"By: patrick devlin Tuesday February 25, 2014 4:45 pm  The US Supreme Court has handed American law enforcement agencies an unqualified victory that arguably restricts the Constitutional prohibition against unwarranted searches and seizures.

In a split decision the court ruled that even when a person who is the subject of a law enforcement investigation has refused to have his home searched by police, the Supreme Court determined that, if law enforcement officers simply ask another person who happens to live at the same address while the investigatory target is not present (a type of third party consent referencing another’s constitutional rights) the law enforcement agents can now accept that third party’s accession and not have to (as is described in this well-known document) seek a judge’s order to conduct a search."

"If the government wants to track our cell phones, or see what web sites we’ve visited, or rummage through our Gmail, or read our private messages on Facebook, the Constitution requires it to go to a judge and get a search warrant based on probable cause. Right now, there’s a law on the books that doesn’t make that requirement clear—and it's time we demand a privacy upgrade.

The government should be explicitly required to go to a judge and get a warrant before it can read our email, access private photographs and documents we store online, or track our location using our mobile phones. Please support HR 1852 The Email Privacy Act, which would update the Electronic Communications Privacy Act of 1986 (ECPA) to make crystal clear that warrants are required before the government can access this sensitive information."

"Este perro aparecio hace una semana en mi barrio... parecia manso pero todos le temiamos por su raza... yo tengo miedo de salir en las mananas ya que el perro me sigue y temo que me muerda... anoche un perrito le paso por el lado y lo ataco brutalmente... el perro tubo una muerte larga y dolorosa... Gracias al gobierno de PR por no hacer nada como siempre .. estamos cansados de pedir ayuda y de que nos ignoren como de costumbre...." MDA

WASHINGTON (AP) — A Brooklyn man in prison for terrorism may have a new opportunity to challenge his conviction because the government only recently told him how it obtained evidence it intended to use against him. It was through one of the National Security Agency's secret surveillance programs.

 

On Monday, the government notified Albanian citizen Agron Hasbajrami it had intended to use information from the warrantless surveillance program — something that federal law required him to be told in September 2011. Hasbajrami pleaded guilty in 2012 to a terrorism charge after admitting he tried to go to Pakistan to join a radical jihadist insurgent group. He was sentenced to 15 years in prison.

On Feb. 26, the application and affidavit used to obtain the search warrants for the 2010 raids on homes and offices of anti-war and international solidarity activists were unsealed, revealing lies and attacks on the constitutionally-protected rights to speak out and organize. The unsealing of these documents came as a result of legal action taken by the anti-war activists.

The timeline in the documents show what we have always stated. Shortly before the huge protest at the Republican National Convention, undercover police agent and professional liar, going by the name of Karen Sullivan (identified in the affidavit as UC1) joined the Anti-War Committee and became active in the efforts to build the demonstration. She later joined Freedom Road Socialist Organization.
