Police officer fired for DWI charge

Police officer fired for DWI charge | What Every Drug User and Drinker Should Know About Law | Scoop.it

“An Austin police officer has lost his job under Police Chief Art Acevedo’s zero tolerance policy for Austin Police Department officers involved in DWIs. A disciplinary memo shows Ofc. Albert Arevalo had blood alcohol levels of .175 and .178 after he submitted to breath and blood tests – more than twice the legal limit.”

Law Office of David D. White, PLLC's curator insight, October 5, 2015 11:50 AM

In May of this year, Austin police officer Albert Arevalo was stopped for speeding. He was off-duty at the time. Arevalo admitted visiting six bars with friends earlier that night, and said he had one drink at each bar over a span of six hours. A memo on the incident says that Arevalo’s BAC was more than twice the legal limit at the time of the stop. The arrest comes on the heels of a “zero tolerance” policy on officer DWI’s introduced by APD Chief Art Acevedo in April of last year. Interestingly, the policy applies even if a case is dismissed. The matter will likely be referred to arbitration, which could take six months. The DWI case itself is scheduled for a court hearing on October 2.

It is interesting to see and note, it is generally the smaller countries, (not the major players in Anglophile led global western capitalism), who have been/are leading the way to alternative drug policies: Uruguay, Ecuador, Netherlands, Czech Republic, Portugal, Spain and Switzerland.

I suspect one of the many reasons is the vested interest of the the pharmaceutical industry and the power and influence of the legal drug industry (alcohol, tobacco, and caffeine) in Anglophile capitalist countries,

Law Office of David P. Shapiro's curator insight, May 19, 2015 7:13 AM

In this video, San Diego DUI lawyer David P. Shapiro discusses questions to ask, and issues to be aware of, when you are looking to hire an attorney to represent you in a DUI case.  For example, experience as an attorney, or even a criminal attorney, is not enough – you’ll want to hire a lawyer with plenty of recent DUI experience, including DUI jury trial experience.  Other issues include the reputation of the lawyer in the legal community among colleagues, prosecutors, and judges.  Does the attorney keep up with the latest changes in the law by attending DUI seminars?  How would the attorney plan for a defense in your case?  And how would that plan be implemented?  Only by asking the important questions will you obtain the information necessary to make the right decision when choosing an attorney for your DUI defense.

Just as no legislator wants to be seen as “soft on drunk driving,” no prosecutor wants a career to be jeopardized by failing to get enough DUI convictions.
