Cut limitation period for whiplash claims to six months, say LMA | Content Marketing | Scoop.it

In response to the Transport Select Committee’s inquiry into whiplash, the Lloyd’s Market Association (LMA) has proposed that the limitation period for bringing whiplash claims should be cut to six months. As an alternative to that (instead of cutting the three-year limitation period for whiplash claims), the LMA said damages should be reduced for claims submitted more than six months after an accident.

 

The LMA’s five-point whiplash plan is as follows:

 

- Increase the level of injury claims handled by the Small Claims Track from the current £1k to £5k

 

- Introduce a new medico-legal process with stronger governance of costs, production and content of medical reports. Further, the LMA wants to see fewer medical agencies owned by solicitors

 

- Publish a new public tariff of damages that courts can award to whiplash claimants, dependent on the severity of their condition (akin to the French system)

 

- Reduce the period in which a whiplash claim can be made from three years after the accident to six months (or decrease damages for claims submitted more than 6 months after an accident)

 

- Initiate a new public debate on the appropriate level of damages for whiplash claims in the UK
