Matter of FACT federal management itself gave aid to my would be assassins which I have well documented. The final outcome is though I escaped death our home was totally destroyed. Cleveland 12-year-old killed in police shooting after reportedly brandishing replica air gun.

Police were summoned to the scene outside a recreation center by a 911 caller who said someone -- possibly a juvenile -- was pointing a gun at people.

"There's a guy in there with a pistol, you know, it's probably fake, but he's like pointing it at everybody," the caller said, according to audio provided by CNN affiliate WEWS.

"He's sitting on a swing right now, but he's pulling it in and out of his pants and pointing it at people," the caller said. "He's probably a juvenile, you know?"

When the two officers arrived, the boy did not point the weapon at them or otherwise threaten them, Deputy Chief Ed Tomba of the Cleveland Division of Police told reporters early Sunday.

But he did reach for the weapon, Tomba said.

"The officers ordered him to stop and to show his hands and he went into his waistband and pulled out the weapon," he said.

Tomba showed reporters the weapon -- a large, black BB- or pellet-type replica gun resembling a semiautomatic pistol. An orange tip indicating the gun was an air gun had been removed, police said.

It wasn't clear if officers had been told the weapon was not a firearm, Officer Ali Pillow told CNN on Sunday.

Both officers have been placed on leave, police said.

The 12-year-old's name has not been released by police. He died early Sunday at MetroHealth Medical Center following surgery, according to the hospital and the family's attorney.

David Slepkow's curator insight, January 7, 2015 12:51 AM

The theory of the lawsuit Ms. Gonzales filed in federal district court in Denver was that Colorado law had given her an enforceable right to protection by instructing the police, on the court order, that "you shall arrest" or issue a warrant for the arrest of a violator. She argued that the order gave her a "property interest" within the meaning of the 14th Amendment's due process guarantee, which prohibits the deprivation of property without due process.

The district court and a panel of the United States Court of Appeals for the 10th Circuit dismissed the suit, but the full appeals court reinstated it and the town appealed. The Supreme Court's precedents made the appellate ruling a challenging one for Ms. Gonzales and her lawyers to sustain.

A 1989 decision, DeShaney v. Winnebago County, held that the failure by county social service workers to protect a young boy from a beating by his father did not breach any substantive constitutional duty. By framing her case as one of process rather than substance, Ms. Gonzales and her lawyers hoped to find a way around that precedent.

But the majority on Monday saw little difference between the earlier case and this one, Castle Rock v. Gonzales, No. 04-278. Ms. Gonzales did not have a "property interest" in enforcing the restraining order, Justice Scalia said, adding that "such a right would not, of course, resemble any traditional conception of property."

A pair of cops burst into her classroom with weapons drawn; one was carrying an AR-15 assault rifle, according to Winter Haven police officials. The intrusion so frightened Lauren that she immediately texted her mother, Stacy Ray.

"I'm panicking because I'm thinking that it's a legitimate shooter is coming, that something bad is happening at the school," said Ray, who additionally received similar text messages from her other very frightened children. One of them said, "I thought he was going to shoot me."

"We have to do it this way"

Only after the exercise did school officials send out an email in which they described it as a "lockdown active shooter drill." Again, until then neither students nor parents had a clue that the drill was to take place.

Polk County Schools spokesman Jason Geary told reporters that it is standard operating procedure for such drills to occur without prior notification to parents or warning to children and teachers. Winter Haven Police Chief Charlie Bird added that a lack of prior notification was necessary in order to be able to adequately evaluate the school's response.

"It's very important that, when you do your drill, you do it without everyone knowing that it's a drill," Bird told the local FOX station. "How you train and how you prepare is how you're going to react when everything goes bad."

Current drug laws need a whole range of fixes, but there is one issue where relatively simple changes in the law could literally mean the difference between a life behind bars and a fresh start for thousands, while saving millions in taxpayer funds: I’m talking about sentencing reform.

As the drug war rhetoric grew more aggressive over the years, legislation often followed suit. Politicians don’t like to appear “soft on crime,” and harsh sentences seemed like an easy way to earn the requisite credentials for public office. As a result, the United States currently keeps more people in prison than any other country in the world.

More than 2.4 million people languish in federal, state and county prisons, many of them non-violent drug users serving life sentences triggered by misguided three-strike laws that don’t distinguish between petty theft and armed robbery. Prisons everywhere are overcrowded, while law enforcement and judicial resources are wasted. It’s a travesty that has created a vicious and inescapable cycle of incarceration, ruining the lives of thousands of non-violent offenders in the process.

This fall, on November 4th, voters in California have a chance to set an example and roll back years of injustice and waste by making the right choice at the ballot box.
