Being tested with a BAC level of 0.01-0.04% while being under the drinking age in California is a civil penalty that is usually governed by the DMV where the offender will not have to appear in court but rather in a DMV hearing. Of course, one’s attorney can still appeal an underage DUI charge on behalf of his or her client despite the penalty being civil and not criminal.

This is not the purpose of a DUI arraignment. The arraignment is where you will find out what criminal charges have been filed against you, your Constitutional rights, as well as bail status. This is also where you are given your first opportunity to enter a plea: no contest, not guilty, or guilty.

Displacement of Alcohol harms? Credible 'enabled' education? Respect or rule of Law? or a combination of all three (or more).

 

I believe a review of the med-pot States vs the non-med pot States is showing similar decreases in fatalities, particularily in the at risk group, <25 males.

On one hand, part of the country is working out legitimate market technicalities while on the flip side, many regions of the country continue to arrest and lock up hundreds of thousands of people every year for a marijuana-related crime, 90% of which are for possession only.

New federal legislation governing ignition interlocks for drunk drivers will be introduced when the House of Representatives reconvenes this week.

The proposed law, to be presented on Tuesday by Representative Nita Lowey (D-NY), would mandate that states require all convicted drunk driving offenders to install an ignition interlock for a minimum of six months.
