.
