The recent media storm over the so-called “Muslim foster carer” story has highlighted the continuing debate over transparency in the family justice system. We look at how the story emerged and consider the role played by open justice in the context of a multi-agency care system. The story broke on 28 August 2017 with a stark headline that spoke of religious intolerance and child cruelty: “Christian child forced into Muslim foster care”. Both the headline and the tone of the story seemed unusual for The Times, more like what you’d expect in the Daily Mail. It was accompanied by a rather sinister-looking photograph, taken from behind and partially pixelated, showing a blonde white girl being led away by a woman shrouded in a black hijab. We advise parents, grandparents, other relatives and friends about their rights and options when social workers or courts make decisions about their children’s welfare.
