‘Claim The Sky!’ – support the global initiative with your signature


“We, as the global citizens of Earth, hereby CLAIM THE SKY! and Demand the Creation of an Atmospheric Trust”

“The COP21 in Paris represents a turning point in climate negotiations. Climate action is no longer a matter just for governments. Society is compelled to recognize that the atmosphere is a public good. Pope Francis in his recent encyclical and speeches has reinforced this view that the climate is a “common good” that needs protection. We now need avenues for broader participation and action.

One legal movement in this direction is broadening the application of the public trust doctrine, which holds that certain natural resources are to be held in trust to serve the public good. It is every government’s responsibility, as trustee, to protect these assets from harm and maintain them for the public’s use. Under this doctrine, governments cannot give away or sell off these public assets to private parties. Recent court cases in the Netherlands and Washington State, USA have confirmed the government’s responsibility to protect common assets. In the Washington State case, Superior Court Judge Hollis R. Hill ruled that Washington’s government has “a constitutional obligation to protect the public’s interest in natural resources held in trust for the common benefit of the people of the State.”

The global atmosphere is certainly one of our major common assets and should be held in trust and protected from harm for current and future generations. Under the public trust doctrine, all countries are co-trustees in the global atmosphere. A subset of countries can therefore agree to establish an Atmospheric Trust (AT), as an independent agency to serve as trustee.

We, the undersigned, are calling on the V20 to take the lead by creating this Atmospheric Trust (AT) that establishes community property rights over the atmospheric commons. As some of the most vulnerable countries to climate change, the V20 can use the AT as a legal instrument to increase their voice and power in addressing the climate crisis.

How? The AT can collect claims for damages to the atmosphere and invest funds in mitigation, adaptation, and compensation, while also providing resources for the most affected populations. Only 90 enterprises (mainly extractive industries) are responsible for 2/3 of global carbon emissions. This means that damage claims could target a relatively small number of entities.

Civil society pressure will be of great value to turn this into a global movement and counteract potential corporate resistance. A concerted effort to ‘claim the sky’ as a public trust on behalf of all of global society, in combination with the solid legal framework of the public trust doctrine can work.

This approach can significantly change the whole discussion about how to deal with climate disruption. Rather than national governments negotiating with each other about emissions, governments can see themselves as co-trustees with a fiduciary responsibility to protect the atmospheric commons. As Mary Wood notes in her book “Nature’s Trust”, ‘Trustees have an affirmative obligation to recoup monetary damages against third parties that harm or destroy trust assets” (p. 185). If an oil spill occurs in the oceans, governments collect natural resource damages for cleaning up the mess. Yet they sit idle in the face of a catastrophic ‘spill’ of carbon dioxide into the atmosphere.

We, the undersigned, strongly urge the V20, as co-trustees of the atmospheric commons, to take the lead by establishing an independent Atmospheric Trust on behalf of current and future generations.

I just signed this petition at iPetitions.com, and wrote:

What is needed now is a change of consciousness. We must face the facts of what scientists report is happening to the planet we live on, and how we, the seven billion humans (and counting), are playing with fire.

We must accept the reality that economic growth based on the exploitation of finite resources and destruction of our planet's ecosystem is becoming a threat to our own wellbeing and safety - and that to millions of people it will soon even become a threat to their survival. It is time to clear the air, literally, and start that transformation of our economy to one which is 'circular'.

We must re-build our communities, our infrastructure and systems to something which is sustainable with a long-term perspective. Saying goodbye to the economic growth-model is at the same time saying hello to creating new jobs and building communities where moral sensibility and conscience is cultivated, and where fear, isolation, woundedness and hatred can be replaced with a sense of unity and togetherness.

We have that option. It is up to us, if only we start making the right decisions now, advocating for that change of consciousness.

Anglesea has endured pollution from Alcoa's brown coal fired power plant for 46-years to support large scale employment at the now defunct Point Henry Smelter in Geelong.

The power plant will close forever on 31 August 2015 and the site will then be cleaned up as part of a process that may take several years.

Unless the Alcoa owned land in Anglesea is donated to the community there is a risk that the land could be rezoned for development, potentially changing the character of our small...

What they all are saying? They are saying that governments currently are putting their citizens in danger by failing to address greenhouse gas emissions, and that this is an urgent matter. They are also saying that this is so serious that we can’t just lean back and wait for our governments to wake up. We all need to take action and reduce our carbon footprints down to zero, step by step, over the next decade or two.

According to Bloomberg, the big shift in power generation, though, isn’t likely to be because of a grand climate agreement, national polices or carbon pricing scheme. Instead, it comes down to cold, hard cash with renewables offering more power-generating bang for the buck than fossil fuels. Which is maybe the best news of them all.

Victoria doesn’t need more coal mines ruining our land and making climate change worse. But the government has approved four new coal licences in Gippsland. Tell Premier Andrews to clear the air and rule out more dirty coal mines in Victoria once and for all. 
The UN climate chief Christiana Figueres is clear: there is no room for new coal. Coal is already responsible for half of Victoria’s emissions, which are among the worst per person in the world. Now is not the time to be going backwards. Proposals for more coal projects are a ticking time bomb for our climate.
And yet the Andrews Government recently approved four new coal exploration licences in Victoria. They’ve also inherited proposed coal export projects in the Latrobe Valley from the previous Coalition Government.  Unbelievably if these plans progress, this coal could be exported through Corner Inlet, right next to Wilsons Promontory National Park.
The government has said it wants Victoria to be a leader on climate change, so dirty coal plans like these have to stop. Premier Andrews, it’s time to say no to dirty coal projects in Victoria once and for all.
