Local communities have triumphed over the fracking industry inprecedent-setting case decided today by the New York Court of Appeals, the state’s highest court.

In a test case pitting community rights against the oil and gas industry, the Court ruled that the towns of Dryden and Middlefield can use local zoning laws to ban heavy industry, including oil and gas operations, within municipal borders.

In 2013, the government of Ecuador launched a major strategic research project to “fundamentally re-imagine Ecuador” based on the principles of open networks, peer production and commoning. A guiding idea in this effort is Buen Vivir (Sumak Kawsay) or “good living”, an indigenous peoples’ concept that refers to a life that balances material, social and spiritual needs. Ecuadorian President Rafael Correa has urged young people to achieve and fight for this open knowledge society. The long-term challenge, of course, is getting governments to whole-heartedly embrace and ratify such visions and working out in detail how Ecuador and other nations might make a smooth transition to a commons-based peer production society.

Earlier this week, the stadium in Phokeng outside Rustenberg exploded in jubilation at the end of South Africa’s longest strike. Workers had changed history. They had valiantly resisted the dogged state and corporate attempt to smash their strike despite the personal hardships that they had to endure to reach this point. At last, it is workers who have dealt a blow to capital, as they determinedly held out for a better deal despite accumulating five months of unpaid accounts, getting blacklisted, keeping their kids out of school and going without food. They are the central heroes in this story and these are their voices.

But even via the mediation of a television screen, it was clear that at Marikana there was a very different view among the workers and their families. Instead of viewing affirmative action as a policy designed to assist blacks overcome the legacy of apartheid, mainstream whites regard it as a confirmation of black inferiority. This is partly why the debate about the change in admission policies of some universities is presented as something good for blacks. It is argued that a move away from a reliance on affirmative action to achieve diversity will reduce racial stereotyping. This argument fails to take into consideration the fact that in post-apartheid South Africa, it is not overt racism that hinders the social mobility of blacks, but the racial advantage that whites enjoy through acts of favouritism that whites show each other through opportunity hoarding.
